Conditions for creating a national model court

The People's Court is the national judicial organ of the People's Republic of China. The People's Republic of China has established specialized people's courts such as the Supreme People's Court, local people's courts at all levels, and military courts. The hearing of cases shall be conducted in public, except for special circumstances stipulated by law. The defendant is entitled to an opportunity to defend himself. The people's courts independently exercise judicial power on behalf of the state in accordance with legal provisions and will not be interfered by any administrative agencies, social groups, individuals or others.

Article 3 of the "Criminal Procedure Law of the People's Republic of China" is responsible for the investigation, detention, arrest and pre-trial of criminal cases, and the public security organs are responsible. The People's Procuratorate is responsible for procuratorial work, approval of arrests, investigation of cases directly accepted by the procuratorial organs, and prosecution. Trials are conducted by the People's Court. Except as specifically provided by law, no other agency, group or individual has the right to exercise these powers. The People's Courts, People's Procuratorates and public security organs must strictly abide by the relevant provisions of this Law and other laws when conducting criminal proceedings.

"Measures for the Registration and Management of Forensic Authentication Institutions"

Article 33: Judicial administrative organs shall supervise and inspect judicial appraisal institutions in accordance with unified arrangements and law.

If citizens, legal persons and other organizations report or complain about violations of the provisions of these Measures by judicial authentication agencies, the judicial administrative organs shall promptly conduct supervision and inspections and handle them based on the investigation results.
