Pricing Management Measures

Article 2 These Measures apply to construction projects within the administrative region of Sichuan Province.
The construction projects referred to in these Measures refer to various types of housing construction and municipal infrastructure projects.
House construction projects refer to various types of house buildings and their ancillary facilities and their supporting lines, pipelines, equipment installation projects and indoor and outdoor decoration projects.
Municipal infrastructure projects refer to urban roads, public transportation, water supply, drainage, gas, heat, gardens, sanitation, sewage treatment, garbage disposal, flood control, underground public facilities and Civil engineering, pipeline and equipment installation projects for ancillary facilities.
Article 3 The safe and civilized construction measures fee referred to in these measures refers to the purchase and update of construction safety protective equipment and equipment in accordance with the current national construction safety, construction site environment and health standards and relevant regulations during the construction period. The cost of safe and civilized construction measures for construction projects consists of safety construction fees, civilized construction fees, and temporary facilities fees. Please see Appendix 1 for details.
Article 4 For projects that have special requirements for safety protection and civilized construction and are highly dangerous, if they exceed the standards stipulated in these Measures and require an increase in the cost of safe and civilized construction measures, the tenderer will prepare a bill of quantities. , minimum bid or budget control price, the items should be listed separately and the cost should be calculated. When bidding, the bidder shall make a separate quotation in the measure item according to the requirements of the bidder and the characteristics of the project combined with the bidding construction organization design or construction plan.
Article 5: The safe and civilized construction measures fee is divided into two parts: the basic fee and the on-site evaluation fee. The basic fee is the basic guarantee fee for the safety and civility measures taken by the contractor during the construction process. The on-site evaluation fee refers to the contractor's implementation of relevant safety and civility construction regulations and is obtained through on-site inspection and dynamic evaluation organized by the construction safety supervision and management agency of the construction administrative department. II. On-site evaluation fees
On-site inspection and evaluation work shall be organized and implemented by the construction safety supervision and management agency of the construction administrative department.
The construction safety supervision and management agency formulates on-site evaluation and scoring methods based on the "Construction Safety Inspection Standards" (JGJ59-99).
On-site evaluation implements dynamic management, and the construction safety supervision and management agency conducts inspections and evaluations of safe and civilized construction measures in stages according to the project progress and supervision needs.
The construction safety supervision and management agency determines the final evaluation result based on the inspection and evaluation. The evaluation results are divided into three levels: excellent, qualified, and unqualified.
1. If the evaluation result is excellent, the on-site evaluation fee will be calculated.
The calculation method is: for those with a score of 80 points, the on-site evaluation fee rate is calculated at 40% of the basic fee rate. For every additional 1 point above 80 points, the on-site evaluation fee rate is equal to the basic fee. The rate is increased by 3%, the middle value is calculated using the interpolation method, two digits after the decimal point are retained, and the third digit is rounded off. The formula for calculating the on-site evaluation fee is as follows:
On-site evaluation fee = basic fee × 40% + basic fee × (evaluation score - 80) × 3%.
2. If the evaluation result is qualified, the score will be 70 to 80 points. The fee for safe and civilized construction measures will be calculated as the basic fee, and the on-site evaluation fee will not be charged.
3. If the evaluation result is unqualified, rectification should be carried out, and the rectified evaluation result will be used as the basis for measuring and calculating the safe and civilized construction measures fee. If the evaluation is still unsatisfactory after rectification, the safe and civilized construction measures fee will not be charged.
3. If the construction site ground should be hardened but has not been hardened, the civilized construction fee included in the safe and civilized construction measures fee shall be calculated at 60% of the accrued rate.
4. If the contractor has a quality safety accident of level 4 or above (including level 4) during the construction period, the safety construction fee in the safe and civilized construction measures fee will not be calculated.
5. For projects that have not been evaluated on site, no fees for safe and civilized construction measures will be charged.
Article 6 The fees for safe and civilized construction measures for construction projects are non-competition fees. When preparing budget estimates, budget control prices or base bids, and bid quotations, the full amount should be calculated, that is, the safe and civilized construction measures fee rate is calculated as the basic fee rate plus the maximum on-site evaluation fee rate.

Article 7 When bidding, the bidder does not pay for "civilized construction", "safe construction" and "temporary facilities" according to Article 6 Bidders whose bids are quoted at prescribed rates will be rejected.
Article 8 In order to ensure that safe and civilized construction measures are implemented in place, a rate determination system will be implemented for the three measures of civilized construction, safe construction, and temporary facilities. After the project is completed, the contractor shall take the "Safe and Civilized Construction Measures Evaluation and Rate Determination Form" (Attachment 2) to the project cost management agency where the project is located to apply for determination.
For construction projects owned by counties (districts, cities) that do not have a project cost management agency, the agency for determining the rate of safe and civilized construction measures shall be determined by the county (district, city) construction administrative department and reported to the city , state project cost management agency for filing.
The safe and civilized construction measures fee rate determination agency determines the evaluation rate and determines the safe and civilized construction measure fee rate that the contractor should accrue based on the evaluation results of the safety and civilized measures by the construction safety supervision agency. The measurement work should be completed within 3 working days after receiving the measurement form.
Article 9 Settlement management of safe and civilized construction measures fees:
After the project is completed and accepted, the contractor shall determine the fees based on the "Safe and Civilized Construction Measures Evaluation and Rate Determination Table" Handle completion settlement at a high rate.
