Chapter 1 General Provisions Article 1 In order to do a good job in flood control of the Yellow River, ensure the safety of people's lives and property and economic and social development, in accordance with the "People's Republic of China and Flood Defense Law" and the "People's Republic of China Flood Control Law" "Regulations on Flood Defense", "Regulations on the Management of National Rivers of the People's Republic of China" and other laws and regulations, these regulations are formulated based on the actual conditions of this province. Article 2 These Regulations shall apply to flood control activities in the Yellow River within this province (including the main stream of the Yellow River, the main stream of the Qin River and their beach areas, flood detention areas and reservoir areas).

The flood prevention activities referred to in the preceding paragraph include flood prevention and storm prevention.

The flood control and flood prevention dispatching of the Sanmenxia and Xiaolangdi Reservoirs on the main stream of the Yellow River and the Yihe Luhun Reservoir, Luohe Guxian Reservoir, and Qinhe Hekou Village Reservoir on the Yellow River tributaries are implemented in accordance with relevant national regulations. Article 3: The Yellow River flood control work implements the policy of safety first, constant preparedness, prevention first, and all-out emergency rescue, and follows the principle of unity and cooperation and the subordination of local interests to overall interests. Article 4: The Yellow River flood control work shall implement the administrative head responsibility system of the people's governments at all levels, implement unified command, and carry out hierarchical and sub-departmental responsibilities. All relevant departments implement a flood prevention post responsibility system. Article 5: Yellow River flood control expenses are raised in accordance with the principle of combining reasonable responsibilities of the state, local governments and beneficiaries. The costs for Yellow River flood control should be earmarked for special purposes.

People's governments at or above the county level with the task of Yellow River flood control shall, in accordance with relevant national and provincial regulations, arrange necessary funds and labor services for Yellow River flood control team training, drills, flood control material collection, flood control and emergency rescue and other flood control activities. . No unit or individual may withhold or misappropriate Yellow River flood control and disaster relief funds and materials. Article 6: Units and individuals have the obligation to protect the Yellow River flood control engineering facilities and participate in the Yellow River flood control and flood fighting in accordance with the law.

Units and individuals that have made outstanding achievements in the Yellow River flood control and flood relief work will be commended and rewarded in accordance with relevant regulations. Chapter 2 Flood Control Organization Article 7 People's governments at or above the county level that have the task of Yellow River flood control establish a flood control command organization, which is composed of heads of relevant departments, local garrison, People's Armed Forces Department and Yellow River River Affairs Department. The administrative head of the people's government serves as the commander. Flood prevention command agencies at all levels, under the leadership of the higher-level flood control command agency and the people's government at the same level, implement the superior flood control instructions, formulate various flood control measures, and uniformly direct the flood control work in their respective administrative regions.

The Yellow River flood control offices of flood control command agencies at all levels are located in the Yellow River River Affairs Department at the same level. The Yellow River flood control office is responsible for the daily work of Yellow River flood control in its administrative region under the leadership of the people's government at the same level. Article 8 People’s governments at or above the county level that have the task of Yellow River flood control shall clarify the Yellow River flood control responsibilities of the member units of the flood control headquarters at the same level and other relevant departments, and announce them to the public. Member units of flood control command agencies at all levels and other relevant departments shall be responsible for relevant Yellow River flood control work according to their respective division of responsibilities.

People's governments at all levels along the Yellow River and the Yellow River River Affairs Department should strengthen publicity and education on flood control work in the Yellow River, and strengthen awareness of flood control, beach area safety awareness and flood control engineering facility protection awareness.

The Yellow River Affairs Department is responsible for preparing the Yellow River flood control plan in its administrative region; guiding flood prevention and rescue matters; responsible for the construction and management of Yellow River emergency flood relief projects and water damage restoration projects; responsible for the national reserve of flood control materials, equipment and Management and dispatch of professional mobile rescue teams. Article 9 Flood control command agencies at all levels shall establish a Yellow River flood control inspection system to supervise and inspect the Yellow River flood control work of member units of the flood control command agency at the same level and other relevant departments and flood control command agencies at lower levels. If problems are found, the responsible units shall be ordered to make rectifications within a time limit. Article 10 The organization and management of the Yellow River flood control team adheres to the principle of combining professional flood control teams and mass flood control teams.

Professional flood control teams are organized and managed by the Yellow River Affairs Department at all levels.

The mass flood control teams are under the unified leadership and command of the people's governments at all levels and their flood control command agencies, and the Yellow River River Affairs Department is responsible for technical guidance.

The People's Liberation Army and the Armed Police Force stationed in Henan Province participated in the Yellow River flood control and rescue operations in accordance with the flood control tasks assigned by the state. Chapter 3 Flood Control Preparations Article 11 The Provincial People's Government shall, in accordance with the national flood control plan for the Yellow River Basin, the Yellow River flood prevention plan and the national flood control standards, and in combination with the actual conditions of the flood control projects, formulate a provincial Yellow River flood control plan for the year before the annual flood season. .

The people's governments of municipalities and counties (cities, districts) in the provinces along the Yellow River should formulate local flood control plans for the year before the annual flood season based on the province's Yellow River flood control plan and the actual local conditions.

Once the Yellow River flood control plan is issued, the relevant flood control command agencies and relevant departments and units must implement it. Article 12 The Yellow River flood control plan shall include flood control tasks, division of responsibilities, command and dispatch, team organization, defensive measures, material reserves and transportation, communications, power and logistics support, relocation and rescue of people in beach areas and flood detention areas, etc. Article 13 The people's government with the task of relocation and rescue shall unifiedly lead the relocation and rescue work, organize the departments of civil affairs, Yellow River Affairs, public security, transportation, health and family planning, land and resources and other departments to formulate relocation and rescue plans, and implement relocation and rescue measures. . Article 14 People's governments at or above the county level along the Yellow River shall, in accordance with the requirements of the Yellow River Basin Flood Control Plan, organize the formulation of safety construction plans for floodplain areas, and organize the planned relocation of residents living in floodplain areas.
