Measures for the administration of directional donation funds

Chapter I General Provisions

Article 1 In order to regulate the acceptance, distribution and use of directional special donation funds of Red Cross Societies at all levels in our city, these measures are formulated according to the Law of the People's Republic of China on Red Cross Societies and the Administrative Measures on Donation and Acceptance of China Red Cross Societies, combined with the actual situation in our city.

Article 2 The term "directional special donation funds" as mentioned in these Measures refers to the project funds that are received by the Red Cross Societies at all levels in our city, donated voluntarily by units and individuals, have specific purposes or designated objects, and are used for disaster relief, rescue, social welfare undertakings, humanitarian communication and so on in line with the purpose of the Red Cross Society.

Article 3 The directional special donation funds accepted by the Red Cross Societies at all levels shall be based on the principle of respecting the wishes of the donors and must be used for the relief work in line with the purpose of the Red Cross Society.

Chapter II Management

Article 4 When accepting targeted special donation funds, the donor must issue a donation letter indicating his willingness to donate. When necessary, a donation agreement can be signed, stipulating the amount and use of donated funds, the way and time limit for the implementation of the agreement. The donation letter and donation agreement shall comply with the provisions of laws and regulations.

Article 5 Red Cross Societies at all levels may accept targeted special donation funds voluntarily donated by enterprises, organizations and individuals inside and outside their respective jurisdictions, and shall not attach improper conditions. Donated funds for projects that cannot be supervised can be politely declined.

Sixth Red Cross Societies at all levels must issue legal and effective public welfare donation bills to donors when receiving targeted special donation funds from all walks of life.

Donors enjoy corresponding preferential tax policies according to national laws and regulations. At the same time, give donors corresponding honor and recognition.

Chapter III Use

Article 7 The use of targeted special donation funds shall respect the wishes of the donors and conform to the purpose of the Red Cross Society, and the donation will shall not be changed without authorization. If it is really necessary to change the use, the written consent of the donor shall be obtained.

Eighth directional special donation funds are mainly used for the following aspects:

(1) Natural disasters and post-disaster reconstruction in the whole city;

(2) Red Cross humanitarian assistance;

(3) Red Cross fraternity assistance;

(4) The Red Cross Society for Caring for Doctors;

(5) The Red Cross helps and cares for life;

(six) other relief work in line with the purpose of the Red Cross.

Article 9 After the targeted relief work is completed, with the written consent of the donor, the remaining targeted special donation funds can be transferred to other humanitarian relief work of the Red Cross or the Red Cross charity project fund.

Article 10 According to the Administrative Measures of China Red Cross on Donation and Acceptance of Donations, the actual cost (project implementation cost) generated by the humanitarian relief work of targeted special donations can be truthfully charged from the targeted special donation funds and made public, but it should be made clear to the donors before accepting the donation, and the amount and scope of use should be strictly limited, which should not exceed 6% of the total donation. Donors have clear requirements on the actual costs (project implementation costs) generated by humanitarian relief work, which shall be handled according to the agreement of both parties on the premise of rationality and legality.

Article 11 The actual cost of humanitarian relief (project implementation cost) refers to the necessary expenses in the process of project management and implementation, including the salary of project staff or volunteer subsidies, office supplies and equipment expenses, information expenses, communication expenses, travel expenses, transportation expenses, publicity expenses and other necessary expenses, but it shall not be used for the expenses of staff and institutions.

Twelfth the use of targeted special donation funds to purchase materials, projects and services, should follow the relevant laws and regulations of the state, in strict accordance with the "Government Procurement Law".

Thirteenth directional special donation funds to establish and improve the information feedback system, timely feedback to donors on the use of donated funds.

Chapter IV Supervision
