Which department will punish open burning of garbage?

Burning garbage in the open air shall be punished by the environmental protection and urban management departments. Garbage refers to domestic garbage, crop straws, dead branches, fallen leaves, weeds, electronic garbage, linoleum, asphalt, rubber, plastics, leather and other substances that produce smoke and toxic and harmful gases through combustion. It is forbidden for any unit or individual to burn garbage in the open air, and it is not allowed to throw and burn paper, relics and other funeral commemorative items on urban and rural roads. The supervision and management department determined by the county (District) people's government shall order it to make corrections, impose a fine of 1 10,000 yuan or more on the unit and a fine of 2,000 yuan or more on the individual.

Article 77

The people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall delimit areas and prohibit the open burning of straw, fallen leaves and other substances that produce smoke pollution. Article 82

It is forbidden to burn asphalt, linoleum, rubber, plastic, leather, garbage and other substances that produce toxic and harmful smoke and malodorous gases in densely populated areas and other areas that need special protection according to law.

It is forbidden to produce, sell and set off fireworks and firecrackers that do not meet the quality standards. No unit or individual may set off fireworks and firecrackers in the time and area prohibited by the city people's government. Article 119

Anyone who, in violation of the provisions of this Law, sprays highly toxic pesticides on trees, flowers and plants in densely populated areas, or burns straw, fallen leaves and other substances that produce smoke and dust pollution in the open air shall be ordered to make corrections by the supervision and administration department determined by the local people's government at or above the county level, and may be fined from 500 yuan to 2,000 yuan.

Whoever, in violation of the provisions of this Law, burns asphalt, linoleum, rubber, plastics, leather, garbage and other substances that produce toxic and harmful smoke and malodorous gases in densely populated areas and other areas that need special protection according to law shall be ordered by the supervision and administration department determined by the people's government at the county level to make corrections, and the unit shall be fined from 10,000 yuan to 100,000 yuan, and the individual shall be fined from 500 yuan to 2,000 yuan.

Anyone who, in violation of the provisions of this law, sets off fireworks and firecrackers in the time and area where the people's government of a city prohibits it, shall be punished by the supervision and administration department determined by the local people's government at or above the county level according to law.
