Regulations on safety management of large-scale mass activities

Chapter I General Principles

Article 1 These Regulations are formulated in order to strengthen the safety management of large-scale mass activities, protect citizens' lives and property, and maintain public order and public safety.

Article 2 The term "large-scale mass activities" as mentioned in these Regulations refers to the following activities organized by legal persons or other organizations for the public, with an estimated number of participants of more than 65,438 each time:

(1) Sports competitions;

(2) Concerts, concerts and other cultural performances;

(three) exhibitions, exhibitions and other activities;

(four) garden, lantern festival, temple fair, flower show, fireworks and other activities;

(five) job fairs, lottery sales and other activities.

The provisions of this Ordinance shall not apply to the activities held by theaters, concert halls, parks and entertainment venues within their daily business scope.

Article 3 The safety management of large-scale mass activities shall follow the principles of safety first and prevention first, and adhere to the principle that the undertaker is responsible and the government supervises.

Article 4 The public security organs of the people's governments at or above the county level shall be responsible for the safety management of large-scale mass activities.

Other relevant competent departments of the people's governments at or above the county level shall be responsible for the safety of large-scale mass activities in accordance with their respective duties.

Chapter II Safety Responsibility

Article 5 The undertaker of large-scale mass activities (hereinafter referred to as the undertaker) is responsible for the safety of the activities it undertakes, and the main person in charge of the undertaker is the person in charge of the safety of large-scale mass activities.

Article 6 When holding large-scale mass activities, the undertaker shall formulate a safety work plan for large-scale mass activities.

The safety work plan for large-scale mass activities includes the following contents:

(a) The time, place, content and organization of the activity;

(two) the number of security personnel, task assignment and identification marks;

(three) fire safety measures in the activity place;

(four) the number of people that can be accommodated in the activity place and the number of people who are expected to participate in the activity;

(five) the establishment and identification of public security buffer zone;

(six) ticket inspection and safety inspection measures for admission personnel;

(seven) vehicle parking and diversion measures;

(eight) on-site order maintenance and personnel guidance measures;

(9) Emergency rescue plan.

Article 7 The undertaker shall be specifically responsible for the following safety matters:

(a) to implement the safety work plan and safety responsibility system for large-scale mass activities, clarify the safety measures and responsibilities of security personnel, and carry out safety publicity and education for large-scale mass activities;

(two) to ensure the safety of temporary facilities and buildings, eliminate potential safety hazards;

(3) According to the requirements of the public security organ in charge of licensing, it is equipped with necessary safety inspection equipment to conduct safety inspection on personnel participating in large-scale mass activities. If the organizer refuses to accept the safety inspection, he has the right to refuse his entry;

(4) distributing or selling tickets according to the number of people accommodated in the approved venues and designated areas;

(five) the implementation of medical rescue, fire fighting, emergency evacuation and other emergency rescue measures and organize drills;

(six) to stop acts that hinder the safety of large-scale mass activities in a timely manner and report illegal and criminal acts to the public security organs in a timely manner;

(seven) equipped with professional security personnel and other security personnel to meet the needs of large-scale mass activities;

(eight) to provide the necessary guarantee for the safety of large-scale mass activities.

Article 8 The site manager of large-scale mass activities shall be specifically responsible for the following safety matters:

(a) to ensure that the site and facilities meet the national safety standards and safety regulations;

(two) to ensure that evacuation routes, exits, fire engines, emergency broadcasting, emergency lighting and evacuation signs comply with the provisions of laws, regulations and technical standards;

(three) to ensure that the monitoring equipment and fire control facilities and equipment are fully equipped, intact and effective;

(4) Providing necessary parking spaces and maintaining safety and order.

Article 9 Persons participating in large-scale mass activities shall abide by the following provisions:

(a) abide by laws, regulations and social ethics, and shall not interfere with social security or affect social order;

(2) Abide by the public security and fire control management system for large-scale mass activities, accept safety inspection, and shall not carry explosive, flammable, radioactive, toxic or corrosive dangerous goods or illegally carry guns, ammunition and control devices;

(three) obey the safety management, not to display insulting slogans, banners and other items, not to besiege referees, athletes or other staff, not to throw debris.

Article 10 A public security organ shall perform the following duties:

(a) review the application materials submitted by the organizer for large-scale mass activities, and implement the safety license;

(two) to formulate safety supervision plans and emergency plans for large-scale mass activities;

(three) to guide the education and training of security personnel;

(four) before the large-scale mass activities are held, organize the safety inspection of the activity places, and order them to make corrections in time when potential safety hazards are found;

(five) in the process of holding large-scale mass activities, supervise and inspect the implementation of safety work, and promptly order corrections when discovering potential safety hazards;

(six) to investigate and deal with illegal and criminal acts in large-scale mass activities according to law, and to deal with emergencies that endanger public safety.

Chapter III Safety Management

Eleventh public security organs to implement a safety licensing system for large-scale mass activities. If there are other provisions on the safety management of performance activities in the Regulations on the Administration of Commercial Performances, those provisions shall prevail.

