Measures of Zunyi Municipality on the Administration of Urban Road Traffic Safety Facilities

Article 1 The purpose of legislation is to strengthen the construction and management of urban road traffic safety facilities, prevent and reduce road traffic accidents, and ensure road traffic safety, order and smoothness. According to the "Road Traffic Safety Law of the People's Republic of China", the State Council "Regulations on Urban Road Management" and other laws and regulations, combined with the actual situation of this Municipality, these measures are formulated. Article 2 Scope of Application These Measures shall apply to the planning, design, construction, management and maintenance of urban road traffic safety facilities within the administrative area of this Municipality.

Urban road isolation belts and road guardrails managed by municipal departments shall be managed in accordance with relevant laws and regulations on municipal administration. Article 3 Definitions of Terminology The term "urban road traffic safety facilities" as mentioned in these Measures refers to traffic signs, traffic markings, traffic signal lights, traffic monitoring facilities and their special power supply, communication pipe network, support rods and other auxiliary facilities installed on urban roads. Article 4 Basic Principles The construction and management of urban road traffic safety facilities shall follow the principles of unified planning, rational layout, scientific setting, supporting construction and hierarchical management, and be adjusted and improved in a timely manner in combination with urban road network construction and actual traffic demand. Article 5 Duties The traffic administrative department of the municipal public security organ shall be responsible for the supervision and management of the city's urban road traffic safety facilities.

The traffic administrative department of the county (city, district) public security organ shall be responsible for the supervision and management of traffic safety facilities within its jurisdiction according to the division of responsibilities.

Natural resources, development and reform, housing and urban construction, comprehensive administrative law enforcement (urban management), landscaping, finance and other departments shall, in accordance with their respective responsibilities, cooperate with the construction and management of urban road traffic safety facilities. Article 6 Financial Security The people's governments at or above the county level shall include the funds for the construction, management and maintenance of urban road traffic safety facilities in the fiscal budget at the corresponding level, and use them for special purposes. Article 7 Rights and Obligations No unit or individual may set up, move, occupy, alter or damage urban road traffic safety facilities without authorization, and have the right to stop and report the damage to urban road traffic safety facilities. Article 8 When building, rebuilding and expanding urban roads are planned synchronously, traffic safety facilities shall be planned, designed, constructed, accepted and put into use simultaneously with the main project. In the process of construction, if the construction unit really needs to change the contents of road traffic safety facilities in the engineering design scheme, it shall solicit the opinions of the traffic management department of the public security organ in writing. Eleventh traffic impact assessment When evaluating the traffic impact of new and expanded urban road construction projects, the design and construction of urban road traffic safety facilities should be taken as the evaluation index. Twelfth after the completion of the acceptance of urban roads, the construction unit shall notify the traffic administrative department of the public security organ to participate in the acceptance of supporting traffic safety facilities.

Urban roads with traffic safety facilities that have not been accepted and unqualified shall not be put into use without authorization. Thirteenth in the new construction, renovation and expansion of urban roads, the special power supply facilities required for traffic safety facilities should be built simultaneously. For urban roads that have been put into use but have not built special power supply facilities for supporting traffic safety facilities, traffic safety facilities can take electricity from street lighting, urban power supply and other electricity facilities, and the electricity charges are accounted for separately, and relevant departments should cooperate. Fourteenth management responsibilities after the acceptance of urban road traffic safety facilities, the traffic management department of the public security organ is responsible for the management and maintenance.

The construction unit shall timely submit the completion and acceptance of traffic safety facilities, the list of facilities and other relevant information to the traffic management department of the public security organ for inspection. If the information is complete, the traffic management department of the public security organ shall be included in the management in time.

Urban road traffic safety facilities have not been handed over, and the relevant facilities are managed and maintained by the construction unit. Fifteenth organs, organizations, enterprises, institutions and other jurisdictions that allow social motor vehicles to pass through shall be responsible for the construction, management and maintenance of traffic safety facilities, and accept the guidance and supervision of the traffic management department of the public security organ. Article 16 Maintenance Methods The administrative department in charge of urban road traffic safety facilities may entrust a professional maintenance unit to maintain urban road traffic safety facilities according to law, and the maintenance unit shall conduct regular inspections and timely maintenance of traffic safety facilities to keep them in good working condition.

Abandoned traffic safety facilities on urban roads that have not been put into use shall be removed by the maintenance department in time.

The maintenance and management of urban road traffic safety facilities shall conform to the relevant national, provincial and municipal technical standards and industry norms. Article 17 If the facilities repair unit may affect the normal use of urban road traffic safety facilities due to construction or other activities, it shall report to the traffic management department of the public security organ for approval in advance, set up temporary traffic safety protection measures in accordance with relevant standards and requirements, and carry out construction within the approved road sections and time.

After the completion of construction work, obstacles should be quickly removed, potential safety hazards should be eliminated, and urban road traffic safety facilities should be restored to their original state. Only after passing the inspection by the competent department of roads and the traffic management department of public security organs can traffic be resumed.

When the inspection wells, box covers or ancillary facilities of various pipelines on urban roads are damaged or displaced, which affects traffic and safety, the relevant property rights responsibility units shall timely fill the gaps or repair them.
