< p>Article 1: In order to protect citizens’ rights to assemble, process and demonstrate in accordance with the law and maintain social stability and public order, in accordance with the Law of the People’s Republic of China on Assemblies, Processions and Demonstrations and relevant laws and regulations, and in light of the city’s situation , formulate these regulations.

Article 2: Assemblies, processions, and demonstrations held in open-air public places and public roads within the administrative region of this city must abide by the Constitution, laws, regulations, and these regulations.

Article 3 The competent authorities for assemblies, processions and demonstrations in this city are the district public security bureau and county public security bureau where the assemblies, processions and demonstrations are held; the routes of processions and demonstrations pass through more than two districts and counties. , the competent authority is the Municipal Public Security Bureau.

Article 4: There must be a responsible person for holding assemblies, processions, and demonstrations. If there are more than two people in charge, one person should be identified as the main person in charge.

Organizing or participating in rallies, marches, and demonstrations in the name of state agencies, social groups, enterprises, and institutions must be approved by the principal person in charge of the unit. The principal person in charge of the approved unit shall be deemed as the person in charge of organizing or participating in assemblies, processions, and demonstrations of the unit.

Persons who have been sentenced to public surveillance, probation, parole, supervised release, or medical parole cannot be the person in charge of assemblies, processions, or demonstrations.

Article 5: To apply for an assembly, procession, or demonstration in accordance with the law, the person in charge must submit a written application to the competent authority five days before the date of the event. The application should state the following matters:

(1) Name, gender, age, occupation, address, and unit of the person in charge;

(2) The purpose of the assembly, procession, or demonstration Purpose, method, slogans, slogans, number of people, placard specifications and the content of other promotional materials;

(3) The starting and ending time and location of assemblies, processions, and demonstrations (including gathering places, stopping places, and disbanding places) ) and the route of travel;

(4) The number of vehicles, the models and license plates of motor vehicles, and the type and quantity of audio equipment used;

(5) Maintaining rallies, parades, Measures for ordering demonstrations, including the number of people maintaining order and the signs worn;

(6) Other matters that the person in charge of applying for an assembly, procession, or demonstration deems necessary to explain.

The competent authority will not accept applications made by telephone, telegram, telex, letter, entrustment, etc.

Sixth Article: When the person in charge of applying for an assembly, procession or demonstration submits a written application to the competent authority, he or she must submit his or her resident identity card for verification, fill in the application registration form for an assembly, procession or demonstration, and answer relevant inquiries from the handling personnel. . Those who organize or participate in rallies, marches, or demonstrations in the name of state agencies, social groups, enterprises, or institutions must also submit an approval document signed by the principal person in charge of the unit and stamped with the official seal.

The application time for holding an assembly, procession, or demonstration shall be calculated from the time when the competent authority accepts the application registration form for an assembly, procession, or demonstration.

Article 7: After accepting the registration form for an assembly, procession or demonstration, the competent authority shall make a written decision on whether to grant permission or not two days before the date of application. If not, the reasons shall be stated. If the competent authority fails to make a decision within the time limit, it shall be deemed to be permission.

The competent authority shall notify the person in charge of the application for assembly, procession or demonstration of its decision on permission or disapproval according to the time and delivery address agreed upon by both parties. If the person responsible for applying for an assembly, procession or demonstration fails to wait at the agreed time and address, resulting in the competent authority being unable to deliver the application, the application will be deemed to have been withdrawn. If the competent authority fails to deliver the notice at the agreed time and address, it shall be deemed as permission.

Article 8 If the person in charge of applying for an assembly, procession or demonstration is dissatisfied with the competent authority’s decision not to grant permission, he may apply to the people’s government at the same level for reconsideration within three days from the date of receipt of the decision notice. The people's government shall make a decision within three days from the date of receipt of the application for reconsideration.

Article 9 If any of the following circumstances occurs, the competent authority may change the time, place, and route of an assembly, procession, or demonstration when or after making a decision to grant permission, and promptly notify the person in charge:

(1) During peak traffic hours;

(2) Others have applied for and obtained permission at the same place and route during the same time;

( 3) There are major foreign affairs activities or other major activities at the same place and route at the same time;

(4) Road construction or other municipal construction is in progress and it is impassable;

(5) Infectious disease epidemic areas;

(6) Others that will seriously affect the smooth progress of assemblies, processions, and demonstrations, or traffic order and social order.

Article 10: If you apply to hold an assembly, procession or demonstration to resolve specific issues, after accepting the application, the competent authority may notify the relevant agency or unit to negotiate with the person in charge of the assembly, procession or demonstration to resolve the issue, and may Postpone the application date for five days.

After receiving the notice, the relevant agencies or units shall conduct consultations without prevarication, and shall notify the competent authority in writing of the results of the consultations within three days.

If the person in charge of applying to hold an assembly, procession or demonstration refuses to negotiate, the application will be deemed to have been withdrawn.

