Chapter I General Provisions

Article 1 In order to do a good job in militia work and reserve work, these Regulations are formulated in accordance with the National Defense Law of People's Republic of China (PRC), the National Military Service Law of People's Republic of China (PRC) and other relevant laws and regulations, and combined with the actual situation of this Municipality.

Article 2 State organs, social organizations, enterprises and institutions, other organizations and citizens within the administrative area of this Municipality shall abide by these Regulations.

Article 3 People at all levels * * * manage the militia reserve work within their respective administrative areas in accordance with the licensing authority prescribed by law, and organize and supervise relevant departments and units to complete the militia reserve work tasks.

The municipal, district and county people's governments shall incorporate the militia reserve work into the national economic and social development plan.

Article 4 The people's armed forces departments of the Shanghai Garrison, districts and counties and the people's military service organs at the same level shall, under the leadership of the military organs at higher levels and the people at the same level, do the following militia reserve work according to their respective responsibilities:

* * * 7 * * Other duties stipulated by laws and regulations.

According to the needs of military work, the Shanghai Garrison can directly lead the militia reserve work of relevant state organs, enterprises, institutions and other organizations.

Article 5 State organs, social organizations, enterprises, institutions and other organizations shall complete the militia reserve task according to the requirements of the Shanghai Garrison, the District People's Armed Forces Department and the people.

Citizens should fulfill their obligations of serving in the reserve service and participating in militia organizations according to law.

Article 6 The people's governments at all levels, the Shanghai Garrison, the people's armed forces departments of districts and counties and the reserve forces shall commend and reward the units and individuals that have made remarkable achievements in the militia reserve work.

Chapter II Organizational Construction

Article 7 According to the provisions of laws and administrative regulations, this Municipality may, according to the needs of military work, pre-enlist eligible male citizens aged 18 to 35 for active service, or be incorporated into reserve forces, militia organizations, or register for reserve service; Eligible female citizens can also be incorporated into reserve forces or militia organizations.

The upper age limit of militia cadres and militia reserve professional and technical personnel may be appropriately relaxed.

Article 8 The formation of militia and reserve personnel shall be conducted in the order of reserve personnel in active service, reserve personnel in reserve forces, backbone militia and ordinary militia in accordance with the principles of facilitating organization and leadership, improving quality, performing tasks and balancing burdens.

Article 9 The organizational tasks of militia reserve personnel shall be assigned by the Shanghai Garrison, and the people's armed forces departments at all levels shall be responsible for organizing and implementing them.

State organs, social organizations, enterprises, institutions and other organizations shall provide the Shanghai Garrison or the District/County People's Armed Forces Department with the relevant information about the personnel who meet the requirements of Article 7 of these regulations; According to the requirements of the People's Armed Forces Department of Shanghai Garrison or District/County, the personnel to be incorporated into the militia reserve organization shall be determined and reported to the People's Armed Forces Department of Shanghai Garrison or District/County for approval.

Article 10 Militia organizations and reserve forces organize rectification once a year, and accept the guidance and acceptance of the Shanghai Garrison, the People's Armed Forces Department at the county level and the military organs at higher levels of the reserve forces.

Article 11 Any change in the work unit and residence of the personnel pre-integrated into the active and reserve forces shall be reported to the original registration department in time.

The People's Armed Forces Department and the reserve forces shall strengthen the management of the militia reserve personnel and timely grasp and update the relevant information of the militia reserve personnel.

Chapter III Political Work

Twelfth city, district and county civil air defense offices shall incorporate the political education of militia reserve personnel into the national defense education work plan.

Departments and units of culture, news, publishing, radio, film and television shall cooperate with the Shanghai Garrison, the People's Armed Forces Department at the county level and the reserve forces to do a good job in the publicity and education of the militia reserve.

Article 13 The People's Armed Forces Department and the reserve forces shall, in combination with the organization of rectification, military training, conscription and major festival activities, conduct political education for militia reserve personnel.

State organs, social organizations, enterprises, institutions and other organizations shall support the militia reserve political education activities carried out by the People's Armed Forces Department and the reserve forces.

Fourteenth grass-roots people's armed forces departments should be equipped with full-time people's armed cadres in accordance with the relevant provisions. Full-time people's armed cadres should have the conditions of political reliability, good health, certain military quality and organization and command ability.

Without the approval of the Municipal People's * * and the Shanghai Garrison, the grassroots people's armed forces departments shall not be revoked or merged.

Article 15 The People's Armed Forces Department and the reserve forces shall, jointly with relevant units, conduct pre-enlistment inspections on militia reserve personnel; Establish a follow-up inspection system for organized militia reserve personnel, and promptly repel unqualified personnel.

Chapter IV Military Training and Combat Readiness Duty

Article 16 The military training of militia reserve personnel shall be conducted in accordance with the military training program and assessment standards. If it is really necessary to adjust the training tasks, the reserve forces or the district or county people's armed forces departments shall apply and report to the military organs at higher levels for approval.

The annual military training tasks of militia organizations and reserve forces shall be compiled and issued by the Shanghai Garrison, the People's Armed Forces Department at the county level and the reserve forces step by step. Except in special circumstances, the People's Armed Forces Department or the reserve forces shall notify the unit where the trainees work 30 days before the start of training.

Seventeenth militia reserve personnel should participate in military training in accordance with the arrangements of the Shanghai Garrison, the District People's Armed Forces Department or the reserve forces, and no unit or individual may obstruct it.

