Benxi City Urban Appearance and Environmental Sanitation Management Regulations

Chapter 1 General Provisions Article 1 In order to strengthen the management of urban appearance and environmental sanitation and create a clean, beautiful and civilized urban environment, these regulations are formulated in accordance with relevant laws and regulations and in combination with the actual situation of this city. Article 2 These regulations apply to the built-up areas of this city.

The scope of the built-up area shall be determined and announced by the Municipal People's Government. Article 3: Urban city appearance and environmental sanitation work shall implement the principles of unified leadership and divisional responsibility, and the combination of professional management and socialized management. Article 4 The Urban and Rural Planning and Construction Committee of the Municipal People's Government is the city's administrative department in charge of city appearance and environmental sanitation. Its affiliated city appearance and environmental sanitation management agency is responsible for the daily management of city appearance and environmental sanitation.

The Urban and Rural Development Administration Bureau of the District People's Government is responsible for the city appearance and environmental sanitation work within its administrative region.

The municipal and district urban management comprehensive law enforcement bureaus shall implement supervision and administrative penalties for violations of these regulations in accordance with their respective powers.

Relevant departments such as public security, health, environmental protection, love committees, finance, prices, industry and commerce, transportation, real estate, and commerce shall, in accordance with their respective responsibilities, cooperate with the city appearance and environmental sanitation administrative departments to improve the city appearance and environment Health management work. Article 5 The municipal department in charge of city appearance and environmental sanitation shall organize the preparation of city appearance and environmental sanitation plans and standards based on the city's overall plan and the development needs of city appearance and environmental sanitation undertakings in different periods, and implement them after approval by the Municipal People's Government. Article 6: All units and individuals have the right to good city appearance and environmental sanitation, and at the same time have the obligation to maintain city appearance and environmental sanitation, take care of public facilities, and have the right to dissuade and report violations of these regulations. Article 7 City appearance and environmental sanitation, culture, radio, film and television, press and publication, education, health and other administrative departments as well as operators or management units of stations, shopping malls, squares, tourist attractions and other public places shall strengthen the city appearance and environment Hygienic publicity and public opinion supervision work to enhance citizens’ awareness of maintaining city appearance and environmental sanitation.

Radio, television, newspapers and outdoor advertisements should contain public welfare content on city appearance and environmental sanitation. Chapter 2 City Appearance and Environmental Sanitation Responsible Areas Article 8 Implement the city appearance and environmental sanitation responsibility area system. Relevant units and individuals (hereinafter referred to as responsible persons) shall, in accordance with the provisions of these regulations, do a good job in the city appearance and environmental sanitation work in the responsible area.

The specific scope and specific responsibilities of the city appearance and environmental sanitation responsibility area shall be determined by the municipal administrative department for city appearance and environmental sanitation. Article 9 City appearance and environmental sanitation management agencies shall strengthen the management and supervision of city appearance and environmental sanitation within their responsible areas. Chapter 3 City Appearance Management Section 1 Road Appearance Management Article 10 Urban road surfaces and ancillary facilities shall be regularly maintained or updated by property rights units to keep them intact and tidy. Various public facilities located on and on both sides of urban roads shall comply with urban planning requirements and urban appearance standards.

The underground laying of various wires and pipelines shall be arranged in an overall manner. During the construction of new urban areas, all types of wires and pipelines should be laid underground; in old urban areas, underground laying should be implemented in conjunction with renovation. Article 11 The silt and dirt produced by excavation of urban roads, maintenance of pipelines, and clearing of pipelines and ditches shall be cleaned up in time to keep the road surface clean and tidy, and restore the appearance of the road in a timely manner. Article 12 Whoever is approved to occupy urban roads to open a market shall organize business activities in accordance with the designated area and prescribed time. Article 13 The following behaviors are prohibited on both sides of urban roads:

(1) Building buildings, structures, and arranging commercial booths without authorization;

(2) Setting up sheds on roofs, Setting up racks and stacking debris; hanging items on the exterior walls of buildings that hinder the appearance of the city;

(3) Setting up stalls and stacking items outside the business premises;

(4) Open-air maintenance Business activities such as processing and cleaning vehicles;

(5) Occupying urban roads without authorization to open markets. Section 2 Building Appearance Management Article 14 The owners, users or managers of buildings, structures and facilities on both sides of major roads and within landscape areas shall manage the appearance of buildings, structures and other facilities in accordance with urban appearance standards. The exterior should be cleaned or painted regularly, and buildings, structures and other facilities that are damaged, dangerous or affect the city's appearance and environment should be promptly renovated or dismantled. Article 15: Buildings on both sides of main roads shall not set up physical walls. Transparent or semi-transparent walls, fences or hedges, flower beds (pools), lawns, etc. shall be used as boundaries in accordance with planning requirements. The environment inside and outside the perspective boundary should be kept clean and beautiful.

Article 16: Outdoor decoration of buildings on both sides of main roads and landscape areas must comply with this city’s urban appearance standards. Article 17 Demolition and new construction sites must follow regulations: set up fences and signs; neatly stack materials and machinery; clear and transport muck in a timely manner; tidy up the shutdown site in a timely manner and provide necessary coverage; level the construction site in a timely manner after completion, Remove construction waste, engineering debris and other waste, and dismantle temporary construction facilities. Section 3 Management of Outdoor Advertising Settings Article 18 The setting up of outdoor advertising facilities must comply with various safety technical specifications, and must not hinder the use of road traffic and municipal public facilities, or hinder the appearance of the city. Article 19 To set up large-scale outdoor advertisements, you must apply to the administrative department for city appearance and environmental sanitation and submit relevant documents. Only after approval can you go through the approval procedures in accordance with relevant regulations.

Large-scale outdoor advertisements shall be set up within the prescribed period in accordance with the approved location, specifications, styles, materials, and layout.

Within 10 days after the expiration of the installation period, the installation unit shall dismantle it by itself. If it is necessary to postpone the establishment, the approval procedures shall be re-processed in accordance with relevant regulations and procedures.
