Regulations of Ningxia Hui Autonomous Region on Work Safety

Chapter I General Provisions Article 1 In order to strengthen the supervision and management of production safety, prevent and reduce production safety accidents, ensure the safety of people's lives and property, and promote the harmonious development of economy and society, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on Work Safety and relevant laws and administrative regulations, combined with the actual situation of the autonomous region. Article 2 Units and individuals engaged in production and business activities within the administrative area of the autonomous region? These Regulations shall apply to the safety production and safety production supervision and management activities of production and business units. Where laws and administrative regulations provide otherwise for safety in production, such provisions shall prevail. Article 3 The management of production safety should be people-oriented, and adhere to the principles of safety first, prevention first and comprehensive management. Article 4 People's governments at all levels shall strengthen their leadership over the work of production safety, incorporate the work of production safety into the national economic and social development plan, and support and urge relevant government departments to perform their duties of supervision and administration of production safety according to law. Fifth autonomous region safety production supervision and management departments to implement comprehensive supervision and management of production safety work in the region, guide, coordinate and urge other departments responsible for production safety supervision and management to perform their duties according to law.

The departments responsible for the supervision and administration of production safety of the District People's Government shall implement comprehensive supervision and administration of production safety within their respective administrative areas, and be guided by the supervision and administration of production safety of the autonomous region in business.

Other departments responsible for the supervision and administration of production safety shall, within the scope of their respective duties, do a good job in the supervision and administration of production safety according to law. Article 6 The people's governments of townships and towns and sub-district offices shall organize, coordinate and inspect the work of production safety within their respective administrative areas, report the illegal acts and hidden dangers of production safety to the departments and relevant departments of the people's governments at the county level in a timely manner, and assist in the emergency rescue and accident investigation and handling of production safety accidents. Seventh people's governments at all levels and their relevant departments should take various forms to strengthen the publicity of safety laws, regulations and related knowledge, and enhance the safety awareness and safety prevention ability of the whole society. Encourage and support scientific research on safety production, popularize and apply advanced safety production technology, management experience and scientific and technological achievements, and improve the level of safety production. Eighth news, publishing, broadcasting, film and television, Internet and other media units have the right to supervise the work of production safety by public opinion and the obligation of publicity and education. Article 9 The people's governments at all levels and their relevant departments shall commend and reward the units and individuals that have made remarkable achievements in improving the conditions for safe production, preventing production safety accidents, participating in emergency rescue, reporting the hidden dangers of serious accidents, reporting the illegal acts of safe production, and researching and popularizing the science and technology of safe production and advanced management experience. Chapter II Guarantee of Safety in Production of Production and Business Units Article 10 Production and business units shall have and meet the conditions for safety in production stipulated by relevant laws, regulations, national standards or industry standards, and establish and improve rules and regulations for safety in production; Those who do not have the conditions for safe production shall not engage in production and business activities. Eleventh production and business units shall establish and improve the responsibility system for production safety, clear the responsible personnel, responsibility content and assessment requirements of production safety posts, and form the responsibility system for production safety. Article 12 The principal responsible person of a production and business operation entity shall be fully responsible for the safety production of the entity, the principal responsible person in charge of safety production shall assist the principal responsible person to perform the safety production management duties, and other responsible persons shall assume corresponding leadership responsibilities for safety production within their respective business scope. Thirteenth production and business operation entity's main person in charge and safety management personnel should have the knowledge and management ability of production safety corresponding to production and business operation activities.

The main person-in-charge and safety production management personnel of mines, construction units and units that produce, manage, store, transport and use dangerous goods shall participate in the training of safety production knowledge and management ability organized by relevant competent departments according to law, and can only take up their posts after passing the examination. The assessment shall not be charged.

According to the relevant provisions of the state, special operations personnel must receive special safety operation training and obtain the qualification certificate for special operations before taking up their posts with certificates. Fourteenth production and business units shall, in accordance with the relevant provisions, carry out safety education and training for employees. Employees who have not received safety education, training or unqualified training shall not engage in production and business activities. Production and business units shall record the education and training of employees in production safety, establish the archives of education and training in production safety, and keep them within the prescribed time limit.

The cost of safety education and training shall be borne by the production and business operation entity. Fifteenth in the production and business activities, employees enjoy the following rights:

(a) labor safety, occupational hazard prevention and social security for work-related injuries should be clearly defined in collective contracts and labor contracts;

(two) to understand the risk factors in their workplaces and jobs and their preventive and emergency measures, and to obtain labor protection articles that meet the national standards or industry standards;

(three) to criticize, suggest, report and accuse the problems existing in the safety production work of the unit;

(4) Refusing to command or force risky operations in violation of regulations, and stopping operations or taking possible emergency measures to leave the workplace when personal safety is found to be directly endangered;

(five) to claim compensation for the damage caused by production safety accidents;

(six) other rights stipulated by laws and regulations.

In production and business activities, employees shall perform the following obligations:

(a) strictly abide by the safety production rules and regulations and operating procedures of the unit;

(two) to receive education and training in production safety;

(three) timely report the hidden dangers of accidents and unsafe factors;

(4) Other obligations stipulated by laws and regulations.
