Chapter I General Provisions

Article 2 (Scope of Application) These Measures are applicable to the standardization of culture and tourism in People's Republic of China (PRC).

Article 3 The tasks of task culture and tourism standardization are: to implement the national principles, policies, laws and regulations related to standardization, strengthen the overall coordination of cultural and tourism standardization, formulate and organize the implementation of cultural and tourism standards, and supervise the formulation and implementation of cultural and tourism standards.

Article 4 Standard classification culture and tourism standards include national standards, industry standards, local standards, group standards and enterprise standards; According to the binding force of standards, national standards are divided into mandatory standards and recommended standards, while industry standards and local standards are recommended standards.

Article 5 Standards of quoting laws, regulations and policies advocate quoting standards of laws and regulations and supporting standards for implementing policies, and actively use standards when formulating laws and policies.

Article 7 To formulate international standards for culture and tourism, we should study and adopt international standards according to actual needs, promote the translation of foreign language versions of China standards, participate in the formulation of international standards, carry out standardized foreign exchanges and cooperation, and promote the internationalization of China's cultural and tourism standards.

Article 8 Standards promote regional development and encourage qualified local cultural and tourism administrative departments to support the introduction of regional standards on the basis of consensus and full cooperation.

Chapter II Institutions and Responsibilities

Tenth organizational principles, culture and tourism standardization work on the basis of unified leadership, centralized management, division of responsibilities. The Ministry of Culture and Tourism is responsible for the standardization work of its own department and industry, and is entrusted by the administrative department of standardization of the State Council to carry out related work. Local cultural and tourism administrative departments shall, in accordance with their duties, carry out cultural and tourism standardization within their respective administrative areas.

Article 11 The Department of Science, Technology and Education of the Ministry of Culture and Tourism (hereinafter referred to as the Department of Science, Technology and Education) is responsible for the centralized management of cultural and tourism standardization.

(a) to organize the preparation and implementation of cultural and tourism standardization related planning, formulate cultural and tourism standardization rules and regulations, and promote the construction of cultural and tourism standards system.

(2) The National Professional Standardization Technical Committee (hereinafter referred to as the "Technical Committee") under the overall guidance, coordination and management of the Ministry of Culture and Tourism.

(3) Organizing the declaration, drafting, approval and examination of national standards for culture and tourism according to their duties.

(four) to organize the preparation, drafting, examination, approval, numbering, publication, filing, publication, disclosure and examination of cultural and tourism industry standards.

(five) the organization of cultural and tourism standards publicity and supervision and inspection.

(six) to participate in and coordinate the internationalization of cultural and tourism standards.

Twelfth business departments of the Ministry of culture and tourism related business departments of standardization work responsibilities:

Thirteenth technical committee by the Ministry of culture and tourism management, in accordance with the "national professional standardization technical committee management approach" to undertake the following duties:

(a) to study and analyze the standardization needs of the professional field, and put forward suggestions on the standardization of culture and tourism.

(two) the preparation of the professional standard system, put forward suggestions for standard planning projects.

(three) to organize the drafting, soliciting opinions, technical review and review of national standards and industry standards, as well as the translation and review of foreign language versions of standards.

(six) to perform reporting procedures on important matters involving the business of the Technical Committee.

(seven) to undertake other standardization work assigned by the standardization administrative department of the State Council and the Ministry of Culture and Tourism.

According to the needs, the Department of Science, Technology and Education will set up an expert group or entrust relevant units to undertake the corresponding standardization technical work according to the responsibilities of the technical committee.

Fifteenth units directly under the Ministry of Culture and Tourism shall actively participate in the standardization work such as drafting standards, soliciting opinions, publicizing and implementing standards, and improve the quality of work through standards.

Chapter III Formulation of Standards

Article 16 Principles The following principles shall be followed in formulating cultural and tourism standards:

(1) Practice the socialist core values and stick to the correct direction.

(2) Conforming to the provisions of laws, regulations and policy documents.

