Regulations of Urumqi Municipality on the Administration of Urban Roads

Article 1 In order to strengthen the management of urban roads, ensure the integrity of urban roads, give full play to the functions of urban roads, and promote the economic and social development of cities, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Administration of Urban Roads and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 The term "urban roads" as mentioned in these Regulations refers to roads, bridges and their ancillary facilities that are used by vehicles and pedestrians in the city and have certain technical conditions. Including carriageways, sidewalks, bridges, squares, isolation belts, shoulders, passages with urban road functions, tunnels, culverts, open spaces along the street outside the building control red line and their ancillary facilities. Article 3 The planning, construction, maintenance, repair and road administration of urban roads within the administrative area of this Municipality shall abide by the Regulations of the State Council Municipality on the Administration of Urban Roads and these Regulations. Article 4 The Municipal Appearance Management Bureau is the administrative department of urban roads in this Municipality (hereinafter referred to as the administrative department of urban roads), and is responsible for the unified management of urban roads in this Municipality.

The administrative departments of urban roads of the district and county people's governments shall be responsible for the management of urban roads within their respective jurisdictions, and accept the supervision and guidance of the administrative departments of urban roads.

Planning, land resources, construction, public security, transportation, industry and commerce, water affairs, gardens and other departments shall, in accordance with their respective responsibilities, coordinate in the management of urban roads. Fifth urban road management should follow the principle of unified planning, supporting construction, coordinated development, construction, maintenance and management. Article 6 Urban road administrative departments shall, according to the principle of separation of management and maintenance, organize the maintenance and repair of urban roads, strengthen the supervision and inspection of project quality, and ensure the integrity of urban roads. Seventh city road maintenance, maintenance responsibility according to the following provisions:

(a) the urban roads directly managed by the administrative department of urban roads shall be responsible for organizing the maintenance and repair;

(two) the urban roads managed by the administrative departments of urban roads of the district and county people's governments shall be maintained and repaired by their organizations respectively;

(three) the road of unit investment management shall be maintained by the single organization invested in construction. Eighth urban road maintenance and repair in accordance with the law through bidding.

Units undertaking urban road maintenance and repair shall strictly implement the technical specifications for urban road maintenance and repair to ensure the quality of maintenance and repair projects. Article 9 The following acts are prohibited within the scope of urban roads:

(a) unauthorized occupation and excavation of urban roads;

(two) tracked vehicles, iron wheeled vehicles or overweight, ultra-high and ultra-long vehicles driving on urban roads without authorization;

(three) to carry out various operations that endanger urban roads without authorization;

(4) discharging sewage, dumping garbage and ice cubes into roads;

(five) hanging slogans, advertisements or other floating objects on bridges or street lighting facilities without authorization;

(six) other acts of damage and occupation of urban roads. Article 10 No unit or individual may block or erect obstacles on urban roads without authorization in any form.

Strictly control the opening of markets within the scope of urban roads. If it is really necessary to occupy urban roads as bazaars, it must be approved by the Municipal People's Government. Eleventh pipelines, poles and other facilities attached to urban road construction shall be approved by the municipal administrative department of urban roads before construction. Article 12 If it is necessary to temporarily occupy urban roads (including open parking lots) due to special circumstances, an application shall be submitted to the municipal urban road administrative department, and the occupation shall be carried out in accordance with the provisions after approval by the municipal urban road administrative department and the public security traffic management department. Article 13 If it is necessary to excavate urban roads due to engineering construction, an application shall be submitted to the competent department of urban road administration with the construction project planning permit and relevant design documents issued by the competent department of urban planning administration, and excavation can be carried out in accordance with the regulations only after the approval of the competent department of urban road administration and the public security traffic management department.

Within five years after the new, expanded and rebuilt urban roads are delivered for use, the overhauled urban roads shall not be excavated within three years after completion; Because of special circumstances, it is really necessary to dig, it must be approved by the Municipal People's government, and an additional-to-three times the excavation and repair fee. Fourteenth approved temporary occupation and excavation of urban roads shall comply with the following provisions:

(a) to pay the urban road occupation fee or excavation and repair fee according to the regulations;

(two) in accordance with the approved location, area, time limit for occupation or excavation, it is really necessary to change the location, area, time limit, it should go through the formalities for change in advance;

(3) Safety protection facilities such as guardrails and warning signs should be set at the excavation site;

(4) When excavating urban roads, ensure that underground facilities are in good condition; If it is really necessary to change the underground facilities, the relevant procedures shall be handled according to law;

(five) after the expiration of the occupation of urban roads or the completion of the excavation of urban roads, the site shall be cleaned up in accordance with the provisions, restored to its original state, and the municipal road administrative department shall be notified for inspection and acceptance. Article 15 If a pipeline buried under an urban road breaks down and needs urgent repair, it can be repaired by breaking the road first, and notify the municipal urban road administrative department and the public security traffic management department at the same time, and go through the examination and approval procedures in accordance with the regulations within 24 hours. Sixteenth in the city road set up outdoor advertising, should be approved by the municipal administrative department of urban roads, and go through the relevant formalities in accordance with the law, before setting up. Seventeenth urban roads in danger, affecting traffic safety, urban road administrative departments or public security traffic management departments should actively take measures to ensure the safety of passing vehicles and pedestrians.

In order to eliminate the danger of urban roads, it is necessary to close road traffic, and the administrative department of urban roads and the traffic management department of public security shall jointly issue an announcement in advance.
