Measures of Qiqihar Municipality on Implementing the Law of People's Republic of China (PRC) Municipality on Assembly, Demonstration and Demonstration

Article 1 In order to ensure the citizens of this Municipality to exercise their rights of assembly, procession and demonstration according to law, and to maintain social stability and public order, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) Municipality on Assembly, Parade and Demonstration and in light of the actual situation of this Municipality. Article 2 Assemblies, processions and demonstrations held within the administrative area of this Municipality must abide by the Law of People's Republic of China (PRC) Municipality on Assemblies, Processions and Demonstrations and these Measures. Article 3 People's governments at all levels shall protect citizens' rights of assembly, procession and demonstration according to law.

When exercising the rights of assembly, procession and demonstration, citizens must abide by the Constitution and laws, and may not object to the basic principles set by the Constitution. Shall not harm the interests of the state, society and the collective, as well as the legitimate freedoms and rights of other citizens. Article 4 The competent authorities of assemblies, processions and demonstrations in this Municipality are the district and county public security bureaus where the assemblies, processions and demonstrations are located; Where the route of procession and demonstration passes through more than two districts and counties, the competent authority shall be the Municipal Public Security Bureau. Article 5 To hold an assembly, a procession or a demonstration in this Municipality, an application must be submitted to the competent authority in accordance with the law and permission must be obtained. However, according to the relevant provisions of the Law of People's Republic of China (PRC) on Assemblies, Demonstrations and Demonstrations, there is no need to apply. Article 6 An assembly, a procession or a demonstration must have a responsible person, who must hold a resident identity card and submit a written application to the public security organ five days before the assembly, procession or demonstration is held. The public security organ shall not accept applications in other ways.

The application shall specify the purpose, mode, slogan, slogan, number of people, number of vehicles, type and quantity of audio equipment used, starting and ending time, place (including assembly place and dissolution place), route and name, occupation and address of the person in charge. Seventh in the name of state organs, social organizations, enterprises and institutions to organize or participate in the assembly, procession and demonstration, must be approved in advance by the principal responsible person of the unit. The application must be stamped with the official seal of the organization. Article 8 After receiving an application for an assembly, a procession or a demonstration, the public security organ shall, in accordance with the provisions of the Law of People's Republic of China (PRC) on Assemblies, Processions and Demonstrations, directly serve the notice of approval or disapproval to the applicant two days before the application date. If the license is not granted, the reasons shall be explained. If it is not delivered within the time limit, it shall be deemed as a license; If the notice of decision cannot be served due to the reason of the person in charge of the application, the application shall be deemed to have been withdrawn. Article 9 Where an application for holding an assembly, a procession or a demonstration needs to solve specific problems, the public security organ may, after receiving the application, notify the relevant organ or unit to negotiate with the person in charge of the application for holding an assembly, a procession or a demonstration to solve the problem, and may postpone the application for holding for five days.

The relevant organs or units must report the consultation results to the public security organs within the time limit prescribed by the public security organs. Article 10 If a public security organ believes that holding an assembly, a procession or a demonstration according to the time, place and route applied for will have a serious impact on traffic order and social order, it may change the time, place and route of the assembly, procession or demonstration when or after deciding to permit it, and notify its responsible person in time. Article 11 An application for holding an assembly, a procession or a demonstration shall not be granted under any of the following circumstances:

(a) Violating the basic principles stipulated in the Constitution;

(2) endangering national unity, sovereignty and territorial integrity;

(3) Inciting ethnic division;

(four) there are sufficient reasons to believe that the assembly, procession and demonstration applied for will directly endanger public security or seriously undermine social order. Article 12 If the person in charge of an assembly, a procession or a demonstration refuses to accept the decision of the public security organ not to permit it, he may apply to the people's government at the same level for reconsideration within three days from the date of receiving the notice of the decision. The people's government shall make a decision within three days after receiving the application for reconsideration. Thirteenth citizens who are not permanent residents of this Municipality or have no residence permit in this Municipality shall not launch, organize or participate in citizens' assemblies, processions and demonstrations in this Municipality. Article 14 The public security organ shall send people's police to maintain traffic order and social order for assemblies, processions and demonstrations held with legal permission. When an accident occurs, the public security organ may take necessary safeguard measures according to the actual situation. Article 15 No organization or individual may use violence, coercion or other illegal means to disrupt, shock or destroy an assembly, a procession or a demonstration held according to law.

Without permission, no organization or individual may participate in the ongoing assembly, procession or demonstration at will. Article 16 When an assembly, procession or demonstration is held or passed by the Party and state organs, military organs, radio stations, television stations and other important places, the public security organ may set up a temporary cordon nearby in order to maintain order, and no one may cross it without the permission of the people's police. Seventeenth important military facilities, airports, stations and other places around the distance 10 meters to 300 meters, no assembly, procession and demonstration. Article 18 An assembly, a procession and a demonstration shall be conducted peacefully in accordance with the permitted purpose, slogan, starting and ending time, place and route. Article 19 Assemblies, processions and demonstrations must comply with the following provisions:

(a) shall not disturb the work, production, teaching, scientific research and people's life order;

(two) shall not block vehicles, occupy traffic booths, damage vehicles and facilities;

(3) Do not carry weapons, controlled knives, inflammable and explosive articles and other articles endangering public safety;

(four) are not allowed to scribble and post slogans along the way;

(five) shall not use violence or incite the use of violence;

(six) shall not slander, insult others, or create trouble, disturb the order of public places;

(seven) shall not be published or shouted to incite others to engage in illegal activities or slogans;

(eight) shall not damage the gardens, green spaces and public facilities.
