Regulations of Zhejiang Province on the Promotion of Digital Economy

Chapter I General Provisions Article 1 In order to promote the development of digital economy, speed up the construction of a modern economic system, enhance core competitiveness, promote high-quality development, and promote the modernization of provincial governance, these Regulations are formulated in accordance with relevant laws and administrative regulations and in light of the actual situation of this province. Article 2 These Regulations shall apply to promoting the development of digital economy, building a digital government and a digital society within the administrative region of this province.

The term "digital economy" as mentioned in these Regulations refers to a new economic form with data resources as the key production factor, modern information network as the main carrier, and the integration and application of information and communication technology and the digital transformation of all factors as the important driving force to promote efficiency improvement and economic structure optimization. Article 3 The development of digital economy is an important strategy for the economic and social development of this province, and it should follow the principles of giving priority to development, application-oriented, data-driven, innovation-oriented, talent support, tolerance and prudence, ensuring data security and protecting personal information. Article 4 The people's governments at or above the county level shall strengthen their leadership over the development of the digital economy, incorporate the development of the digital economy into the national economic and social development plan, establish and improve the coordination mechanism for the development of the digital economy, make overall plans for policy formulation, supervise and inspect the implementation of policies, coordinate major issues of the development of the digital economy, and incorporate relevant indicators of the development of the digital economy into the high-quality development performance evaluation system.

People's governments at or above the county level shall take measures to encourage and support the development, popularization and application of digital technology, cultivate and develop new industries, new formats and new models of digital economy, accelerate the construction of technological innovation systems, industrial ecological systems, public service systems and modern governance systems that are compatible with the development of digital economy, and create an optimized environment conducive to the development of digital economy. Fifth provincial economic and information technology departments are responsible for promoting, coordinating and supervising the development of digital economy in this province.

The competent department of economy and informatization of the people's government of a city or county divided into districts or other departments determined by the people's government of a city or county divided into districts (hereinafter referred to as the competent department of digital economy) shall be responsible for promoting, coordinating and supervising the development of digital economy within their respective administrative areas.

The data development department of the people's government at or above the county level or other departments determined by the people's governments of cities and counties (cities, districts) with districts (hereinafter referred to as public data departments) shall be responsible for organizing, guiding and coordinating public data management and promoting the digital transformation of the government.

Other relevant departments of the people's governments at or above the county level shall do a good job in promoting the development of digital economy in accordance with their respective responsibilities. Sixth provincial economic and information technology departments in conjunction with the relevant departments of the province to prepare the provincial digital economy development plan, submitted to the provincial people's government for approval before implementation.

Districts of the city and county (city, district) digital economy department in conjunction with the relevant departments at the same level according to the requirements of the provincial digital economy development planning and actual needs, the preparation of local digital economy development planning, submitted to the people's government at the same level for approval before implementation. Article 7 The provincial standardization department shall, jointly with the relevant departments of provincial economy and informatization, promote the construction of digital economy standard system in this province, establish and improve various digital economy standards such as basic general standards, key technical standards, integrated application standards and safety assessment standards, and guide and support relevant units to adopt advanced digital economy standards.

The people's governments at or above the county level shall organize and support industry associations, industry alliances and leading enterprises to participate in the formulation of international standards, national standards, industry standards and local standards for the digital economy. Encourage industry associations, industry alliances, leading enterprises and other independent development of digital economy group standards or enterprise standards.

The standardization departments of the people's governments at or above the county level and the relevant administrative departments shall supervise and inspect the implementation of standards. Article 8 The provincial administrative department of economy and informatization shall, jointly with statistics and other relevant departments, establish and improve the statistical monitoring index system and comprehensive evaluation system of the digital economy, formulate and improve the statistical classification catalogue of the core industries of the digital economy, carry out daily statistics and operational monitoring according to law, carry out annual development evaluation of the digital economy, and regularly announce the main statistical indicators, monitoring results and comprehensive evaluation index of the development to the public. Article 9 People's governments at or above the county level should strengthen international exchanges and cooperation in the field of digital economy, participate in the construction of the Belt and Road, and enhance the resource concentration and radiation capacity of the digital economy.

The people's governments at or above the county level shall, in accordance with the requirements of the national strategy for regional integration in the Yangtze River Delta, strengthen inter-provincial cooperation in the development of digital economy, and promote the unification of data standards for major digital infrastructure, the opening of public data resources, the collaborative development of intelligent manufacturing, regional integration and collaborative governance of digital applications.

People's governments at or above the county level should strengthen cross-regional cooperation in digital economy in the province, innovate institutional mechanisms, strengthen policy coordination, and promote the development of digital economy. Chapter II Digital Infrastructure Article 10 The digital infrastructure mentioned in these Regulations refers to the public infrastructure system that provides basic information services such as perception, transmission, storage, calculation and comprehensive application for economic and social development and residents' life, mainly including information network infrastructure, computing infrastructure, new technology infrastructure, integrated infrastructure and information security infrastructure. Eleventh provincial economic and information technology departments shall, jointly with relevant departments, according to the requirements of the digital economy development plan of this province, prepare the digital infrastructure development plan of this province, and organize the implementation after approval in accordance with the authority prescribed by the provincial people's government.

The competent department of digital economy of the people's government of a city or county (city) divided into districts shall, jointly with relevant departments, prepare a special plan for digital infrastructure construction according to the development plan of digital infrastructure in the whole province, and organize its implementation after being approved by the people's government at the same level. The special planning of digital infrastructure construction shall conform to the overall planning of land and space, and coordinate with the special planning of municipal, transportation, electric power, public safety and other related infrastructure.

The compilation and implementation of the special plan for digital infrastructure development and construction should follow the principles of advanced technology, moderate advancement, safety and reliability, * * enjoyment of construction, avoidance of duplication, coverage of urban and rural areas, and convenient service, focusing on promoting the construction of new digital infrastructure such as the new generation mobile communication network, big data center, industrial Internet, Internet of Things, vehicle networking, artificial intelligence, blockchain and satellite communication, and speeding up municipal, transportation and satellite communication.

The people's governments at or above the county level should explore the establishment of cross-industry infrastructure "multi-regulation" system and mechanism, and promote the enjoyment of digital infrastructure.
