Article 1: In order to strengthen the construction and management of urban road traffic safety facilities, give full play to the functions of traffic safety facilities, and ensure traffic safety and smoothness, these Measures are formulated in accordance with relevant national regulations and in combination with the actual situation of Xiamen City. Article 2 Urban road traffic safety facilities include traffic command signal systems, traffic closed-circuit television monitoring systems, traffic communication systems, road traffic signs and markings, traffic isolation, traffic guardrails, guide posts and traffic command posts within the scope of urban roads. , traffic booths and other auxiliary facilities related to urban road traffic safety and management. Article 3 The Xiamen Municipal Public Security and Traffic Management Bureau is the administrative department in charge of urban road traffic safety facilities in this city and is responsible for the management of urban road traffic safety facilities in this city. Article 4: All units and individuals should take good care of urban road traffic safety facilities and have the right to stop, report and accuse behaviors that damage urban road traffic safety facilities.

Recognize and reward units and individuals who have contributed to maintaining and protecting urban road traffic safety facilities. Article 5 The urban transportation plan shall be organized and prepared by the competent department of the municipal government, and shall be submitted to the Municipal People's Government for approval after comprehensive balance by the municipal planning management department.

New construction, expansion, and reconstruction of urban roads should be based on the needs of urban traffic planning to ensure that urban road traffic safety facilities and urban roads are designed, constructed, and completed at the same time as urban roads.

The public security and traffic management department must participate in the joint review of the design plan of urban road traffic safety facilities; the public security and traffic management department must participate in the completion acceptance of urban road traffic safety facilities. Article 6 The management department of urban road traffic safety facilities shall be responsible for the maintenance and repair of urban road traffic safety facilities and ensure the intact and effective operation of urban road traffic safety facilities. Article 7 If urban road traffic safety facilities need to be moved or damaged due to excavation of urban roads or other reasons, they must be submitted to the public security and traffic management department for approval in addition to the approval of the municipal management department. The construction unit should set up temporary traffic safety facilities at the construction site. After completion of the construction, the original traffic safety facilities should be restored and reported to the public security and traffic management department for acceptance.

If traffic accidents occur due to unauthorized movement or damage of traffic safety facilities without the approval of the public security and traffic management department, the construction unit shall bear the corresponding liability for the accident. Article 8 The following behaviors that affect the functions of urban road traffic safety facilities are prohibited:

(1) Setting up billboards and publicity boards within urban roads without approval from relevant departments;

( 2) Setting up road signs, street signs or guide signs within the scope of urban roads without the approval of relevant departments;

(3) Using signboards and symbols that may be confused with traffic signs and markings around urban roads , patterns;

(4) Set up red, yellow, and green light sources that interfere with driver vision around urban roads, or set up other objects that produce dazzling light sources or reflective effects;

(5) Setting up traffic signs, markings and traffic separation facilities on urban roads without authorization;

(6) Posting and hanging propaganda slogans, propaganda signs and propaganda flags on traffic safety facilities;

(7) Drying clothes, quilts or other debris on traffic safety facilities;

(8) Other behaviors that affect the functions of urban road traffic safety facilities. Article 9 prohibits the following acts of damaging urban road traffic safety facilities:

(1) Unauthorized demolition, relocation, blocking, or modification of traffic safety facilities;

(2) Cutting and digging to separate traffic Guardrails;

(3) Painting or destroying traffic signs and markings;

(4) Unauthorized digging of underground pipelines attached to traffic safety facilities;

(5) ) Other behaviors that damage traffic safety facilities. Article 10 Units that need to install movable traffic isolation guardrails (hereinafter referred to as movable guardrails) may apply to the public security and traffic management department. The public security and traffic management department should decide whether to set up movable guardrails based on the vehicle flow and road conditions of the applicant unit.

Units that have been approved to set up movable guardrails should have dedicated personnel to guard the movable guardrails. When vehicles enter or exit, open and close the movable guardrail in a timely manner to maintain traffic safety and traffic order around the movable guardrail. Article 11 A necessary distance must be maintained between trees and traffic safety facilities within urban roads. When natural growth affects the function of traffic safety facilities, the public security and traffic management department shall prune it after consultation with the city gardening department.

When trees on city-wide highways affect the function of traffic safety facilities, they must be pruned according to regulations after obtaining the consent of the traffic management department. Article 12 Anyone who violates the provisions of Article 8 of these Measures shall be ordered to make corrections by the public security and traffic management department and may be fined not less than 100 yuan but not more than 5,000 yuan. Those who refuse to make corrections will be forcibly demolished in accordance with the law. Article 13 Anyone who violates the provisions of Article 9 of these Measures shall be ordered by the public security and traffic management department to stop the illegal act and shall be fined not less than 200 yuan but not more than 10,000 yuan. If a loss is caused, the original condition shall be restored or the loss shall be compensated. Anyone who deliberately damages traffic safety facilities shall be punished in accordance with the "Regulations on Public Security Administration and Punishment of the People's Republic of China"; if a crime is constituted, his criminal responsibility shall be investigated in accordance with the law. Article 14 Anyone who violates the provisions of paragraph 2 of Article 10 of these Measures by not setting up a dedicated person to guard the movable guardrail or failing to close the movable guardrail in a timely manner shall be ordered by the public security and traffic management department to make corrections within a time limit. Anyone who refuses to make corrections will be fined not more than RMB 200 and the movable guardrail will be replaced with a fixed guardrail. If a traffic accident is caused, a fine of not less than RMB 500 but not more than RMB 10,000 will be imposed.
