Measures of Tangshan Municipality on the Administration of Urban Nightscape Lighting

Article 1 In order to standardize the setting and management of urban night lighting facilities and beautify the city appearance and environment, these Measures are formulated in accordance with the relevant provisions of the Regulations of Tangshan Municipality on the Administration of City Appearance and Environmental Sanitation and in combination with the actual situation of this Municipality. Article 2 These Measures shall apply to the setting and management of night lighting facilities within the planning scope of the central area of this Municipality (lunan district, lubei district and Hi-tech Zone).

The term "night lighting facilities" as mentioned in these Measures refers to the lighting facilities and ancillary equipment attached to buildings, structures, roads, bridges, tunnels, squares, parks, green spaces, stations, airports, outdoor advertisements, rivers, water surfaces and other facilities. Article 3 The municipal administrative department of urban management shall be responsible for the management of urban night lighting in urban areas. The district urban management administrative department is responsible for the daily management of night lighting within its jurisdiction.

The municipal administrative department of urban and rural planning is responsible for the preparation of the overall planning and detailed planning of the city's night lighting.

The administrative law enforcement department of urban management is responsible for punishing acts that violate the provisions on night lighting management.

Finance, construction, housing management and other administrative departments shall, in accordance with their respective responsibilities, do a good job in night lighting. Article 4 Nightscape lighting facilities and their ancillary equipment shall be set up in the following places in the central area of a city:

(a) landscape street, commercial street, both sides of the city's main (secondary) road, and buildings around the square;

(two) urban branch roads with relatively concentrated buildings and commercial stores above 6 floors;

(three) squares, bridges, flower beds, parks, green spaces, important scenic spots and other municipal facilities;

(four) all kinds of windows, plaques, outdoor advertisements and signs;

(five) other parts that need to be set at night. Article 5 The municipal administrative department of urban management is responsible for examining and approving the design scheme of night lighting with a single building area of less than 20,000 square meters, and the municipal administrative department of urban and rural planning is responsible for examining and approving the design scheme of night lighting with a single building area of more than 20,000 square meters (including 20,000 square meters).

The architectural design scheme reported by new projects (including residential and commercial buildings) shall include night lighting scheme. Article 6 The setting of urban night lighting facilities shall conform to the relevant standards of urban night lighting planning and public lighting facilities. Seventh units and individuals engaged in the design, construction, management, maintenance and repair of urban night lighting facilities shall have corresponding qualifications and business qualifications according to law. Eighth city night lighting construction shall meet the following requirements:

(a) new construction, renovation and expansion projects shall, in accordance with the provisions of Article 4, design, construction, acceptance and use of night lighting facilities and construction projects simultaneously, and the expenses shall be included in the total investment of the project construction;

(two) landscape street, commercial street, one or two street roads, square around the construction site set up night lighting color light door and lighting enclosure;

(3) Outdoor advertising should be equipped with lighting facilities and equipment;

(four) night lighting facilities shall not affect astronomical observation, traffic and navigation safety;

(five) city night lighting facilities should be fireproof, windproof, shockproof, waterproof, lightning protection and leakage prevention;

(six) property units should check the night lighting facilities, timely repair damaged or faulty facilities, to ensure the normal operation of lighting facilities. Ninth changes, relocation, demolition of night lighting facilities, shall be approved by the original examination and approval department before implementation.

Altering, moving or dismantling night lighting facilities, which causes damage to the buildings and landforms where the original facilities are located, shall be repaired. Tenth city night lighting facilities construction and maintenance by the property unit is responsible for the investment; Municipal facilities and government departments and other buildings lighting funds according to the centralized financial examination and approval expenses. Eleventh city night lighting facilities should be turned on at the same time with street lamps; Winter shall not be earlier than 2 1, and spring, summer and autumn shall not be earlier than 22: 00.

The opening and closing time and area of night lighting facilities during major events shall be decided by the municipal government. Twelfth in violation of the provisions of article fourth and article eighth of these measures, the urban management law enforcement department shall order it to make corrections within a time limit, and if it fails to make corrections within the time limit, it shall be fined more than 500 yuan 1000 yuan. Thirteenth do not open and close the night lighting facilities according to the prescribed time, the competent department shall order it to make corrections within a time limit; If no correction is made within the time limit, the urban management law enforcement department shall order it to make corrections and impose a fine on 200 yuan every time. Fourteenth new lighting facilities without acceptance or unqualified acceptance put into use, the urban management law enforcement department shall order it to make corrections within a time limit and impose a fine of more than 500 yuan 1000 yuan. Fifteenth unauthorized changes, relocation, demolition of night lighting facilities, urban management law enforcement departments shall be ordered to make corrections within a time limit, and impose a fine of more than 500 yuan 1000 yuan; Anyone suspected of committing a crime shall be transferred to judicial organs for handling according to law. Article 16 If a party refuses to accept a specific administrative act, it may bring an administrative reconsideration or an administrative lawsuit according to law. If it fails to apply for administrative reconsideration, bring a lawsuit or perform a specific administrative act within the time limit, the organ that made the specific administrative act shall apply to the people's court for compulsory execution. Article 17 If the urban night lighting management personnel abuse their powers, engage in malpractices for selfish ends, neglect their duties, the unit to which they belong or the administrative supervision department shall give administrative sanctions to the person in charge of the unit or the responsible person; Anyone suspected of committing a crime shall be transferred to judicial organs for handling according to law.
