Decision of the Standing Committee of Qingdao Municipal People's Congress on Amending the Provisions of Qingdao Municipality on Prohibiting the Production and Sale of Fireworks and Firecrackers (2004)

First, the title of the Ordinance is amended as "Provisions of Qingdao Municipality on Prohibiting the Production and Restricting the Sale of Fireworks and Firecrackers". Article 2 is amended as: "These Provisions shall apply to the built-up areas of Shinan District, Shibei District, sifang district, Licang District and Laoshan District." Three. Article 3 is amended as: "The municipal public security department is the competent department for implementing these Provisions.

"Urban management, industrial and commercial administration, environmental protection, transportation and other relevant departments shall, in accordance with their respective responsibilities and these Provisions, do a good job in the management of prohibiting the production and restricting the sale and discharge of fireworks and firecrackers." One article is added as Article 4: "Fireworks and firecrackers (including electronic and other simulated firecrackers, the same below) are prohibited in the following places:

(a) stations, docks, airports and other crowded public places;

(2) Hospitals, schools, kindergartens, rest places for the elderly, etc. ;

(3) roofs, balconies, stairs, corridors, windows, etc. ;

(4) Mountains, green spaces and tourist attractions;

(five) funeral homes, cemeteries and other funeral places;

(six) cultural relics protection units or places at or above the municipal level;

(seven) gas stations, liquefied gas supply stations (points), oil depots and other places where inflammable and explosive goods are produced and stored, and the fire-free areas around them within 100 meters;

(eight) other places designated by the Municipal People's government to prohibit the discharge of fireworks and firecrackers. 5. Article 4 is renumbered as Article 5 and amended as: "Fireworks and firecrackers may be set off on the 23rd day of the twelfth lunar month, New Year's Eve, the first day, the second day, the third day and the fifteenth day of the first lunar month in areas other than those specified in Article 4. Fireworks and firecrackers are prohibited at other times.

In major festivals and city-wide celebrations and celebration activities, fireworks and firecrackers need to be set off, and the organizer shall apply to the municipal public security department, and after being audited by the municipal public security department, it shall be reported to the Municipal People's Government for approval, and after issuing a notice, it shall be set off at the designated time and place. Six, an increase of two, as sixth and seventh respectively:

"Article 6 The residents' committees and owners' committees are encouraged to organize residents in their residential areas to set off fireworks and firecrackers in open-air areas at the time when they are allowed to set off, or to organize residents to formulate residents' conventions and owners' conventions, and to stipulate that fireworks and firecrackers should not be set off in their residential areas or concentrated time and place.

Seventh fireworks should pay attention to personal safety and property safety, care for public health, observe social order, and respect the rights of others to work, live, study and rest.

Fireworks and firecrackers shall not be thrown at pedestrians, vehicles, buildings and structures, and shall not endanger the safety of others or affect traffic order. "Seven, the first paragraph of article fifth to eighth, ninth, tenth and eleventh, as amended:

"Eighth prohibit any unit or individual from making fireworks.

Ninth fireworks wholesale business, approved by the public security department and issued a "explosive sales license" franchise units unified management.

Without the approval of the original examination and approval authority, the fireworks wholesale franchise unit shall not transfer or decompose the sales license, and shall not hand it over to other units and individuals to engage in the fireworks wholesale business.

Tenth intends to engage in fireworks retail business, it shall apply to the district public security department, and report to the municipal public security department for approval, and obtain the "temporary sales license for fireworks". To apply for a temporary sales license for fireworks and firecrackers, the following conditions shall be met:

(1) Having the business license of the general merchandise wholesale and retail enterprise as a legal person;

(2) Having a fixed and independent business place and a special warehouse;

(3) The business premises and warehouses have fire-proof and explosion-proof facilities that meet the requirements;

(four) other conditions stipulated by the municipal public security department.

The district public security department shall, within ten days from the date of receiving the application, review and put forward opinions and report to the municipal public security department. The municipal public security department shall make a decision on approval or disapproval within five days. If it decides not to approve, it shall explain the reasons to the applicant in writing.

Fireworks retail units shall, during the period from the 15th day of the twelfth lunar month to the 15th day of the first lunar month, purchase fireworks and firecrackers from the wholesale franchise units and sell them.

Eleventh prohibit the sale and discharge of firecrackers, throwing guns, smashing guns and other dangerous fireworks.

The varieties and specifications of fireworks and firecrackers that are prohibited from being sold and discharged shall be stipulated by the municipal public security department. 8. Paragraph 2 of Article 5 is renumbered as Article 12, which is amended as: "Where a fireworks wholesale franchise unit purchases fireworks or is approved to set off fireworks to buy fireworks, it shall apply to the municipal public security department for a transport permit for explosives, which shall be carried by a transport enterprise with specified qualifications." 9. Article 7 is renumbered as Article 14 and amended as: "Units and individuals that violate these provisions shall be punished in accordance with the following provisions:

(a) units that set off fireworks and firecrackers in violation of regulations shall be fined 4,000 yuan by the public security department or the urban management department, and according to the seriousness of the case, the person in charge of the unit and the discharger shall be fined 200 yuan to 1000 yuan respectively;

(two) individuals who set off fireworks in violation of regulations shall be fined from one hundred yuan to one thousand yuan by the public security department or the urban management department depending on the seriousness of the case;

(three) the units and individuals that manufacture and sell fireworks and firecrackers in violation of regulations shall be confiscated by the public security department or the administrative department for industry and commerce; A fine of four thousand yuan to ten thousand yuan shall be imposed on the unit, and a fine of five hundred yuan to two thousand yuan shall be imposed on the person in charge of the unit; Depending on the seriousness of the case, impose a fine of five hundred yuan to two thousand yuan on individuals;

(four) in violation of the provisions of article twelfth, the public security department shall confiscate the fireworks and firecrackers transported, and impose a fine of one thousand yuan to two thousand yuan on the carrier;

(five) in violation of the provisions of article thirteenth, fireworks and firecrackers shall be confiscated by the relevant departments, and if the circumstances are serious, they shall be handed over to the public security department for handling. "
