Article 1 In order to protect the public, personal and property safety, improve environmental quality, reduce pollution and promote the construction of civilized city in Tai 'an, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers and other laws and regulations, combined with the actual situation of this Municipality.

Article 2 These Regulations shall apply to the discharge of fireworks and firecrackers and their supervision and management activities within the administrative area of this Municipality.

Fireworks and firecrackers as mentioned in these Regulations refer to fireworks and firecrackers products and civil black powder, pyrotechnics, fuses and other items used for the production of fireworks and firecrackers.

Third city and county (city, district) people's government is responsible for the organization and leadership of fireworks and firecrackers and related supervision and management work, establish a joint meeting system, and comprehensively coordinate related major issues.

The public security organ is responsible for the safety management of fireworks and firecrackers.

Safety production supervision and management department is responsible for the safety supervision and management of fireworks production and operation.

Environmental protection, education, urban management (administrative law enforcement), civil affairs, housing and urban and rural construction, transportation, culture, radio, film and television, press and publication, industry and commerce administration (market supervision), meteorology, supply and marketing and other departments shall, according to their respective functions and duties, do a good job in relevant supervision and management.

Fourth Township People's governments and sub-district offices shall incorporate the safety management of fireworks and firecrackers into the comprehensive management of social security, strengthen organization, coordination, guidance and supervision, and cooperate with relevant departments to do relevant work.

Residents' committees, villagers' committees, realty service enterprises, owners' autonomous organizations, units and individuals engaged in wedding, funeral and festive services, and hotels and other units that undertake weddings and ceremonies shall cooperate with relevant departments to do a good job in the management and publicity of fireworks and firecrackers, and shall inform and discourage those who set off fireworks and firecrackers in violation of the provisions of this Ordinance. If dissuasion is ineffective, it shall report to the public security organ in time.

Article 5 People's governments at all levels and relevant departments, enterprises, institutions and social organizations shall organize and carry out publicity activities on the safe discharge of fireworks and firecrackers, and increase publicity during major festivals and heavily polluted weather.

Schools, kindergartens and other educational institutions shall incorporate the safe discharge of fireworks and firecrackers into the content of safety education, and strengthen the safety discharge education of fireworks and firecrackers for students and minors.

Radio, television, newspapers, internet and other news media should do a good job in the propaganda of fireworks and firecrackers.

Article 6 People's governments at all levels shall include the funds for the management of fireworks and firecrackers in the fiscal budget at the corresponding level.

Article 7 Fireworks and firecrackers are prohibited in the following areas:

(1) Tai 'an City: to the east of Taohuayuan Road and G3 Expressway, to the west of Boyang Road (including the line extending northward from the intersection of Boyang Road and Bi Xia Street to Tangjiazhuang Village, Liujiazhuang Village, Simayu Village, Shajialing Village, Qijiatan Village and Wangjiazhuang Administrative Village), to the south of Huanshan Road and to the north of Yitianmen Street in High-tech Zone;

(2) Culaishan National Forest Park;

(3) Taishan Scenic Area designated by the Administrative Committee of Taishan Scenic Area;

Article 8 Fireworks and firecrackers are prohibited in the following places outside the areas specified in Article 7 of these Regulations:

(a) the office space of organs and institutions;

(2) cultural relics protection units;

(3) Traffic hubs such as stations, docks and airports, expressways, tunnels, overpasses, viaducts (roads), overpasses, underground passages and railway line safety protection zones;

(4) Places where fireworks and firecrackers are produced, managed and stored;

(five) gas stations, liquefied gas supply stations (points), oil depots, important material warehouses and other inflammable and explosive goods production, management and storage units (places) and oil (gas) pipeline safety protection zones;

(6) Safety protection zones for power transmission and transformation facilities such as substations and high-voltage lines;

(seven) medical institutions, kindergartens, schools, pension institutions, welfare homes, etc. ;

(eight) scenic spots, forests, green spaces, parks, nurseries, wetlands, etc. ;

(9) Banks, parking lots (garages), shopping malls, cinemas (theaters), bazaars, public places of entertainment, public cultural facilities (places), places for religious activities and other crowded public places;

(ten) the public corridors, stairs, roofs, sun (cool) platforms of buildings and the construction sites of buildings under construction;

(eleven) other places designated and announced by the people's government of the city or county (city).

