Provisions of Ya 'an Municipality on Classified Treatment of Rural Domestic Waste

Article 1 These Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, the Regulations of Sichuan Province on Environmental Protection, and the Regulations of Sichuan Province on Comprehensive Management of Urban and Rural Environment, in combination with the actual situation of Ya 'an City, in order to promote rural grass-roots governance, strengthen the classified treatment of rural domestic garbage, improve rural living environment and cultivate good habits of garbage classification. Realize the reduction, recycling and harmlessness of rural domestic garbage, and promote the construction of green development demonstration cities. Article 2 These Provisions shall apply to the classified treatment, supervision and management of rural domestic garbage within the administrative area of this Municipality.

The term "rural domestic waste" as mentioned in these Provisions refers to the solid waste generated by units and individuals outside the city appearance and environmental sanitation management area in their daily life or in the activities of providing services for daily life, and the solid waste regarded as domestic waste as stipulated by laws and administrative regulations.

Wastes from industrial, construction, medical and agricultural production in rural areas, as well as the bodies of livestock and poultry and pets, shall be disposed of in accordance with the provisions of relevant laws, regulations and rules. Article 3 The housing and urban-rural construction department or the comprehensive administrative law enforcement department is the competent department in charge of the classified treatment of rural domestic waste within their respective administrative areas, and is responsible for the coordination, guidance and management of the classified treatment of rural domestic waste.

The agricultural and rural departments are responsible for technical guidance and training on the utilization of perishable garbage as fertilizer or biogas fermentation.

The education department shall require kindergartens, primary and secondary schools, secondary vocational schools and municipal institutions of higher learning to popularize the knowledge of classified treatment of domestic waste.

The ecological environment department is responsible for the guidance, supervision and management of the storage, disposal and utilization of hazardous wastes.

Supply and marketing cooperatives are responsible for guiding the recycling of recyclable materials and establishing a recycling system of renewable resources based on counties or townships (towns).

Development and reform, finance, natural resources and planning, civil affairs, commerce and other relevant departments should cooperate with each other to do a good job in the classification and treatment of rural domestic waste according to their respective responsibilities.

Trade unions, the Communist Youth League, women's federations and other people's organizations should carry out extensive social mobilization in various ways to promote the whole society to participate in the classified treatment of domestic garbage.

Newspapers, radio, television, internet and other news media should strengthen the public welfare propaganda of domestic waste classification and disposal, enhance the public's awareness of domestic waste classification and disposal, and conduct public opinion supervision on acts that violate the relevant provisions of domestic waste classification and disposal. Article 4 Units and individuals shall practice a green lifestyle, reduce the generation of rural domestic garbage, assume the responsibilities of rural domestic garbage producers, put and dispose of rural domestic garbage in accordance with regulations, and report violations of domestic garbage management regulations.

Village (neighborhood) committees and autonomous management committees in new village settlements educate and guide units and individuals to put domestic garbage into the classification, organize the collection of domestic garbage after the classification, and cooperate with the transportation and treatment of domestic garbage.

Village (neighborhood) committees and autonomous management committees of new village residential areas organize village (neighborhood) people to formulate village rules and regulations, residents' conventions or residents' management conventions in new village residential areas, and make agreements on matters such as classified treatment and removal management of domestic garbage.

Township (town) people's governments and subdistrict offices shall be responsible for the daily work of classified treatment of rural domestic garbage within their respective jurisdictions, promptly urge or organize garbage transfer, guide renewable resource recycling units or individuals to set up outlets or purchase recyclable materials at home, deal with violations of these provisions according to law, and guide and support village (neighborhood) committees and autonomous management committees of new village settlements to organize classified collection of domestic garbage.

The people's governments of cities and counties (districts) shall strengthen their leadership in the classified treatment of rural domestic garbage within their respective administrative areas, establish an assessment and incentive mechanism for the classified treatment of rural domestic garbage, strengthen the construction of facilities for the classified treatment of domestic garbage and guarantee the funds, and incorporate the classified treatment of rural domestic garbage into the urban garbage treatment system. Article 5 The system of responsible person shall be implemented for the classified delivery of rural domestic garbage:

(a) the houses and houses in front of the village (neighborhood) people, and the actual users of the houses are responsible persons;

(two) the office, production and business premises in the village (community), and the unit or production operator is the responsible person;

(three) in the public places in the village (community), the village (neighborhood) people's committee, the autonomous management committee of the new village community or its entrusted managers are responsible persons;

(four) the construction site in the village (community), by the construction unit or the construction unit is responsible for.

If the responsible person cannot be determined in accordance with the provisions of the preceding paragraph, it shall be determined by the local village (neighborhood) committee. Sixth village (community) rural domestic garbage clearance fees through government subsidies, village (neighborhood) committees to raise money.

The county (District) people's government shall incorporate the rural domestic garbage clearing fee into the fiscal budget and establish a subsidy mechanism for rural domestic garbage clearing fee.

Encourage and guide social capital to participate in the classified treatment of rural domestic waste. Article 7 The rural domestic garbage clearing fee shall be used for subsidies and rewards for rural domestic garbage clearing personnel, the purchase and management of garbage sorting equipment, etc., and shall be managed and used by the village (neighborhood) committees in accordance with the relevant provisions, with special funds.

The management and use of rural domestic garbage clearing fees shall be included in the scope of publicity and subject to the supervision of the villagers (residents).
