Article 2 These regulations shall apply to the administration of highways within the administrative region of this city. Article 3 The term "highway administration management" as mentioned in these regulations refers to the management of construction control areas on both sides of the highway by the transportation departments of the municipal and district people's governments in accordance with the law to protect highways, highway land, and highway ancillary facilities (hereinafter collectively referred to as highway properties), and promote the development of highways. Article 4 The municipal and district people's governments shall establish and improve relevant systems and effectively strengthen their leadership over highway administration within their respective administrative regions.

The transportation department of the Municipal People's Government is responsible for the administration of highways in this city. Highway administration management follows the principle of unified leadership and hierarchical management. National highways, provincial highways and toll roads are in charge of the municipal transportation department, and county and township roads are in charge of the district transportation department.

The transportation department may entrust the highway management agency to perform highway administration duties and impose administrative penalties in accordance with these regulations.

Planning, land, water conservancy, forestry, public security, industry and commerce and other relevant departments should do a good job in highway administration according to their respective responsibilities. Article 5 Due to construction needs, excavation and occupation of roads, or construction across or across highways must be reported to the municipal transportation department for approval in advance if they are on national highways or provincial roads; if they are on county roads or township roads, they must be reported to the district transportation department in advance. The competent department must agree; if it affects traffic safety, it must also obtain the consent of the public security department. If traffic is interrupted, the transportation department and the public security department shall jointly issue a notice.

Units and individuals approved to carry out construction operations should set up obvious warning signs at the site, repair the highway and resume traffic within a time limit in accordance with regulations. Article 6 To add a level intersection on a highway, the construction unit or individual must obtain the consent of the district transportation department in advance, and submit intersection design drawings and other materials, and submit them to the municipal transportation department for approval before proceeding according to the highway engineering technology. Standard requirements for construction. Article 7 Within the scope of highways and their land, the following behaviors are prohibited:

(1) Setting up sheds, stalls, farmers’ markets, gas stations, maintenance yards, parking lots, etc.;

(2) Stacking items and dumping garbage;

(3) Fetching soil, quarrying, retting, making bricks, burning kilns, planting crops, grazing livestock, digging ditches to divert water, blocking culverts, and drying fields Grain;

(4) Dragging or throwing, scattering, dripping or leaking cargo on the vehicle;

(5) Other behaviors of encroaching, destroying and polluting highways and highway land. Article 8 No unit or individual may set up signs, billboards and other signs other than highway signs without authorization within the scope of highways and highway lands; if it is really necessary to set them up, they must be approved by the municipal transportation department on national highways and provincial highways, county roads, township highways, etc. The road is approved by the district transportation department. Article 9: The planning and construction of new villages and towns, development zones, residential areas and farmers' markets shall maintain a prescribed distance from the highway, and avoid being carried out on both sides of the highway to prevent the street from turning the highway into a street.

It is strictly prohibited to change the nature of highway use without authorization; if it is really necessary to change the nature of highway use, it must be approved by the municipal transportation department, then reported to the provincial transportation department for approval, and the highway property rights change procedures must be completed in accordance with the law. Article 10 The transportation department shall strengthen the management of the construction control areas on both sides of the highway. The construction control area is calculated from the outer edge of the road ditch: national highways are not less than 20 meters, provincial roads are not less than 15 meters, county roads are not less than 10 meters, and rural roads are not less than 5 meters; on the inside of road curves and plane intersections For intersections and urban entrance and exit sections, national highways are not less than 30 meters, provincial roads are not less than 25 meters, county roads are not less than 20 meters, and rural roads are not less than 10 meters; the scope of the construction control areas on both sides of the highway shall be determined according to the "Hubei The provisions of the Provincial Highway Management Regulations are determined.

Except for those required for highway protection and maintenance, it is prohibited to construct buildings and ground structures in the construction control areas on both sides of the highway; if it is necessary to bury pipelines, cables and other facilities in the construction control area, they must be cleared in advance. Article 11 In the construction control areas on both sides of the highway, illegally constructed buildings and ground structures must be unconditionally demolished by themselves within the time limit specified by the transportation department; if they are not demolished within the time limit, the transportation department will forcibly dismantle them in accordance with the law.

If the buildings and ground structures that have been approved according to law are located in the construction control area due to highway construction, they should be demolished by the municipal or district transportation authorities according to the needs of highway development. Article 12 The competent transportation department is responsible for highway greening work, and the greening of toll highways is invested and managed by operating units.

Construct highway green belts in accordance with the principles of "unified planning, multi-party investment, multi-party construction, and unified management". Encourage units and individuals to plant street trees and flowers and green spaces on both sides of the highway in accordance with the plans of the transportation department. Article 13 It is strictly prohibited to cut down highway trees indiscriminately or damage highway flowers and green spaces; it is strictly prohibited to hang billboards, wires and other items on highway trees. If street trees need to be felled, they must obtain the consent of the transportation department, go through the procedures in accordance with the Forest Law of the People's Republic of China and relevant laws and regulations, and complete the replanting task.