State organs, social organizations, enterprises, institutions and other organizations shall, according to the requirements of the Shanghai Garrison, the District People's Armed Forces Department or the reserve forces, urge the militia reserve personnel of their own units to participate in military training and provide corresponding convenient conditions.

Article 18 The People's Armed Forces Department and the reserve forces shall assess the militia reserve personnel who participated in the training, and the assessment results shall be registered and filed, and the units to which they belong shall be notified.

Article 19 Militia reservists shall undertake the following combat readiness tasks:

In wartime, reservists are transferred to active service according to orders to undertake combat tasks; The militia undertakes the tasks of cooperating with the troops, fighting independently, serving on the battlefield, supporting the front line and defending the rear.

Article 20 The militia reserve personnel shall be organized by the Shanghai Garrison, the District People's Armed Forces Department or the reserve forces to perform combat readiness duties, with the assistance of relevant departments.

Militia reservists shall perform combat readiness tasks in accordance with the approval authority and procedures prescribed by the state.

Chapter V Management of Weapons and Equipment

Article 21 The Shanghai Garrison shall be responsible for the equipping, adjustment and maintenance of militia weapons and equipment.

The allocation, adjustment and maintenance of weapons and equipment of the reserve forces shall be carried out in accordance with the relevant provisions of the state and this Municipality.

Twenty-second militia weapons and equipment shall be kept by the Shanghai Garrison and the District and County People's Armed Forces Department; According to the needs of combat readiness, with the approval of the Shanghai Garrison, it can also be kept by the people's armed forces departments of townships, towns, streets, enterprises and institutions or militia duty points.

The weapons and equipment of the reserve forces shall be kept centrally by the reserve forces. If it does not meet the storage conditions, it shall be stored in the place designated by the military organ at a higher level.

Twenty-third weapons and equipment storage units shall, in accordance with the prescribed standards, establish weapons and equipment storage rooms, equipped with full-time guards, improve safety facilities, implement management systems, and ensure the safety of weapons and equipment in a good tactical and technical state.

Chapter VI Safeguard Measures

Twenty-fourth militia fees are guaranteed by the city, district and county. The People's Armed Forces Department of the Shanghai Garrison and the district and county shall, according to the annual militia work tasks, prepare the militia business budget, which shall be included in the financial budget by the people's government at the same level.

Militia fees are mainly used for militia military training, organizational construction, political work, weapons and equipment management and subsidies for enterprises and institutions to keep militia weapons and equipment.

Twenty-fifth reserve forces construction funds according to the relevant provisions of the state and the city, by the army at all levels and the people of the city.

Reserve personnel who are pre-integrated into active service forces or into reserve forces shall be allocated training funds by military organs at higher levels according to the plan, and the people's governments of cities, districts and counties shall give subsidies for the insufficient part.

Twenty-sixth militia expenses and reserve forces construction funds should be earmarked, strictly managed, and subject to the supervision of military organs at higher levels and people's financial and auditing organs at the same level.

Twenty-seventh militia reserve personnel to participate in military training, combat readiness on duty, the unit shall not reduce their wages and bonuses.

Militia reservists who participate in military training or perform combat readiness duties shall be subsidized in accordance with the relevant provisions of the state and this Municipality.

Militia reservists who participate in military training or perform combat readiness duties are killed or disabled, and the local people give preferential treatment in accordance with relevant state regulations.

Twenty-eighth militia and reserve forces training base construction, into the city, district and county construction planning, in accordance with the relevant provisions of this Municipality with staff, and the implementation of construction, maintenance and other work funds.

Twenty-ninth city and district and county militia weapons and equipment maintenance units, people's armed training institutions and district and county people's armed forces departments, in accordance with the relevant provisions of this Municipality, equipped with staff.

Chapter VII Legal Liability

Thirtieth state organs, social organizations, enterprises, institutions and other organizations have one of the following acts, the District and County People's Bureau shall order it to make corrections, informed criticism, and may be fined between 5,000 yuan and 20,000 yuan; The person in charge who is directly responsible for the unit and other persons who are directly responsible may be fined not less than 300 yuan but not more than 3,000 yuan:

Thirty-first militia reservists who refuse to participate in military training and perform combat readiness duties shall be ordered by the district and county people's governments to make corrections within a time limit; If no correction is made within the time limit, the district and county people's governments may, in addition to enforcing their obligations in accordance with the relevant provisions of the state, give informed criticism a fine ranging from 200 yuan to 2000 yuan.

Thirty-second militia reserve weapons and equipment storage units and their custodians in violation of the provisions of the custody of weapons and equipment, in accordance with the relevant provisions of the state.

Article 33 Any functionary of a state organ who neglects his duty, abuses his power or engages in malpractices for personal gain in the militia reserve work shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Thirty-fourth district and county people * * to impose administrative penalties on units and individuals that violate these regulations, and the district and county people's military service organs shall jointly handle them with relevant departments.

Article 35 If a party refuses to accept the administrative punishment decision made by the district or county people's government in accordance with these regulations, it may apply for administrative reconsideration to the people's government at the next higher level according to law, or bring an administrative lawsuit to the people's court according to law. If it fails to apply for administrative reconsideration, bring a lawsuit or perform the punishment decision within the time limit, the organ that made the decision on administrative punishment may apply to the people's court for compulsory execution.

Chapter VIII Supplementary Provisions