In the places listed in the preceding paragraph, the business management unit or the property right unit shall set up warning signs prohibiting the discharge of fireworks and firecrackers, and do a good job in safety tips and prevention.

Ninth in the following time, no unit or individual within the administrative area of this Municipality shall set off fireworks and firecrackers, hold fireworks parties and other large-scale fireworks display activities:

(a) the early warning period of heavy pollution weather above yellow;

(2) during the senior high school entrance examination and college entrance examination;

(three) other no-burning time issued by the people's government of the city or county (city) according to law.

Tenth in addition to the provisions of this Ordinance seventh, eighth, ninth, other areas, places and time to prohibit the discharge of fireworks and firecrackers by the city, county (city) people's government according to the actual situation, and announced to the public.

We should reasonably adjust the scope of prohibiting fireworks and firecrackers.

Eleventh in areas and places where fireworks are prohibited, it is forbidden to produce, operate (store) fireworks.

Article 12 In areas and places where fireworks and firecrackers are prohibited, units and individuals engaged in wedding, funeral and festive services, hotels and other units undertaking weddings and funerals shall not provide services related to fireworks and firecrackers.

Thirteenth in this Ordinance seventh, eighth, ninth provisions of the no-burn zone, place, time, should ensure safety, shall not have the following acts:

(a) throwing at people, vehicles, buildings, etc. ;

(two) from the roof of the building, sun (cool) platform, windows and other places. ;

(3) obstructing the safe passage of pedestrians and vehicles;

(four) other ways to endanger public security and personal and property safety.

Fourteenth in case of major public activities, it is necessary to hold a fireworks show and other large-scale fireworks display activities, the organizer shall apply to the public security organ, and go through the formalities of fireworks display license according to law. Discharge operation units and workers shall conduct discharge operations in accordance with the safety regulations for fireworks and firecrackers and the approved discharge operation plan.

The public security organ shall strengthen the supervision and inspection of large-scale fireworks display activities such as high-risk fireworks parties.

Fifteenth to encourage and advocate the development, research and use of pollution-free and low-noise substitutes for fireworks and firecrackers.

Encourage less or no fireworks and firecrackers outside the areas and places where fireworks and firecrackers are prohibited, and encourage voluntary service activities that prohibit fireworks and firecrackers.

Sixteenth any unit or individual has the right to report the illegal discharge, operation and storage of fireworks and firecrackers to the public security organs and safety supervision departments. If the report is true, the informant may be given appropriate rewards.

Those who take revenge on informants shall be investigated and dealt with by public security organs according to law.

Article 17 Anyone who, in violation of the provisions of Articles 7, 8, 9 and 13 of these Regulations, discharges fireworks and firecrackers in areas, places and times where fireworks and firecrackers are prohibited, or discharges fireworks and firecrackers in a way that endangers public safety and personal and property safety, shall be ordered by the public security organ to stop the discharge, and shall also be imposed a fine of more than 100 yuan and less than 500 yuan; Those who violate the administration of public security shall be punished according to law.

Article 18 Whoever, in violation of the provisions of Article 11 of these regulations, produces and operates fireworks and firecrackers in areas or places where the discharge of fireworks and firecrackers is prohibited, shall be ordered by the safety production supervision and management department to stop the illegal production and operation activities, and be fined not less than 20,000 yuan but not more than 100,000 yuan, and the illegal production and operation of fireworks and firecrackers and illegal income shall be confiscated; If it constitutes a violation of public security administration, it shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 19 The department in charge of fireworks management and its staff who violate the provisions of these regulations, neglect their duties, abuse their powers, engage in malpractices for selfish ends shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Twentieth acts in violation of the provisions of this Ordinance, laws and regulations have stipulated legal responsibility, from its provisions; Where laws and regulations do not stipulate legal responsibilities, such provisions shall prevail.

Twenty-first the names and functions of administrative institutions listed in these Regulations shall be adjusted according to the actual situation after the completion of the reform of administrative institutions in this Municipality.

Twenty-second Tai 'an High-tech Zone, Taishan Scenic Area, Tai 'an Tourism Economic Development Zone (High-speed Railway New District) and other functional areas of fireworks and firecrackers and their supervision and management activities shall be implemented with reference to these regulations.