Article 17 Where national standards in the fields of culture and tourism need to be unified nationwide, national standards shall be formulated. Compulsory national standards shall be formulated for the technical requirements of protecting personal health and life and property safety, national security, ecological environment safety and meeting the basic needs of economic and social management. Recommended national standards can be formulated to meet the technical requirements of basic universality, matching with mandatory national standards and playing a leading role in the cultural and tourism industries. The project declaration, drafting, soliciting opinions and review of the revision of the national standards for culture and tourism shall be implemented in accordance with the relevant administrative measures of the standardization administrative department of the State Council and the annual national standard project guide.

Eighteenth industry standards for technical requirements without national standards that need to be unified within the scope of the culture and tourism industry, you can formulate cultural and tourism industry standards. Cultural and tourism industry standards are common standards for public welfare formulated by the Ministry of Culture and Tourism according to its administrative duties, focusing on important products, engineering technology, basic public services and industry management.

(1) Basic Requirements The technical requirements of industry standards shall not be lower than the relevant technical requirements of national standards, and shall be coordinated with the existing relevant national standards and industry standards. General products and services, cross-departmental and cross-industry technical requirements should not be formulated as industry standards. Industry standards should not be formulated to constrain the internal work requirements and management norms of administrative departments. It is forbidden to make specific provisions on qualification, license certification, approval and registration in industry standards, and to carry out acts that damage the legitimate rights and interests of market participants, increase their obligations and increase their rights beyond the provisions of government laws and regulations. It is forbidden to use industry standards to implement acts that hinder the free circulation of goods and services, eliminate or restrict market competition.

(2) The Department of Science, Technology and Education of the Project Department starts the revision of industry standards every year for public consultation, and after the project review and soliciting the opinions of relevant units, the industry standard plan is issued. After the plan is issued, it will not be adjusted in principle. If adjustment is really necessary, it shall be implemented after approval or filing according to the prescribed procedures.

(III) Drafting and soliciting opinions The drafting unit of industrial standards shall draft the standard text according to the format, style and relevant requirements of the specifications, and the drafting unit and technical committee shall solicit opinions extensively.

(four) after the completion of the review, the technical committee will review and form the industry standard materials for approval. For projects that fail to pass the examination, the drafting unit shall revise and improve them within the prescribed time limit and resubmit them for trial; Or according to the evaluation conclusion, through the technical committee to adjust or terminate the project plan, submitted to the Ministry of science and technology education department audit.

(five) after the examination and approval of the materials for the approval of the industry standards, the Department of Science, Technology and Education shall solicit the opinions of the relevant units and report them to the Ministry of Culture and Tourism for approval and release, and number and release them according to the procedures.

(six) after the release of the standards for the record culture and tourism industry, it shall be reported to the administrative department of standardization of the State Council for the record.

Nineteenth local standards in order to adapt to local natural conditions, customs and other special technical requirements related to culture and tourism, local standards for culture and tourism can be formulated. Support local cultural and tourism administrative departments to participate in the formulation of local standards. The management of local standards shall be implemented in accordance with the Measures for the Administration of Local Standards and relevant local laws and regulations.

Twentieth group standards encourage societies, associations, chambers of commerce, federations, industrial technology alliances and other social organizations. Coordinate with relevant market entities to formulate the standards of cultural tourism groups that meet the needs of the market and innovation and are higher than the technical requirements of recommended standards, which will be adopted by the members of the group according to the agreement stipulated by the group or voluntarily adopted by the society, and the relevant information will be submitted to the Department of Science, Technology and Education after the standards are released. The management of group standards shall be implemented in accordance with the Regulations on the Management of Group Standards.

Twenty-first enterprise standards encourage enterprises to formulate standards for cultural tourism enterprises that are higher than the technical requirements of recommended standards. The management of enterprise standards shall be implemented in accordance with the Measures for the Administration of Enterprise Standardization.

