The family members of military personnel as mentioned in these Regulations refer to spouses, children, parents and other relatives who have legal dependency with military personnel.
Retired soldiers, reservists and militia who perform military tasks in wartime are treated as soldiers. Article 4 The people's governments at or above the county level shall incorporate the protection of the rights and interests of servicemen and their families into the national economic and social development plan, the activities of establishing a model city (county) with double support and the target management evaluation system for comprehensive management of social security, and establish a coordination mechanism for the protection of the rights and interests of servicemen and their families. Guide and urge the people's governments at lower levels and relevant government departments to do a good job in safeguarding the rights and interests of soldiers and their families, and include the funds needed for the protection work in the financial budget at the corresponding level.
Township people's governments and sub-district offices shall do a good job in safeguarding the rights and interests of military families.
Village (neighborhood) committees shall assist the township (town) people's governments and neighborhood offices in safeguarding the rights and interests of military families. Article 5 The relevant departments of the people's governments at or above the county level shall mainly perform the following duties in safeguarding the rights and interests of servicemen and their families:
(a) the civil affairs department is responsible for pensions and preferential treatment for military families and the resettlement of retired soldiers;
(2) The competent department of human resources and social security shall be responsible for the resettlement of demobilized military cadres and their dependents, and investigate and deal with illegal acts that infringe upon the labor security rights and interests of military families;
(three) the education department is responsible for the education of children of soldiers and college students;
(four) the competent department of health and family planning is responsible for the medical security of military families;
(five) the judicial administrative department is responsible for assisting the garrison troops to establish legal aid workstations for military rights protection, and providing legal advice and legal aid for military families;
(six) the public security organs shall investigate and deal with criminal and public security cases that infringe upon the rights and interests of military personnel.
Development and reform, finance, transportation, housing and urban construction, land and resources, tourism, agriculture and other competent departments shall, in accordance with their respective duties, do a good job in safeguarding the rights and interests of military families. Article 6 People's courts at all levels shall mediate and hear cases of disputes over the rights and interests of servicemen and their families according to law, and waive, reduce or postpone the legal fees for eligible servicemen and their families.
People's procuratorates at all levels shall strengthen legal supervision over handling cases involving the rights and interests of servicemen and their families, and prosecute criminal acts that endanger the rights and interests of servicemen and their families according to law. Article 7 People's Armed Forces Departments of provincial military regions, military sub-regions (garrison areas) and counties (cities, districts) shall assist in safeguarding the rights and interests of military families in accordance with the relevant provisions of the state and this province. Article 8 The news media shall publicize the advanced model of strengthening the army and supporting the army, carry forward the good social fashion of supporting the army and giving priority to its subordinates, and guide the whole society to safeguard the rights and interests of servicemen. Article 9 People's governments at all levels shall take effective measures to safeguard the honor and personal dignity of servicemen and their families.
No unit or individual may denigrate, insult or slander the image of soldiers and reduce their reputation. Article 10 County (city, district) people's governments shall hang glory cards for soldiers and families of martyrs, organize visits to troops and families of soldiers during major festivals such as the Spring Festival, "August 1st Army Day" and when the troops perform important tasks, and organize farewell and welcoming ceremonies during important activities such as enlistment of new soldiers and retirement of soldiers. Glory brand is made by the civil affairs department of the county (city, district) people's government according to the unified style determined by this province.
Soldiers who have been awarded honorary titles and rendered meritorious service shall be organized by the people's government where their household registration is located to congratulate and sympathize with their families before joining the army.
Demobilized military cadres who were awarded the honorary title by the Central Military Commission during their active service enjoy corresponding treatment according to the national model workers (advanced workers); Those who have been awarded the honorary title or won the first-class merit by units at the level of war zones (formerly major military regions) are rated as national model demobilized military cadres, and enjoy corresponding treatment with reference to provincial and ministerial model workers (advanced workers).
The people's governments at or above the county level where soldiers and martyrs are registered before enlisting shall record local chronicles according to the recording standards.
Soldiers who have been assessed as martyrs after sacrifice shall be mourned and praised by the people's government where they registered before enlisting; Representatives of the survivors of martyrs shall be invited to attend major commemorative activities such as national public holidays, martyrs' memorial day, and "August 1st Army Day". Eleventh conscripts serving in active service shall be distributed by the civil affairs department of the people's government at the county level where their household registration is located before enlistment in accordance with the standard of not less than 40% of the per capita disposable income of urban residents in the previous year. Undergraduate graduates, college graduates, and college students who are enlisted in the army, their resettlement fees will be increased by 30%, 20%, and 10% respectively on the basis of the standard they should enjoy.
Where there are other provisions of the state and province on the payment and payment standards of family preferential payments, those provisions shall prevail.
