Regulations of Yunnan Province on the Promotion of Small and Medium-sized Enterprises (202 1)

Chapter I General Provisions Article 1 In order to improve the business environment of small and medium-sized enterprises, ensure their fair participation in market competition, safeguard their legitimate rights and interests, support their entrepreneurial innovation, promote their healthy development, expand urban and rural employment, and give full play to their important role in national economic and social development, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Promotion of Small and Medium-sized Enterprises and relevant laws and administrative regulations, and in light of the actual situation of this province. Article 2 These Regulations shall apply to activities to promote the development of small and medium-sized enterprises within the administrative region of this province.

The term "small and medium-sized enterprises" as mentioned in these Regulations refers to medium-sized enterprises, small enterprises and micro-enterprises established in accordance with the classification standards for small and medium-sized enterprises approved by the State Council. Article 3 The people's governments at or above the county level shall incorporate the promotion of the development of small and medium-sized enterprises into the national economic and social development plan, implement the policies of actively supporting small and medium-sized enterprises, especially small and micro enterprises among them, improving services, standardizing according to law and safeguarding rights and interests, and create a good environment for the establishment and development of small and medium-sized enterprises. Fourth small and medium-sized enterprises should operate according to law, follow the principle of good faith, standardize internal management, improve management level and achieve high-quality development; Shall not harm the legitimate rights and interests of workers, shall not harm the public interests. Fifth provincial people's government to co-ordinate the promotion of small and medium-sized enterprises in the province, responsible for formulating policies to promote the development of small and medium-sized enterprises in the province, improve the coordination mechanism of small and medium-sized enterprises, and establish a system of linking leading cadres with enterprises.

The competent department of industry and information technology of the provincial people's government is responsible for the comprehensive management of SME promotion, organizing the implementation of SME development policies, and conducting comprehensive coordination, service guidance, supervision and inspection on SME promotion.

State (city) and county (city, district) people's governments shall establish a coordination mechanism for the promotion of small and medium-sized enterprises, clearly define the departments responsible for the comprehensive management of the promotion of small and medium-sized enterprises, and be responsible for the promotion of small and medium-sized enterprises within their respective administrative areas.

Other relevant departments shall provide guidance and services for small and medium-sized enterprises within their respective functions and duties. Article 6 The statistical department shall implement the national statistical monitoring system for small and medium-sized enterprises, strengthen the statistical investigation, monitoring and analysis of small and medium-sized enterprises, and regularly publish relevant information. Article 7 The people's governments at or above the county level and their relevant departments shall promote the construction of the credit system of small and medium-sized enterprises, improve the socialized credit information collection and credit evaluation system, and realize the socialization of credit information inquiry, exchange and enjoyment of small and medium-sized enterprises. Chapter II Business Environment Article 8 The people's governments at or above the county level shall continue to deepen the reform of decentralization, combine decentralization with management, optimize services, implement a unified national market access and market supervision system, adhere to the principles of marketization, rule of law and internationalization, and create a stable, fair, transparent and predictable business environment for the development of small and medium-sized enterprises. Article 9 People's governments at or above the county level and their relevant departments shall conduct fair competition review in the process of formulating rules and administrative normative documents related to the production and operation activities of small and medium-sized enterprises, fully listen to the opinions of small and medium-sized enterprises and their industry organizations, and guarantee their right to know, participate, express and supervise in the system construction. Article 10 People's governments at all levels and their relevant departments shall promptly announce and implement preferential policies such as tax reduction and fee reduction to promote the development of small and medium-sized enterprises, optimize work processes, simplify procedures, strengthen publicity and guidance, and reduce the burden on small and medium-sized enterprises. Eleventh relevant departments of the people's governments at or above the county level shall supervise and inspect small and medium-sized enterprises according to law, and establish a spot check mechanism, and shall not interfere with the normal production and business activities of enterprises. If the same department can supervise and inspect the enterprise for many times, it should be combined; Where multiple supervision and inspections carried out by different departments can be merged, the people's government at the corresponding level shall organize relevant departments to merge or conduct joint inspections, and timely disclose the inspection results to the public. Article 12 People's governments, people's courts and people's procuratorates at or above the county level shall take effective measures to protect the property rights, business autonomy and other legitimate rights and interests of small and medium-sized enterprises and their investors according to law, punish illegal and criminal acts that infringe on the legitimate rights and interests of small and medium-sized enterprises and their investors according to law, and actively create a business environment under the rule of law that is conducive to promoting the development of small and medium-sized enterprises. Article 13 The people's governments at or above the county level and their relevant departments shall establish and improve the honor system for entrepreneurs, foster entrepreneurship, widely publicize the innovative spirit and social contribution of outstanding entrepreneurs, and actively create a good environment for respecting and encouraging entrepreneurs to start businesses. Chapter III Financial Support Article 14 The provincial finance shall arrange special funds for the development of small and medium-sized enterprises in the budget at the corresponding level. State (city) and county (city, district) people's governments shall, according to the actual situation, arrange special funds for the development of small and medium-sized enterprises in the financial budget at the corresponding level.

Other special funds used by governments at all levels to support the development of enterprises should equally support qualified small and medium-sized enterprises. Fifteenth special funds for the development of small and medium-sized enterprises help small and medium-sized enterprises to transform and upgrade, technological innovation and open up markets, and support the construction of public service system and financing service system for small and medium-sized enterprises.

Special funds for the development of small and medium-sized enterprises are inclined to small and micro enterprises. The management and use of funds should adhere to the principle of openness and transparency, implement budget performance management, and accept the supervision of the financial department and the audit department.
