Measures of Wuwei Municipality on the Administration of Fireworks and Firecrackers

Article 1 In order to strengthen the safety management of fireworks and firecrackers, reduce atmospheric and noise environmental pollution, and ensure the safety of the public and personal property, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the discharge of fireworks and firecrackers and their supervision and management activities within the administrative area of this Municipality.

The term "fireworks" as mentioned in these Measures refers to fireworks products and civil black powder, pyrotechnics, fuses and other items used for the production of fireworks. Third fireworks should adhere to the principles of safety and environmental protection, changing customs, civilization and thrift.

Fireworks management should adhere to the principles of education and guidance, strict control and comprehensive management. Article 4 The people's governments of cities and counties (districts) shall strengthen their leadership over the management of fireworks and firecrackers within their respective administrative areas, and incorporate the management of fireworks and firecrackers into the target management of ecological protection, civilization creation and social governance.

Township (town) people's governments and sub-district offices shall incorporate the management of fireworks and firecrackers into grassroots social governance, and strengthen organization, coordination, supervision and management. Fifth public security organs are responsible for the safety management of fireworks and firecrackers, and investigate and deal with illegal fireworks and firecrackers according to law.

Emergency management, market supervision, comprehensive law enforcement of urban management, housing and urban and rural construction, ecological environment, civil affairs, education, sports, radio and television tourism, transportation and other departments shall, according to their respective responsibilities, do a good job in the management of fireworks and firecrackers according to law. Article 6 Villagers' committees and residents' committees (communities) shall cooperate with relevant units to do a good job in the publicity and education of fireworks and firecrackers, guide villagers (residents) to change their customs, and discharge fireworks and firecrackers in a lawful, civilized and safe manner. Seventh without permission, no unit or individual may produce, operate or transport fireworks; It is forbidden to set off fireworks and firecrackers that do not meet the quality standards.

City, county (District) emergency departments in the approval of fireworks business distribution, should be strictly controlled in accordance with the relevant provisions of the State Council fireworks safety management, reasonable layout. Article 8 The people's governments of cities and counties (districts) and relevant departments shall organize publicity activities on the management of fireworks and firecrackers, educate citizens to abide by the relevant provisions on the safe discharge of fireworks and firecrackers, and increase publicity during major festivals and heavily polluted weather.

Radio, television, newspapers, Internet and other news media should do a good job in the public welfare propaganda of fireworks and firecrackers safety management, and supervise the illegal discharge of fireworks and firecrackers by public opinion.

Schools, kindergartens and other educational institutions shall strengthen publicity and education on the safe discharge of fireworks and firecrackers for students and children.

Guardians of minors shall strengthen education and supervision over the discharge of fireworks and firecrackers by minors. Ninth any unit or individual has the right to report the illegal discharge of fireworks and firecrackers, and the relevant departments that receive the report shall promptly handle and inform the informants.

The relevant departments shall keep confidential the relevant information of informants and protect their legitimate rights and interests. Tenth it is forbidden to set off fireworks and firecrackers in the following areas:

(1) The area west of the northern expressway, north of Lianhuo expressway, east of Jinwu expressway and south of S3 16 line in Liangzhou District.

(2) Areas where fireworks and firecrackers are prohibited as determined by the people's governments of Minqin County, Gulang County and Tianzhu Tibetan Autonomous County.

The people's governments of cities and counties (districts) may, according to the actual situation of their respective administrative areas, make reasonable adjustments to the scope of prohibited areas in a timely manner according to law, and announce them to the public in a timely manner. Eleventh it is forbidden to set off fireworks and firecrackers in the following places outside the areas specified in Article 10 of these Measures:

(a) cultural relics protection units, scenic spots and drinking water source protection areas;

(2) Transportation hubs such as stations, airports, high-speed intersections and railway line safety protection zones;

(three) shopping malls, bazaars, cultural and sports venues and other crowded places;

(four) parks, forests, grasslands, nurseries, haystacks, haystacks and other key fire prevention areas;

(five) medical institutions, kindergartens, schools at all levels, welfare homes and nursing homes;

(6) Units that produce, manage and store inflammable and explosive articles;

(seven) septic tanks, biogas digesters and underground pipe networks, gas (oil) pipelines, communication lines and power transmission (transformation) facilities in the safety protection zone;

(8) Industrial parks and logistics parks;

(nine) other places where fireworks and firecrackers are prohibited as prescribed by the people's government of the city or county (District). Twelfth in the areas and places that are not prohibited by these measures, it is forbidden to set off fireworks and firecrackers in the following time:

(1) During the warning period of heavy polluted weather and strong wind;

(2) during the college entrance examination and senior high school entrance examination;

(3) Other times when the discharge is prohibited according to law. Thirteenth fireworks, shall comply with the following provisions:

(1) Fireworks and firecrackers shall not be set off indoors, in windows, in corridors, on roofs and in public corridors;

(2) Never throw or place lit fireworks and firecrackers at people, vehicles, buildings, public green spaces, manholes and other public facilities;

(three) fireworks and firecrackers shall not be set off in other ways that endanger public safety and personal and property safety.
