Provisions of Guangdong Province on Fire Safety Management of High-rise Public Buildings

Chapter I General Provisions Article 1 In order to strengthen the fire safety management of high-rise public buildings, prevent and reduce fire hazards, and ensure the safety of public buildings, these Provisions are formulated in accordance with the provisions of the Fire Protection Law of People's Republic of China (PRC) and the Measures for the Implementation of the Fire Protection Law of People's Republic of China (PRC) in Guangdong Province, combined with the actual situation of this province. Article 2 These Provisions shall apply to the fire safety management of public buildings (hereinafter referred to as high-rise public buildings) with a building height of more than 24 meters in this province. Where laws and regulations provide otherwise, such provisions shall prevail.

Fire safety management of high-rise industrial buildings, high-rise residential buildings and public buildings with a single-story main building exceeding 24 meters shall be implemented in accordance with relevant state regulations. Article 3 The fire safety management of high-rise public buildings shall implement the policy of "prevention first, combining prevention with elimination", and implement the fire safety responsibility system of self-prevention and self-rescue. Article 4 These Provisions shall be implemented by the construction unit (or property right unit, the same below) of high-rise public buildings and the design, construction, installation, maintenance and use unit of building fire control facilities, and the public security fire control institutions shall implement supervision and management according to law. Chapter II Fire Management Responsibility Article 5 The construction unit shall be responsible for the fire safety work during the construction of high-rise public buildings, with the assistance of the construction unit, and the construction unit and the user unit shall be jointly responsible after it is put into use. The construction unit shall sign fire safety responsibility letters with the construction and use units respectively, and clarify their respective fire safety responsibilities. Article 6 The main leaders or legal representatives of the construction units, construction units and users of high-rise public buildings are the first responsible persons for fire safety and are fully responsible for fire safety work; The leader in charge of fire safety work is the person in charge of fire safety, who has direct leadership responsibility for fire safety work.

The construction units, construction units and users of high-rise public buildings shall set up fire safety management organizations, or be equipped with full-time (part-time) fire safety management personnel and engineering and technical personnel engaged in the management and maintenance of fire control facilities. Article 7 Where there are more than two construction or use units in the same high-rise building, the construction unit shall take the lead to set up a fire safety leading group composed of the legal representatives of the construction unit and the construction or use unit and the person in charge of fire safety, implement the responsibility system for fire safety, sign the responsibility book for fire safety, and uniformly manage the fire control work.

Where a high-rise public building is used in the form of contracting or leasing, a fire safety leading group shall be established, which is mainly composed of the legal representative of the construction unit, the contracting or leasing unit and the person in charge of fire safety, and is responsible for the daily fire safety work; The construction unit shall sign a fire safety responsibility letter with the contractor or lessee to clarify the fire safety responsibilities of both parties.

Property management units shall perform their duties of fire control safety according to law, and urge and guide the owners or users to do a good job in fire control safety according to the stipulations of the entrusted contract of property management. Eighth fire safety responsibility, fire safety management institutions and fire safety leading group's main responsibilities:

(a) the implementation of fire laws, regulations, rules and technical standards;

(two) to organize the formulation and implementation of fire safety management systems and measures;

(three) the fire control work into the daily work, management content, the implementation of fire prevention responsibility system step by step and post fire prevention responsibility system;

(four) to organize the deployment, inspection and summary of fire control work, and regularly report the fire control work to the local public security fire control institutions;

(five) the organization of fire safety inspection, rectification of fire hazards;

(six) to organize full-time or voluntary fire brigade to carry out fire control work;

(seven) in accordance with the relevant provisions of the state equipped with and management of fire control facilities and equipment;

(eight) to carry out fire safety education and training for the employees;

(9) Organizing fire fighting and guiding safe evacuation;

(ten) to assist the public security fire control institutions to investigate the cause of the fire;

(eleven) to coordinate and handle other matters in fire safety work. Chapter III Fire Protection Article 9 For high-rise public building projects that are newly built, rebuilt, expanded, internally constructed and changed in use, the design unit shall, in accordance with the requirements of the National Code for Fire Protection Design of High-rise Civil Buildings and other relevant technical standards, prepare a special chapter on fire protection design and report it to the public security fire control institutions for examination and approval. Tenth high-rise public buildings in the song and dance halls, karaoke halls (including restaurants with karaoke function), nightclubs, video halls, projection halls, saunas (except the bathing part), amusement halls (including electronic amusement halls), Internet cafes and other places of entertainment should be located on the first or second and third floors. If it is really necessary to set it on other floors, it shall meet the requirements of the relevant national fire protection technical standards.

Nurseries, kindergartens, amusement halls and other places for children's activities should not be set up in high-rise public buildings. If it is really necessary to set it in a high-rise public building, it should be set on the first floor or the second and third floors of the building, and a separate entrance and exit should be set up. Eleventh construction units, construction units should be in accordance with the fire design drawings approved by the public security fire control institutions for construction and construction. If it is really necessary to change the contents of fire protection design during construction, it shall be reported to the original audit institution for approval. Twelfth high-rise public * * * after the completion of the construction project, should be approved by the public security fire control institutions for fire control; Without acceptance or unqualified acceptance, the construction unit shall not be delivered for use, and the user shall not be put into use.

Theaters, hotels, hotels, shopping malls and other crowded places shall be reported to the local public security fire control institutions before use or opening, and can only be used or opened after passing the fire safety inspection.

When the contents of the acceptance specified in the first paragraph of this article are consistent with the contents of the inspection specified in the second paragraph, the fire control acceptance of the construction project can be handled at the same time as the fire control safety acceptance.
