Chapter 1 General Provisions

Article 1 In order to prevent and punish drug-related crimes, protect the physical and mental health of citizens, and maintain social order, this Article is formulated in accordance with the Anti-Drug Law of the People's Republic of China, the "Drug Treatment Regulations" and other laws and administrative regulations, and in light of the actual situation of this city. regulations.

Article 2 These regulations shall apply to anti-drug publicity and education, drug control, drug treatment management services, anti-drug guarantee, etc. within the administrative region of this city.

Article 3. The anti-drug work shall implement the policy of giving priority to prevention, comprehensive management, banning species, banning, banning trafficking and banning inhalation. It shall implement the unified leadership of the government, relevant departments shall assume their respective responsibilities, and the society shall participate extensively. working mechanism.

Article 4 This city implements a responsibility system for drug control work. People's governments at all levels should incorporate anti-drug work into national economic and social development plans, incorporate it into government performance assessments and urban spiritual civilization construction and safety construction, and include anti-drug funds in the fiscal budget of the same level.

Article 5 Municipal, district and county anti-drug committees are responsible for organizing, coordinating and guiding anti-drug work within their respective administrative regions, and specifically perform the following duties:

(1) Formulate anti-drug work plans , plans and policy measures;

(2) Supervise the implementation of anti-drug responsibilities and organize assessments;

(3) Inspect the implementation of anti-drug laws, regulations and policies;

(5) Organize and carry out investigation and research on anti-drug work, and issue an annual anti-drug report;

(6) Superiors Other duties assigned by the Narcotics Control Commission and the people's government at the same level.

The Anti-Narcotics Committee has an office responsible for the daily work of the committee.

Article 6 Each member unit of the Anti-Narcotics Committee shall include anti-drug work in the work plan and annual plan of the unit and system, determine the responsible departments, perform their respective duties, cooperate closely, and report to the Anti-Narcotics Committee Anti-drug work.

The public security organs are responsible for the investigation and seizure of drugs, the prohibition of the cultivation of original drug plants, the rectification of key problems of drug abuse and trafficking, the investigation and dynamic control of drug addicts, the relevant supervision and management of precursor chemicals, and the mandatory isolation of drug treatment facilities in this system. Management, taking the lead in organizing port anti-drug work and other work.

The judicial administrative department is responsible for the management of compulsory isolated drug treatment and other places in the system, the education and transformation of drug-related prisoners, and organizing and promoting anti-drug legal publicity and education.

The health and family planning department is responsible for the supervision and management of drug treatment medical institutions, formulating plans for the establishment of drug treatment medical institutions in conjunction with the public security and judicial administrative departments, guiding and supporting drug treatment medical services, organizing and guiding the prevention and treatment of mental disorders caused by drug abuse, etc. Work.

The Food and Drug Administration is responsible for the supervision and management of narcotic drugs, psychotropic drugs and pharmaceutical precursor chemicals, as well as drug abuse monitoring.

The production safety supervision and management department is responsible for the supervision and management of non-pharmaceutical precursor chemicals.

The People's Courts and People's Procuratorates should perform their statutory duties and punish drug crimes in accordance with the law.

Trade unions, Communist Youth Leagues, and women’s federations should combine their respective work to organize anti-drug publicity and education, social assistance, volunteer activities, etc., and assist local governments in anti-drug related work.

Education, civil affairs, finance, agriculture, commerce, culture, radio, film and television, industrial and commercial administration, human resources and social security, science and technology, transportation, press and publication, postal service, customs, the People's Bank of China, airports, railway departments and anti-drug departments Other member units of the committee shall coordinate and carry out relevant anti-drug work in accordance with their respective responsibilities.

Article 7: Drug control is the common responsibility of the entire society. State agencies, social groups, enterprises and institutions, as well as other organizations and citizens shall perform anti-drug duties or obligations in accordance with the law.

Use social power to participate in anti-drug work.

Establish and improve a team of anti-drug social workers and volunteers, and encourage social worker organizations, volunteer organizations, and other units and individuals to participate in anti-drug prevention, publicity and education, scientific research, and drug rehabilitation social services. People's governments at all levels should provide guidance and training to anti-drug social workers and volunteers, and provide necessary working conditions.

Encourage social donations for anti-drug work and provide tax incentives in accordance with the law.

Article 8 This city shall establish an anti-drug cooperation mechanism with relevant provinces, autonomous regions, and municipalities directly under the Central Government. Under the guidance of relevant national departments, international and regional cooperation and exchanges such as anti-drug law enforcement, anti-drug scientific research, and anti-drug education will be carried out.

Chapter 2 Anti-drug Publicity and Education

Article 9 This city has established and improved a national anti-drug publicity and education work system led by the Anti-Drug Committee and widely participated in by all sectors of society, so as to integrate anti-drug publicity and education with citizens. Moral education, legal education, health education, science education, AIDS prevention education, etc. are combined to achieve full coverage of anti-drug publicity and education.

The Anti-Drug Committee should improve the assessment and evaluation mechanism for anti-drug publicity and education and improve the effectiveness of anti-drug publicity and education.

Article 10 State agencies and relevant units shall organize civil servants and other staff to receive education and training on drug control situations and tasks. Cadre training institutions should include anti-drug work as part of their training.

The Anti-Drug Committee and its member units should mobilize all aspects of society and adopt various forms to carry out concentrated anti-drug publicity and education activities at important time points such as International Anti-Drug Day.

The Office of the Anti-Drug Commission, in conjunction with departments such as education, science and technology, public security, judicial administration, health and family planning, culture, radio, film and television, press and publishing, and Internet information, builds an anti-drug education base and organizes the preparation of anti-drug education textbooks, knowledge books, audio and video products, Internet cultural products, etc., and use new media and new technologies to provide anti-drug publicity and education services to the public.

Article 11 Relevant units such as news, publishing, culture, radio, film, television, Internet websites, etc. shall conduct anti-drug publicity and education to the society. Mass media such as newspapers, radio, television, and the Internet should formulate and implement anti-drug publicity and education plans, arrange publicity pages and time periods, regularly publish and broadcast anti-drug publicity advertisements and content, and report relevant information to industry authorities.

Article 12 Parents or other guardians of minors shall educate minors on the dangers of drugs and drug abuse, pay attention to their social interactions, and prevent them from taking drugs or engaging in other drug-related illegal and criminal activities.

The education administrative department should strengthen special education on drug prevention in schools, organize the preparation of local curriculum standards and teaching materials, carry out teacher training, and guide and supervise schools to implement relevant teaching tasks. All types of primary and secondary schools should incorporate drug prevention special education into their school curricula and implement teaching plans, teachers and class hours; colleges and universities should incorporate anti-drug knowledge into teaching plans and course content.

Trade unions, Communist Youth Leagues, women’s federations, community organizations, and employers should combine their respective characteristics to strengthen anti-drug education for community youths, youths coming to Shanghai, young workers and other groups.

Article 13 Entertainment venues and hotels, bars, Internet service business places, bathhouses, clubs and other places are responsible for anti-drug publicity and education in their own places. They should set up anti-drug warning signs in prominent places in the places and educate employees. Provide anti-drug education to personnel.

Article 14 Radio, film, television, literary and art groups and related units shall, in accordance with relevant national regulations, not invite persons who have been investigated and punished by the public security organs for drug abuse for less than three years or who have not yet recovered from drug addiction as main creative personnel to participate in the production of broadcasts TV programs, or organizing or participating in theatrical performances; movies, TV series, radio and television programs, and commercial advertising programs endorsed by the aforementioned personnel as main creative personnel will not be broadcast.
