Regulations of Jilin Province on Forest Fire Prevention

Chapter I General Provisions Article 1 In order to effectively prevent and put out forest fires, protect forest resources, maintain ecological balance and promote the development of forestry economy, these Regulations are formulated in accordance with the Forest Law of People's Republic of China (PRC) and relevant laws and regulations, combined with the actual situation of our province. Article 2 These Regulations shall apply to the fire prevention and fighting of forests, trees and woodlands in our province. Except for trees in urban street greening and garden green space. Article 3 The principle of "prevention first, active elimination" shall be followed in forest fire prevention.

People's governments at all levels shall support scientific research on forest fire prevention, popularize and apply advanced science and technology, and improve scientific fire prevention and extinguishing capabilities. Article 4 People's governments at all levels must regard forest fire prevention as an important task, and implement unified leadership and comprehensive prevention and control. All organs, organizations, enterprises and institutions should do a good job in forest fire prevention under the unified leadership of the local government. Fifth forest fire prevention work to implement the administrative leadership responsibility system of the people's governments at all levels and the leadership responsibility system of departments and units under the leadership of the local people's government.

The administrative leaders of the people's governments at all levels and the directors of the villagers' committees shall sign a letter of responsibility for forest fire prevention with their superiors every year to clarify the responsibility for forest fire prevention.

All departments and units in forest areas shall, under the unified leadership of the local people's government, establish a responsibility system for forest fire prevention. Article 6 People's governments at all levels and their forestry administrative departments shall strengthen the leadership and construction of armed forest police forces, forestry public security forces and aviation forest protection stations, and improve the specialization and modernization level of forest fire prevention. Seventh people's governments at all levels of forestry administrative departments, state-owned forest management units and collective and individual forest farms, forest owners and operators should improve forest fire prevention facilities and equipment, and enhance the ability to prevent and put out forest fires.

The people's governments at or above the county level shall appropriately arrange certain funds for forest fire prevention every year.

State-owned Forestry Bureau, Forest Management Bureau and State-owned Forest Farm should arrange no less than 3% of forest fire prevention funds in the afforestation fund every year.

Collective forest farms should arrange not less than 2% of forest fire prevention funds in the collective forest income every year. Article 8 It is the duty of citizens to prevent and put out forest fires. Every citizen should participate in all kinds of forest fire prevention activities organized by the local people's government, assume the responsibility of forest fire prevention and ensure the safety of forest resources. Ninth units and individuals that have made remarkable achievements in forest fire prevention work shall be commended and rewarded once a year by the county (city, district) people's government; City (state) people's government awards once every two years; The provincial people's government awards once every three years. Chapter II Forest Fire Prevention Organizations Article 10 The forest fire prevention headquarters established by people's governments at all levels are the forest fire prevention headquarters of the people's governments at the same level, and are responsible for forest fire prevention work in their respective administrative areas. The forest fire prevention headquarters is composed of the leaders of the people's government at the same level, the leaders of relevant departments and the leaders of the local garrison. The forest fire prevention headquarters at all levels shall have a chief commander and a deputy chief commander.

The office of forest fire prevention headquarters at or above the county level is located in the forestry administrative department at the same level, responsible for the daily forest fire prevention work, and its full-time cadres are included in the forestry public security management.

The daily work of the township (town) forest fire prevention headquarters shall be undertaken by the township (town) forestry workstation. Eleventh forest fire prevention headquarters at all levels should strengthen the construction of forest fire prevention transportation and communication facilities and establish communication networks. Special vehicles for forest fire prevention with fixed devices shall be managed as special vehicles and exempted from road maintenance fees. Article 12 The forest fire prevention headquarters set up by the State-owned Forestry Bureau, the Forest Management Bureau and the Changbai Mountain National Nature Reserve Administration shall, under the unified leadership of the local people's government, be specifically responsible for the forest fire prevention work in their own systems, units and camps.

State-owned forest farms, collective forest farms and other state-owned and collective enterprises and institutions in forest areas shall set up forest fire prevention committees to be responsible for forest fire prevention in their own camps and areas of responsibility.

Villagers' committees in forest areas shall set up a leading group for forest fire prevention, which shall be responsible for the forest fire prevention work in their respective administrative areas, and shall be responsible for organizing prevention and treatment by groups. Article 13 The people's government at the next higher level shall determine the joint defense units, coordinate the establishment of joint defense organizations, delimit joint defense areas, establish joint defense systems, and clarify responsibilities and tasks in the forest areas at the junction of administrative regions of cities (states), counties (cities, districts) and townships (towns) and at the junction of State-owned Forestry Bureau, Forest Management Bureau and Changbai Mountain National Nature Reserve.

Inter-provincial forest fire prevention and joint defense work shall be carried out in accordance with relevant state regulations or mutual agreement. Fourteenth key forest counties (cities, districts) forestry administrative departments, state-owned forestry bureaus, forest management bureaus, Changbai Mountain National Nature Reserve Management Bureau, and state-owned forest farms should establish professional firefighting teams, and firefighting team members should be selected from existing forestry workers.

Other organs, enterprises and institutions in forest areas, villagers' committees and forest units in non-forest areas shall establish mass forest fire brigades. Fifteenth forestry administrative departments of forest counties (cities, districts) and state-owned forestry bureau, forest management bureau, Changbai Mountain National Nature Reserve Administration, with the approval of the people's governments at or above the county level, can set up forest fire prevention checkpoints in forest areas.

Inspectors of forest fire prevention checkpoints have the right to conduct fire prevention inspections on vehicles and personnel entering the mountains in accordance with the provisions of these regulations, to detain fires that are not allowed to be pushed, and to stop undocumented personnel from entering the mountains. No one may refuse the inspection.

When performing their duties, forest fire prevention inspectors must show their certificates, wear obvious signs and enforce the law in a civilized manner.
