Regulations of Xuzhou Municipality on Work Safety

Chapter I General Provisions Article 1 In order to strengthen the work of production safety, prevent and reduce production safety accidents, ensure the safety of people's lives and property, and promote sustained and healthy economic and social development, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Work Safety, the Regulations of Jiangsu Province on Work Safety and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the safety production of production and business operation entities within the administrative area of this Municipality and their related supervision and management activities.

Where relevant laws and regulations have other provisions on fire safety and road traffic safety, railway traffic safety, rail traffic safety, water traffic safety, civil aviation safety, nuclear and radiation safety, special equipment safety and construction engineering safety, such provisions shall apply. Article 3 Work safety in production shall adhere to the principle of safety first, prevention first and comprehensive management, and establish a mechanism of production and business operation units being responsible, employees participating, government supervision, industry self-discipline and social supervision in accordance with the principle that industry management, enterprise management and production and operation must manage safety. Article 4 The production and business operation entity is the main body responsible for production safety, and shall abide by the laws, regulations and standards of production safety, implement the responsibility system for production safety for all employees, establish and improve the rules and regulations of production safety, promote the standardization of production safety, improve the level of production safety, the ability of accident prevention and emergency response, and ensure production safety. Article 5 The municipal, county (city) and district people's governments shall incorporate the work of production safety into the overall plan of national economic and social development, formulate and organize the implementation of special plans for production safety, determine the responsibilities of supervision and management of production safety of relevant departments, strictly implement the territorial supervision responsibilities, improve the emergency rescue system for production safety, establish and improve the input guarantee system for production safety, and implement the target responsibility system for production safety, the responsibility assessment system and the responsibility investigation system for accidents.

Town People's Government, sub-district offices, development zones (including industrial parks, industrial park management committees and other local people's government agencies) shall set up safety production supervision and management institutions in accordance with regulations, and be equipped with safety production supervision and inspection personnel and equipment that meet the requirements of safety production law enforcement, supervise and inspect the safety production conditions of production and business units within their jurisdiction, and assist relevant departments of the people's government at higher levels to perform their duties of safety production supervision and management according to law. Sixth city, county (city), the District People's government emergency management department is responsible for guiding and coordinating, supervision and inspection, inspection and assessment of the safety work of the relevant departments of the government at the same level and the lower levels of government, according to the law of the administrative region of the implementation of comprehensive supervision and management of production safety work; Other relevant departments shall, within the scope of their respective duties, supervise and manage the work of production safety in related industries and fields according to law. The specific responsibilities of emergency management departments and other departments that supervise and manage production safety in related industries and fields shall be determined by the municipal, county (city) and District People's governments.

Emergency management departments and other departments that supervise and manage production safety in related industries and fields are collectively referred to as departments responsible for supervision and management of production safety. The department responsible for the supervision and administration of production safety shall set up or clarify the supervision and administration of production safety institutions and personnel, and be equipped with law enforcement equipment that meets the requirements. Article 7 The municipal, county (city) and district people's governments and their relevant departments, as well as social organizations and production and business units shall take various forms to strengthen the publicity and education of safety production laws and regulations and safety production knowledge and skills, enhance the awareness of safety production of the whole society, and improve the ability of accident prevention and self-help and mutual rescue.

City, county (city) and District People's governments shall set up safety education practice bases and innovate the forms of safety production education.

Radio, television, newspapers, Internet and other media units shall carry out public welfare publicity and education on production safety, and supervise the work of production safety by public opinion. Article 8 The municipal, county (city) and district people's governments and their relevant departments shall commend and reward the units and individuals that have made remarkable achievements in improving the conditions for safe production, preventing or reducing production safety accidents, participating in emergency rescue, reporting major hidden dangers of accidents, reporting violations of production safety, researching and popularizing the application of safety production science and technology and advanced management experience, and supervising and managing production safety. Chapter II Guarantee of Safety in Production of Production and Business Operation Units Article 9 The principal responsible person of a production and business operation unit shall be fully responsible for the safety in production of the unit and perform the duties of safety in production as stipulated by laws and regulations. Article 10 The person in charge of production safety of a production and business operation entity shall directly supervise and manage the work of production safety and perform the following duties:

(a) to organize the daily supervision and management of production safety, and urge the implementation of the responsibility system for production safety, rules and regulations, technical standards and operating procedures;

(two) to check the performance of the duties of the safety production management institutions;

(three) to coordinate the implementation of production safety investment, to ensure effective implementation;

(four) to organize the implementation of safety production risk identification and assessment, management of major hazard sources, investigation and rectification of hidden accidents, and emergency management of production safety accidents;

(five) coordinate and solve the problems in the work of production safety, and report to the main person in charge;

(six) other duties of production safety as prescribed by laws and regulations.

Other persons in charge of production and business operation entities shall, in accordance with their respective division of labor, perform their duties of production safety within their business scope. The person in charge of the production and business operation entity shall perform the duties of production safety within the business scope or production area of the department.
