First, the registration steps are as follows:

Step 1: Prepare the materials.

Step 2: Open the Trademark Office official website and register the account.

Open the trademark registration official website, register your account, and then click on the trademark online application on the homepage of China National Intellectual Property Administration Trademark Office. Next, a protocol box pops up, and click "I accept" to enter the login interface.

Note: Be sure to write the business license address. The Trademark Office will review and consider that your business license address is inconsistent with what you filled in, so you can't apply for a digital certificate or apply online.

Contact person writes the contact person, telephone number and e-mail address who can receive letters from the Trademark Office. This mailbox is the mailbox that the Trademark Office will inform you to mail, and the mailbox must be able to receive mail. The download of the digital certificate will also use this email to send the verification code.

Step 3: Download and install the soft certificate.

After the user has passed the audit, email notification, download and install it.

Step 4: Log in to the system and apply for registration.

Second, the registration instructions

Where a natural person, legal person or other organization needs to obtain the exclusive right to use a trademark for goods or services produced, manufactured, processed, selected or distributed, it shall file an application for trademark registration with the Trademark Office of the State Administration for Industry and Commerce (hereinafter referred to as the Trademark Office) according to law. In a narrow sense, the application for trademark registration only refers to the application for trademark registration of goods and services, the application for international trademark registration, the application for certification trademark registration, the application for collective trademark registration and the application for special symbol registration. The application for trademark registration in a broad sense includes not only the contents of the application for trademark registration in a narrow sense, but also the application for alteration, renewal, transfer registration, objection application, filing application for trademark license contract and other trademark registration matters.

Three. Registration procedure

The application for trademark registration filed by the applicant shall be preliminarily examined and approved by the Trademark Office. If no objection is raised or the objection is ruled invalid, the trademark will take effect and be protected by law, and the trademark registrant will enjoy the exclusive right to use the trademark. Trademark registration takes about one year to one and a half years. There is no statutory time limit for the approval or rejection of an application for trademark registration. The Trademark Office examines and announces the trademark, then issues a trademark registration certificate, and the trademark is approved. The time period of trademark examination will change at any time according to the speed of internal examination of the Trademark Office. The period of validity of a registered trademark is ten years, counting from the date of approval of registration. Where a registered trademark needs to be used again after its expiration, it may apply for renewal of registration.

Four. Registration information

1. A copy of the business license is required for applications in the name of the company, and a copy of the business license is required for applications in the name of individuals.

Provide a copy of the business license and ID card of the self-employed.

2. Six trademark designs. For color trademarks with specified colors, 5 color patterns and 1 black and white ink drafts shall be submitted. The provided trademark pattern must be clear and easy to stick, and replaced by bright and durable paper or photos, with the length and width not exceeding 10 cm and not less than 5 cm (about the size of a business card). If the direction of the trademark pattern is not clear, it should be indicated by an arrow. When applying for trademarks of cigarettes and cigars, the design can be as big as the actual use.

Legal basis:

1. Trademark Law Article 28 The Trademark Office shall, within nine months from the date of receiving the application documents for trademark registration, complete the examination of the trademark applied for registration, and if it meets the relevant provisions of this Law, make a preliminary examination and announcement.

Three. Article 10 of the Trademark Law Legal basis for examination of trademark registration The following marks shall not be used as trademarks:

(1) identical with or similar to the national name, national flag, national emblem, military flag and medal of People's Republic of China (PRC), and identical with the names and graphics of specific place names or landmark buildings where the central state organs are located;

(2) identical with or similar to the name, national flag, national emblem or military flag of a foreign country, except as agreed by the government of that country;

(3) identical with or similar to the name, flag and emblem of an intergovernmental international organization, except with the consent of the organization or not easily misleading the public;

(4) identical with or similar to the official marks and inspection marks indicating the implementation of control and guarantee, unless authorized;

(5) identical with or similar to the names and symbols of the Red Cross and Red Crescent;

(six) with ethnic discrimination;

(seven) exaggerated propaganda and deception;

(eight) harmful to socialist morality or other adverse effects.

Geographical names of administrative divisions at or above the county level or foreign geographical names well known to the public shall not be used as trademarks. However, unless the place name has other meaning or is part of a collective trademark or certification trademark; Registered trademarks using geographical names shall remain valid.
