Measures for the safety management of ferry in Liaoning Province

Article 1 In order to strengthen ferry safety management, maintain ferry order, and ensure the safety of people's lives and property, these measures are formulated in accordance with the Regulations of People's Republic of China (PRC) on the Administration of Inland River Traffic Safety (hereinafter referred to as the Regulations) and other relevant provisions, combined with the actual situation in our province. Article 2 The ferry mentioned in these Measures refers to the places and facilities used to transport people, goods and vehicles on both sides of rivers, lakes, reservoirs and other waters within the administrative area of our province. ?

The term "ferry" as mentioned in these Measures refers to the ships engaged in passenger and cargo transportation between the two sides of the ferry and the ships used to erect the ferry pontoon. ? Article 3 These Measures shall apply to ferry safety management activities within the administrative area of our province. Where laws and regulations provide otherwise, such provisions shall prevail. ? Article 4 The people's governments of counties (including county-level cities and districts, the same below) where ferries are located shall be responsible for ferry management within their respective administrative areas, and their designated departments shall be responsible for the supervision and inspection of ferries and ferry safety. ?

The maritime administrative agencies directly under the central government and local maritime administrative agencies (hereinafter referred to as maritime administrative agencies) shall, according to their respective functions and powers, supervise and manage the water traffic safety in the navigable waters of ferries under their jurisdiction according to law. ? Article 5 The safety management of ferries shall follow the principles of safety first, prevention first, convenience for the masses and management according to law, so as to ensure the safety, order and smoothness of ferries. ? Article 6 The municipal and county people's governments shall strengthen the ferry safety management within their respective administrative areas, establish and improve the responsibility system for ferry safety management, and coordinate and solve the problems existing in ferry safety management in a timely manner. ?

The county people's government shall formulate plans for the renovation and renewal of the ferry, raise funds, renovate the ferry pier, update the ferry, and improve the safety and technical level of the ferry. ? Seventh township (town) people's government shall perform the following duties of ferry safety management within their respective administrative areas:

(a) to establish and improve the ferry safety responsibility system for administrative villages and ship owners; ?

(two) the implementation of the ferry, crew and passengers safety management responsibility system; ?

(three) the implementation of ferry water traffic safety management of specialized personnel and security funds; ?

(four) to urge the ferry owners, operators and crew to abide by the laws, regulations and rules related to inland river traffic safety; ?

(five) other duties as prescribed by laws, regulations and rules. ? Article 8 To apply for setting up a ferry, the applicant must submit the following materials:

(a) an application for the establishment of a ferry; ?

(two) the feasibility study report of setting up the ferry; ?

(three) the ferry site submissions. ? Article 9 To establish a ferry, an application shall be submitted to the people's government at the county level where the ferry is located. In line with the conditions stipulated in Article 36 of the Regulations, the county people's government shall approve it according to law, and if it refuses to approve it, it shall inform the reasons in writing; The people's government at the county level shall solicit the opinions of the local maritime administrative agency before examination and approval. ?

The construction of engineering facilities across rivers, rivers, dikes and ferries shall conform to flood control standards, shoreline planning, shipping requirements and other technical requirements, and shall not endanger the safety of dikes, affect the stability of river regime and hinder the smooth flow of floods; Before the feasibility study report is submitted for approval in accordance with the basic construction procedures stipulated by the state, the project construction plan shall be reviewed and agreed by the relevant water administrative department in accordance with the above flood control requirements. ? Tenth approved ferry, no unit or individual may cancel; If it is really necessary to cancel, it shall go through the examination and approval procedures in accordance with the original examination and approval procedures. ? Eleventh ferry owners or operators shall establish and improve the ferry safety management system to ensure the safety of the ferry and avoid collision accidents. ?

The owner or operator of the ferry shall be equipped with emergency rescue equipment and equipment, and conduct regular inspection and maintenance. ? Twelfth ferry terminal must have safety facilities for cargo loading and unloading, passengers getting on and off, equipped with life-saving and fire-fighting equipment in line with state regulations and staff with water safety knowledge and skills. ? Article 13 The owner or operator of the ferry shall set up obvious ferry signs and ferry codes on both sides of the ferry, indicating the name of the ferry, the approving authority of the ferry, the date of approval, the approval number, the ferry route, the name of the ferry, the passenger quota and cargo quota of the ferry and passenger information. ? Fourteenth ferry must meet the following conditions before ferry:

(1) Holding a qualified ship registration certificate and ship inspection certificate; ?

(two) in accordance with the provisions of the the State Council Municipal Department of transportation crew; ?

(three) equipped with the necessary navigation information; ?

(four) other conditions stipulated by laws, regulations and rules. ? Article 15 Safety guardrails shall be set on both sides of ferries engaged in ferry transportation, equipped with fire-fighting and life-saving equipment in accordance with regulations, and the hull shall be marked with the name of the ship, port of registry, load line marks, etc. Passenger ferries should have identification signs that meet the requirements of the state, and indicate the passenger quota and safety precautions in obvious positions. ? Article 16 The ferry shall be ferried according to the route approved by the people's government at the county level where the ferry is located, and the ferry route shall not be changed without authorization; Don't overload or overstaffed the ferry. ?

The ferry shall be inspected and maintained regularly to ensure that the ferry is in a seaworthy state. ? Seventeenth ferry shall not transport dangerous goods prohibited by laws and regulations and the provisions of the the State Council Municipal Department of transportation. ?
