Measures of Beijing Municipality on Implementing the Regulations on the Administration of Entertainment Places

Article 1 These Measures are formulated in accordance with the Regulations of the State Council Municipality on the Administration of Entertainment Places (hereinafter referred to as the Regulations) and combined with the actual situation of this Municipality. Article 2 Commercial song and dance entertainment places established within the administrative area of this Municipality for consumers to entertain themselves (hereinafter referred to as entertainment places) must abide by the Regulations and these Measures. Article 3 This Municipality implements the policy of scale control and rational layout for the development of entertainment places.

This Municipality advocates healthy and popular cultural and recreational activities, encourages and cultivates cultural and recreational activities with national style and spirit of the times, cultivates and develops the rural cultural and recreational market, restricts entertainment items that are not suitable for development, and cracks down on illegal and criminal acts in entertainment places according to law. Article 4 The departments for cultural administration, public security organs and administrative departments for industry and commerce shall, according to their respective functions and duties, manage entertainment places according to law. Article 5 No entertainment places may be established in the following areas:

(1) East and West Chang 'an Avenue and its extension line (Jianguomen to Fuxingmen).

(two) the central party, government and army and other major organs within 200 meters.

(3) within 200 meters of universities, middle schools and primary schools.

(four) residential buildings (including commercial and residential buildings).

(five) other areas stipulated by the municipal government that are not suitable for the establishment of entertainment venues. Article 6 No electronic entertainment places may be established in the following places:

(1) Libraries, museums, memorial halls and science and technology museums.

(2) Youth Palace, Youth Science and Technology Activity Center and Children's Activity Center.

(3) Mass art museums, cultural centers and cultural stations. Article 7 Where an applicant applies for the establishment of a song, dance, entertainment place or electronic entertainment place within 200 meters of other organs such as the Party, government and army at or above the municipal level and hospitals at or above the county level beyond the scope specified in Item (2) of Article 5 of these Measures, the applicant shall announce his intention to establish an entertainment place three times in a row in a newspaper designated by the administrative department for culture, and if the organs and hospitals within the above scope do not raise any objection, the administrative department for culture shall accept it within 30 days from the date of the first announcement. Article 8 To establish an entertainment place, its business area must meet the following requirements:

(a) the business area of song and dance entertainment places is more than 200 square meters.

(two) billiard hall business area of 65438 000 square meters, table spacing of not less than 65438 0.5 meters.

(three) the business area of the electronic entertainment hall is more than 200 square meters. Article 9 The establishment of entertainment places must meet the following requirements in addition to the conditions stipulated in the Regulations:

(a) the legal representative or person in charge should have a technical secondary school education or above.

(two) the lighting and acoustics in the place must meet the technical standards promulgated by the Ministry of Culture, and the operators must hold the qualification certificates issued by the administrative department of culture.

(three) the facilities and equipment of entertainment places shall comply with the "Regulations on Fire Safety Management in Public Entertainment Places", and shall be equipped with safety technical prevention facilities and equipment as required. Article 10 To apply for the establishment of an entertainment place, the following materials shall be submitted to the administrative department of culture:

(1) A written application.

(2) Notice of Pre-approval of Enterprise Name issued by the administrative department for industry and commerce.

(three) the identity, resume and academic certificate of the legal representative or person in charge to be appointed.

(4) Organizational structure, articles of association and rules and regulations.

(5) Proof of ownership or right to use the business premises.

(six) the name, model and quantity of equipment used in song and dance entertainment places and the source and quantity of audio and video products.

(seven) the qualification certificate of lighting and sound detection in song and dance entertainment places.

(eight) site location map and layout. Eleventh to apply for the establishment of entertainment venues, the following materials shall be submitted to the public security organs:

(a) the site construction safety certificate and site plan.

(2) fire control inspection certificate.

(three) the certificate of safe use of large facilities and equipment in the place (referring to large special equipment in discotheques and halls).

(four) the proposed legal representative or person in charge issued by the public security organ where the household registration is located has no certificate of the circumstances listed in Article 10 of the Regulations.

(five) the audit certificate issued by the administrative department of culture.

(6) Workplace safety system. Article 12 The following business units are not subject to the restrictions in Articles 5, 7 and 8 of these Measures:

(1) star hotels and restaurants.

(two) a large shopping mall or office building with a business area of more than 5000 square meters, and a comprehensive entertainment service place integrating song and dance, electronic entertainment, billiards and other entertainment projects. Thirteenth to apply for the establishment of entertainment venues, the applicant must hold the materials specified in Articles 10 and 11 of these Measures, and go through the examination and approval procedures at the district and county cultural administrative departments and public security organs. The administrative department of culture and the public security organ shall conduct an examination within 30 days from the date of receiving the application; Give a written reply to the unqualified conditions. The applicant may apply to the administrative department for industry and commerce for registration and obtain a business license only after passing the examination by the administrative department for culture and the public security organ.

Where an entertainment place is established in the business unit specified in Article 12 of these Measures, a business license shall be applied separately. Fourteenth entertainment business units shall submit the following materials to the public security organ within 30 days after receiving the business license:

(a) the registration form of employees and the information of security personnel issued by the security company.

(2) A copy of the fire and public liability insurance policy of the business premises.
