The Regulations of Shanghai Municipality on the Prevention and Control of Ship Pollution (hereinafter referred to as the Regulations) came into force on March 6, 0. The "Regulations" make it clear that even if the domestic sewage reaches the requirements of the national standard "Control Standard for Water Pollution Discharge from Ships" after treatment, it cannot be discharged into the Huangpu River and Suzhou River.

The Regulations stipulate the discharge requirements and disposal methods of various pollutants from ships, and require ships to take effective measures to prevent and reduce pollutant discharge, and establish and improve relevant monitoring and testing systems. For acts that cause or may cause water pollution in violation of the Regulations, the Regulations set corresponding punishment measures, including ordering correction and fines.

The Shanghai Maritime Safety Administration said that the Regulations provided a legal basis and institutional guarantee for Shanghai to strengthen the prevention and control of ship pollution. Constructing a long-term mechanism of ship pollution prevention and control that conforms to Shanghai's reality and reflects Shanghai's characteristics will help improve the comprehensive management capacity of Shanghai's waters and port areas, implement the concept of green and low-carbon development, effectively protect the ecological environment of the Yangtze River, and provide assistance for the construction of Shanghai International Shipping Center and the integrated high-quality development of the Yangtze River Delta.

It is noteworthy that the Regulations focus on the protection of "one river and one river" in Shanghai, and explicitly prohibit ships from discharging domestic sewage and oily sewage into Huangpu River and Suzhou River. Even after pretreatment, the domestic sewage on board has reached the requirements of the national standard "Water Pollution Discharge Control Standard for Ships". Considering that the treated water still contains some microorganisms, it is not allowed to be discharged. The reporter followed the law enforcement officers of Yangpu Maritime Safety Administration in the process of law enforcement in Yinhang Waters of Huangpu River, and found that those who discharged treated domestic sewage and oily sewage into Huangpu River would be punished according to law.

According to maritime law enforcement personnel, domestic garbage, domestic sewage and oily sewage generated by inland river ships sailing, berthing and operating in Huangpu River enjoy the free receiving policy; At the same time, the "Regulations" put forward the requirement that domestic garbage and domestic sewage from inland ships should be put in at least once every five days or every voyage. On March 1 day, Shanghai Maritime Department started the "On-line Monitoring of Ship Water Pollutant Discharge" module in the system, and analyzed the inland river ships that did not trade pollutants within 5 days or every voyage through big data and gave tips.

The Regulations also explicitly prohibit single-hull oil tankers and chemical tankers from sailing in waters such as the Huangpu River. Compared with ships with double hull and double bottom, these ships have only one layer of protection, and once they collide, they are more likely to cause hull damage, oil and chemicals leakage and water pollution.

It is understood that in order to strengthen the prevention and control of ship pollution, Jiangsu Province also promulgated the Regulations on the Prevention and Control of Ship Pollution in the Yangtze River in Jiangsu Province on the same day, which was implemented simultaneously with the Regulations on the Prevention and Control of Ship Pollution in the Yangtze River in Shanghai. The two local laws and regulations are generally consistent in the legislative framework structure and key system provisions. This will help to promote the integration of ship pollution prevention and control in the Yangtze River Delta.