Article 22 The Ministry of Culture and Tourism shall, according to the needs of the work and the actual situation, give appropriate financial support to the drafting unit, and the use of the funds shall conform to the relevant provisions of the Ministry of Culture and Tourism on fund management, and the funds shall be used exclusively. Local cultural and tourism administrative departments can refer to the implementation.

Chapter IV Implementation and Supervision of Standards

Twenty-third standard open culture and tourism standards are published and distributed by publishing institutions entrusted by their formulation units, and are made public to the public according to law. Encourage group standards and enterprise standards to be disclosed to the public through the standard information public service platform.

Twenty-fourth standard publicity culture and tourism national standards, industry standards, local standards issued, cultural and tourism administrative departments at all levels, the relevant technical committees should carry out standard publicity, do a good job in standard interpretation. Encourage enterprises and institutions and relevant social organizations to carry out cultural and tourism standards publicity and business exchanges.

Twenty-fifth enterprises, institutions and relevant social organizations are the main bodies of standards implementation, and should strictly implement mandatory standards and actively adopt recommended standards.

Twenty-sixth standards supervision cultural and tourism administrative departments at all levels and other departments with relevant regulatory responsibilities shall supervise and inspect the implementation of standards, and implement the safety production responsibilities related to standards within the scope of statutory duties.

Article 27 Feedback Evaluation and Standard Evaluation The Ministry of Culture and Tourism shall establish a feedback evaluation mechanism for the implementation of cultural and tourism standards. According to the feedback evaluation, industry development needs and technical progress, timely organize technical committees to review national standards and industry standards, and the review period is generally not more than 5 years.

Article 28 Revision of Standards In the process of implementing national standards and industrial standards, if individual technical requirements need to be adjusted, supplemented or deleted, they can be revised through the revision table, which shall be implemented in accordance with the Regulations on the Administration of Revision Table of National Standards and relevant procedures for the administration of Revision Table of Industrial Standards.

Twenty-ninth pilot demonstration The Ministry of Culture and Tourism organized a pilot demonstration of standardization in this industry. Encourage local cultural and tourism administrative departments, with the support of the people's government at the same level, to promote the relevant standardization pilot demonstration work within their respective administrative areas. Encourage cultural tourism enterprises and organizations to actively participate in the national standardization pilot demonstration construction.

Thirtieth punishment related units and individuals can report and complain about violations in standardization work to the cultural and tourism administrative departments at all levels. Units and individuals that cause serious consequences shall be investigated for corresponding responsibilities in accordance with relevant laws, regulations and rules.

Chapter V Safeguard Mechanism

Thirty-first planning, culture and tourism administrative departments at all levels should incorporate standardization into development plans and work plans.

Thirty-second sources of funds Cultural and tourism administrative departments at all levels should include the standardization work funds in the departmental budget. Encourage social funds to invest in culture and tourism standardization.

Thirty-third cultural and tourism administrative departments at all levels should strengthen the team building in standardization talent, strengthen standardization business exchanges, give full play to the role of standardization experts, and enhance the standardization ability of scientific research personnel.

Thirty-fourth units and individuals that have made remarkable achievements in standardization work, high technical level and outstanding implementation effect can be commended and rewarded by cultural and tourism administrative departments at all levels in accordance with relevant regulations, or recommended standardization scientific and technological achievement awards to relevant departments.

Chapter VI Supplementary Provisions

Article 35 Detailed Rules for Implementation These Measures shall be formulated separately by the Department of Science, Technology and Education of the Ministry of Culture and Tourism.

Article 36 These Measures shall be interpreted by the Department of Science, Technology and Education of the Ministry of Culture and Tourism.

Article 37 (Date of Implementation) These Measures shall come into force on X, 2022. The Measures for the Administration of Cultural Industry Standardization (Provisional) formulated by the Department of Culture, Science and Technology of the former Ministry of Culture and the Measures for the Administration of National Tourism Standardization and the Measures for the Administration of the Revision of National Standards and Industry Standards of the Tourism Industry formulated by the former National Tourism Administration shall be abolished at the same time.