Without on-site evaluation or the contractor cannot issue the "Evaluation and Rate Determination Form for Safe and Civilized Construction Measures", the contractor shall not charge fees for safe and civilized construction measures.
Article 10 The developer and the contractor shall specify in the construction contract the total cost of safe and civilized construction measures, as well as the prepayment plan, payment plan, usage requirements, adjustment methods and other terms. If the contract period is less than one year, the contractor's advance payment for safe and civilized construction measures shall not be less than 60% of the basic fee; if the contract period is more than one year (including one year), the advance payment for safe and civilized construction measures shall not be less than 60% of the basic fee. 40%, and the remaining costs shall be paid according to the construction progress and as agreed in the contract.
In the case of general project contracting, if the general contractor subcontracts the project to other units in accordance with the law, the general contractor and the subcontracting unit shall specify in the subcontract that the cost of safe and civilized construction measures shall be unified by the general contractor manage. If safe and civilized construction measures are implemented by a subcontracting unit, the subcontracting unit shall propose a special safe and civilized construction measure plan, which shall be implemented after approval by the general contractor and the general contractor shall pay the required fees.
Article 11 When applying for a project construction license, the construction unit shall submit the payment plan for safe and civilized construction measures agreed in the construction contract to the construction administrative department as specific measures to ensure safe and civilized construction of the project. If it has not been submitted, the construction administrative department shall urge the construction unit to submit it when issuing the construction license.
Article 12 The contractor shall promptly pay the contractor the fees for safe and civilized construction measures in accordance with these regulations and the contract, and urge the contractor to implement safe and civilized construction measures.
If the contractor fails to pay for safe and civilized construction measures in accordance with these regulations and the contract, the construction administrative department at or above the county level shall order him to pay the cost within a time limit in accordance with the provisions of Article 54 of the "Regulations on the Administration of Safety Production of Construction Projects" If corrections are not made within the time limit, the construction project will be ordered to stop construction. Those who cause personal injury or death shall bear corresponding liability for compensation.
Article 13 The project supervision unit shall conduct on-site supervision on the implementation of safe and civilized construction measures by the contractor. If the supervision unit discovers that the contractor has failed to pay for safe and civilized construction measures as stipulated in these Measures or as stipulated in the contract, it shall promptly request the contractor to pay. If it refuses to pay, it shall have the responsibility to report to the construction safety supervision and management agency where the project is located; if it is found that the contractor has failed to implement the measures, If the contractor refuses to make rectifications, the project supervision unit shall promptly report to the contractor and the construction administrative department, and order the suspension of construction in accordance with the law when necessary.
Article 14 The contractor shall ensure that the funds for safe and civilized construction measures are used exclusively for its own purposes.
The contractor's safety production management agency and full-time safety production management personnel are responsible for on-site supervision and inspection of the organization and implementation of safe and civilized construction measures for construction projects, and have the right to report the situation to the construction administrative department.
The general contractor of the project shall be solely responsible for the use of costs for safe and civilized construction measures in the construction project. The general contractor shall promptly pay the subcontracting unit the cost of safe and civilized construction measures in accordance with these regulations and the contract. If the general contractor fails to pay fees in accordance with these regulations and the contract, causing the subcontractor to fail to implement safe and civilized construction measures in a timely manner, resulting in casualties, the general contractor shall be primarily responsible. If economic losses are caused, it shall be liable for compensation.
Article 15 The construction administrative department shall supervise and inspect the implementation of safe and civilized construction measures in accordance with current standards and regulations, and supervise and inspect the payment of the contractor and the use of safe and civilized construction measures by the contractor. .
Article 16 When checking the project completion settlement, the contractor or the project cost consulting company entrusted by it shall rely on the "Safe and Civilized Construction Measures Evaluation and Rates" issued by the safe and civilized construction measures fee rate determination agency. Calculate the fees for safe and civilized construction measures based on the rates determined in the "Measurement Table".
If cost engineers and project cost consulting companies do not calculate the fees for safe and civilized construction measures in accordance with the provisions of these Measures, they shall be calculated according to the "Management Measures for Contracting and Valuation of Construction Projects" (Ministry of Construction Order No. 107) Article 20 shall impose penalties.
Article 17: The project supervision unit fails to review the safety technical measures or special construction plans in the construction organization design; fails to promptly require the contractor to make corrections or temporarily suspends construction when it discovers potential safety accidents; Anyone who refuses to make corrections or stop construction and fails to report to the relevant competent authorities in a timely manner; who fails to supervise in accordance with laws, regulations and mandatory standards for engineering construction shall be punished in accordance with Article 57 of the "Regulations on the Management of Safety Production in Construction Projects".
Article 18 If a staff member of the construction administrative department commits any of the following acts, his/her unit or the superior authority shall impose administrative sanctions in accordance with the provisions of laws and regulations:
(1) Failure to supervise and implement projects for which payment plans for safe and civilized construction measures have not been submitted, resulting in negligence in issuing construction permits;
(2) Other acts of failing to perform supervision and management responsibilities in accordance with the law.
Article 19 Construction safety supervision and management agencies and safe and civilized construction measure fee rate determination agencies shall conscientiously perform their duties and adhere to the principles of fairness, openness and impartiality. They shall not seriously perform their duties, neglect their duties, or abuse their power. , Supervisors who practice favoritism and malpractice will be dealt with in accordance with relevant regulations.
Article 20 These Measures authorize the Provincial Construction Project Cost Management Station to be responsible for interpretation.
Article 21 These Measures will come into effect on August 1, 2006.