Article 11 The competent authorities shall take the following measures to ensure the smooth progress of assemblies, processions and demonstrations held in accordance with the law:

(1) Deploy people's police to maintain traffic order and social order, And designate the on-site person in charge of the People's Police;

(2) Issue temporary special passes to motor vehicles used in rallies, processions, and demonstrations;

(3) Issue licenses to the audio equipment used. Give site use permit.

Article 12 People’s police who disrupt the following gatherings, processions, and demonstrations held in accordance with the law shall stop them; if they do not obey the stop, the public security organs may impose a warning or detain them for not more than 15 days:

< p>(1) Using violence and coercion to disrupt assemblies, processions, and demonstrations;

(2) Gathering crowds to attack assemblies, processions, and demonstrations;

(3) Using other methods Disrupting rallies, processions, and demonstrations.

Article 13: When holding assemblies, processions, or demonstrations, you must not violate public security regulations, conduct criminal activities, or incite crimes.

Citizens who participate in rallies, processions, and demonstrations must carry resident ID cards or other valid documents that can prove their identity, and abide by the following regulations:

(1) No weapons, Control knives, explosives and other dangerous goods;

(2) Vehicles shall not be intercepted, roadblocks shall be set up, and vehicles and transportation facilities shall not be damaged;

(3) State agencies, Military agencies, radio stations, television stations, newspapers and other units;

(4) No scribbling, posting of slogans, cartoons and other promotional materials along the route;

(5) No publishing, shouting, Distribute speeches, slogans, and leaflets that are inconsistent with the purpose of the rally, procession, and demonstration, and shall not display banners and slogans that are inconsistent with the purpose of the rally, procession, or demonstration;

(6) No throwing of materials that endanger personal safety

(7) Do not damage green spaces, gardens, or public facilities;

(8) Do not spread rumors to confuse the public, or slander or insult others.

Article 14 When marching on the road, parades and demonstration teams must abide by the following regulations:

(1) A horizontal line shall not exceed four people;

( 2) Motor vehicles must comply with the requirements of traffic regulations. Cars are prohibited from driving side by side, and fire trucks, ambulances, engineering rescue vehicles, and police vehicles must be allowed to pass first;

(3) Where there are large lanes, small lanes, On roads with two lanes, you should drive in the large lane on the right;

(4) On roads with motorized lanes and non-motorized lanes, you should drive in the motorized lane on the right side of the center line of the direction of travel. Travel on the road;

Article 15: Parades and demonstration teams are not allowed to stay at urban intersections, railway crossings, or bridges.

Assemblies may not be held in the areas listed in the preceding paragraph and on major urban roads.

Article 16: No assembly, procession, or demonstration may be held within a distance of ten to three hundred meters of the following places without the approval of the Hunan Provincial People's Government:

(1) Where the state guests stay ;

(2) Important military facilities;

(3) Airports and railway stations.

The specific surrounding distance of the places listed in the preceding paragraph shall be implemented in accordance with the regulations of the Provincial People's Government.

Article 17 The person in charge of an assembly, procession or demonstration shall keep in touch with the on-site person in charge of the People’s Police and designate one-tenth of the number of people participating in the assembly, procession or demonstration to wear a unified logo and assist People's police maintained order and strictly prevented others from joining.

Article 18 When one of the following circumstances occurs in front of the marching route of a parade or demonstration team and it is impossible to proceed along the permitted route, the person in charge of the people's police on site has the right to change the marching route of the parade or demonstration team and Immediately notify the person in charge of the demonstration:

(1) A major traffic accident occurs or the traffic jam has not been eliminated;

(2) A fire accident or other serious disaster occurs;

(3) Serious public security or criminal cases occur;

(4) Other unpredictable situations occur.

Article 19: If an assembly, procession, or demonstration is held at or passes by the location of the following units, the competent authority may, in order to maintain order, set up a temporary cordon nearby, which shall not be crossed without the permission of the people's police:

(1) State agencies, military agencies and other important agencies;

(2) Radio stations, television stations and other important news units;

(3) State-stipulated Other important security targets and vital parts.

Article 20: Any use of motor vehicles, audio equipment and promotional materials without permission or in compliance with the regulations of the competent authorities when holding rallies, processions or demonstrations without permission shall be stopped by the public security organs and may be punished The person in charge and those directly responsible shall be given a warning or detained for not more than fifteen days; those who refuse to obey shall be ordered to disperse by the public security organs; those who refuse to disperse shall be forcibly dispersed, and those who refuse to obey shall be forcibly removed from the scene or be detained immediately. detention.

Article 21: Anyone who commits illegal or criminal acts in holding assemblies, processions, or demonstrations, or who undermines the holding of assemblies, processions, or demonstrations in accordance with the law shall be held legally responsible.

Article 22 The specific application issues of these regulations shall be interpreted by the Changsha Municipal People’s Government.

Article 23: These regulations shall come into effect on the date of promulgation. The "Changsha City Interim Regulations on Processions and Demonstrations" promulgated on January 21, 1987 were abolished at the same time.
