Article 1 In order to standardize the installation of outdoor advertising facilities, create a clean and beautiful city environment, and maintain urban management order, in accordance with the "Advertising Law of the People's Republic of China" and "Urban City Appearance and Environmental Sanitation Management Regulations" The "Haidong City Urban Management Regulations" and other relevant laws and regulations are formulated based on the actual situation of this city. Article 2 These Measures shall apply to the installation of outdoor advertising facilities and their supervision and management activities within the administrative region of this city. Article 3 The term "outdoor advertising facilities" as mentioned in these Measures refers to facilities that use buildings, structures, roads, venues, green spaces, spaces, waters, vehicles, floating objects and other carriers to set up advertisements and plaques, including neon lights, light boxes, showcases, etc. , signboards, electronic display boards (screens), bulletin boards, publicity boards, newspaper reading boards, galleries, signboards, physical models, store signage, slogans, banners and other independent or affiliated advertising facilities. Article 4 The municipal urban management administrative department is responsible for the supervision and management of the installation of outdoor advertising facilities in the city.
County and district urban management administrative departments are responsible for the management of outdoor advertising facilities within their jurisdiction.
Relevant departments of the municipal, county and district people's governments are responsible for the relevant management of the installation of outdoor advertising facilities within the scope of their respective responsibilities.
Subdistrict offices, township (town) people's governments, other units and organizations shall cooperate with the urban management administrative department in the management work related to the setting up of outdoor advertising facilities. Article 5: Units or individuals have the right to report or complain to the urban management administrative department about illegal activities in the installation of outdoor advertising facilities. After receiving the report or complaint, the urban management administrative department shall handle it in a timely manner and in accordance with the law. Article 6 The installation of outdoor advertising facilities shall be based on the requirements of the overall urban construction plan, follow the principles of reasonable layout, safety regulations, coordination and beauty, energy conservation and environmental protection, and be planned in a unified manner in conjunction with urban regional planning functions, humanistic characteristics, urban landscape and surrounding environment. Article 7 The municipal urban management administrative department shall, in conjunction with the planning, market supervision and management and other administrative departments, prepare an overall plan for the installation of outdoor advertising facilities, which shall be implemented after approval by the Municipal People's Government.
The county and district urban management administrative departments shall prepare detailed plans and technical standards based on the overall plan for setting up outdoor advertising facilities, and implement them after approval by the county and district people's governments. Article 8 It is prohibited to set up outdoor advertising facilities under any of the following circumstances:
(1) Construction control zones of state agencies, cultural venues, hospitals, teaching units, cultural relics protection units, scenic spots, etc., cities Landmark buildings, urban public green spaces and street tree green belts;
(2) Affecting electricity, communications, traffic safety facilities, traffic signs, fire exits, fire protection facilities, fire safety signs, warning signs, etc. Used by municipal public facilities;
(3) Buildings (structures) that have major safety hazards or may endanger the safety of buildings (structures), affecting building facades, outlines and architectural styles. ;
(4) Entrances and exits such as viaducts, overpasses, and express lanes;
(5) Impeding the normal life or production of residents;
(6) Municipal, Areas or locations where outdoor advertising is prohibited by the county and district people's governments;
(7) Other prohibited situations stipulated in laws, regulations and rules. Article 9 To set up large-scale outdoor advertising facilities, the consent of the municipal urban management administrative department must be obtained, and the approval procedures must be completed in accordance with regulations; to set up other outdoor advertising facilities, the consent of the county or district urban management administrative departments must be obtained and the approval procedures must be completed in accordance with regulations.
To apply for setting up outdoor advertising facilities, submit the following materials:
(1) Written application, including unit name, address, facility form, specifications, installation location, etc.;
(2) Business license or other subject qualification certification materials;
(3) Front elevation and color renderings of outdoor advertising facilities and carriers;
(4) Outdoor Materials proving the ownership and use rights of the advertising facility installation carrier, or use agreements and contracts signed with relevant ownership and use rights units;
(5) Other materials required to be submitted by laws and regulations.
Article 10 The urban management administrative department shall review and issue a written decision within seven working days from the date of receipt of the application for the establishment of outdoor advertising facilities. If the conditions are met, a written decision of agreement will be issued; if the conditions are not met, a written decision of disapproval will be issued and the reasons will be explained.
The installation of temporary outdoor advertising facilities shall be reviewed and a written decision issued within three working days from the date of receipt of the application. Article 11 Outdoor advertising facilities approved by the urban management administrative department shall have a clear installation period. The installation period of neon advertisements shall not exceed three years, and the installation period of electronic display advertising and high-pole advertisements exceeding 50 square meters shall not exceed five years. , the installation period of other outdoor advertising facilities shall not exceed two years.
If the installation period of outdoor advertising facilities expires and needs to be retained, an extension application should be submitted to the original consent authority thirty days before the expiration date; if an extension application is not submitted or the extension is not agreed, the installer shall report to the city management administrative director They will be dismantled within the time limit specified by the department. Article 12 The installation of outdoor advertising facilities shall be completed within 45 days from the date of approval; if the installation is not completed within the time limit, the written decision to agree to the installation will automatically become invalid, except for cases due to force majeure, inability to construct in winter and emergencies. Article 13 If it is necessary to set up temporary outdoor advertising facilities to hold various cultural, sports, trade fairs, order fairs, trade fairs, celebrations, publicity and education, etc., the county or district urban management administrative director shall be consulted before the event is held. The department agrees to go through the approval procedures in accordance with relevant regulations, set up in accordance with the specified location, time limit and requirements, and dismantle it within 24 hours after the event.