Holding large-scale mass activities shall meet the following conditions:

(a) the undertaker is a legal person or other organization established in accordance with legal procedures;

(two) the contents of large-scale mass activities shall not violate the provisions of the Constitution, laws and regulations, and shall not violate social morality;

(three) there is a safety work plan in accordance with the provisions of these regulations, with clear safety responsibilities and effective measures;

(4) The activity places and facilities meet the safety requirements.

Twelfth large-scale mass activities are expected to participate in more than 1000 people but less than 5000 people, the public security organs of the people's governments at the county level where the activities are located shall implement the safety license; If the number of participants is expected to be more than 5,000, the public security organ of the Municipal People's Government or the public security organ of the people's government of the municipality directly under the Central Government shall implement the safety license; If large-scale mass activities are held across provinces, autonomous regions and municipalities directly under the Central Government, the public security department of the State Council shall carry out safety licensing.

Thirteenth contractors should apply for safety license 20 days before the event is held. When applying, the following materials shall be submitted:

(a) the legal establishment certificate of the contractor and the identity certificate of the person in charge of safety;

(two) large-scale mass activities and its explanation. If two or more organizers jointly undertake large-scale mass activities, they shall also submit a joint undertaking agreement;

(three) the safety work plan for large-scale mass activities;

(4) The venue manager agrees to provide the venue certificate.

In accordance with the provisions of laws and administrative regulations, if the relevant competent authorities have qualifications and qualification requirements for the organizers of large-scale mass activities, they shall also submit relevant qualifications and qualification certificates.

Fourteenth public security organs shall make a decision on whether to accept the application materials according to law. The accepted application shall be reviewed within 7 days from the date of acceptance, and the site shall be inspected. If it meets the safety conditions, it shall make a licensing decision; For those who do not meet the safety conditions, make a decision not to grant permission, and explain the reasons in writing.

Fifteenth for large-scale mass activities with safety permission, the organizer shall not arbitrarily change the time, place and content of the activities or expand the scale of large-scale mass activities.

Where the undertaker changes the time of large-scale mass activities, he shall apply to the public security organ that made the permission decision before the scheduled time of the activities, and the change can only be made after the consent of the public security organ.

Where the undertaker changes the location and content of large-scale mass activities and expands the scale of large-scale mass activities, he shall re-apply for a safety license in accordance with the provisions of these regulations.

If the organizer cancels the holding of large-scale mass activities, it shall inform the public security organ that made the decision on safety permission in writing before the scheduled time of the activities, and return the safety license issued by the public security organ to allow the holding of large-scale mass activities.

Article 16 For large-scale mass activities with safety permission, the public security organ shall organize corresponding police forces according to safety needs, maintain public security and traffic order around the activity site, prevent and handle public security emergencies, and investigate and deal with illegal and criminal activities.

Seventeenth staff members of public security organs who perform safety management tasks at the scene of large-scale mass activities shall enter the scene of large-scale mass activities with their work certificates and perform safety management duties according to law.

Public security organs and other relevant competent departments and their staff shall not ask the undertaker for tickets.

Eighteenth contractors found that the number of people entering the venue reached the approved number, should immediately stop checking; Anyone who finds tickets or fake tickets outside the designated area will be refused admission and report to the staff of the public security organ at the event site.

Nineteenth in the process of holding large-scale mass activities, public security accidents and public security cases, the person in charge of security shall immediately start the emergency rescue plan, and immediately report to the public security organs.

Chapter IV Legal Liability

Twentieth contractors arbitrarily change the time, place and content of large-scale mass activities or expand the scale of large-scale mass activities, and the public security organs shall impose a fine of 1 10,000 yuan but not more than 50,000 yuan; If there are illegal gains, the illegal gains shall be confiscated.

Large-scale mass activities without the security permission of the public security organs shall be banned by the public security organs, and the undertaker shall be fined between 654.38 million yuan and 300,000 yuan.

Twenty-first large-scale mass activities in violation of the provisions of these regulations, causing heavy casualties, public security cases or other serious consequences constitute a crime, criminal responsibility shall be investigated according to law; If it does not constitute a crime, the person in charge of safety and other directly responsible personnel shall be punished according to law, and the unit shall be fined from 6,543,800 yuan to 50,000 yuan.

Article 22 If a public security accident occurs during a large-scale mass activity, and the person in charge of safety fails to immediately start the emergency rescue plan or report to the public security organ, the public security organ shall impose a fine of not less than 5,000 yuan but not more than 50,000 yuan on the person in charge of safety and other directly responsible personnel.

Twenty-third people who participate in large-scale mass activities in violation of the provisions of article ninth of these regulations shall be criticized and educated by the public security organs; If there is an act that endangers public order and threatens public safety, the public security organ may forcibly take it away from the scene and impose administrative penalties on public security according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 24 If the staff of the relevant competent department and the directly responsible person in charge abuse their powers, neglect their duties or engage in malpractices for selfish ends when performing the safety management duties of large-scale mass activities, they shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
