Regulations of Beijing Municipality on the Administration of Non-motor Vehicles

Chapter I General Provisions Article 1 In order to strengthen the management of non-motor vehicles, ensure the orderly and safe road traffic, and safeguard the legitimate rights and interests of citizens, legal persons and unincorporated organizations, these Regulations are formulated in accordance with the Road Traffic Safety Law of the People's Republic of China, the Product Quality Law of People's Republic of China (PRC), the Implementation Regulations of the Road Traffic Safety Law of the People's Republic of China and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the production, sale, registration, passage, lease, parking and related management activities of non-motor vehicles within the administrative area of this Municipality. Article 3 The municipal and district people's governments shall strengthen their leadership over the management of non-motor vehicles within their respective administrative areas; Optimize the mode of transportation and advocate citizens' green travel; Implement the planning and construction of non-motor vehicle roads, parking and other infrastructure; Guide and standardize enterprises to carry out internet bicycle rental services and implement total regulation; Do not develop electric bicycle rental; Supervise and coordinate the relevant administrative departments to perform their duties.

Township people's governments and sub-district offices shall co-ordinate the management of non-motor vehicles within their respective jurisdictions; Organize, manage, comprehensively coordinate, supervise and inspect the agencies of the functional departments of the district government, delimit non-motor vehicle parking spaces according to the standards, standardize the parking order of non-motor vehicles, and clean up waste non-motor vehicles and other matters; We can rely on the mechanisms of residents' (village) autonomy, grid management, and three guarantees in front of the door to carry out our work by purchasing services from the society, encouraging volunteer services, coordinating multi-agent consultations, and interviewing illegal enterprises.

The traffic management, industrial and commercial administration, traffic administration, quality and technical supervision, environmental protection, urban management comprehensive administrative law enforcement and other relevant departments of the public security organ are responsible for the management of non-motor vehicles within their respective functions and duties. Article 4 Non-motor vehicle related trade associations in this Municipality shall strengthen self-discipline management, organize members to formulate and abide by self-discipline conventions, guide, coordinate and supervise member units and their employees to engage in sales and business activities according to law, and maintain fair market order; Investigate the basic situation of the industry; Participate in the formulation of vehicle and service standards and vehicle catalogue; Reflect opinions and suggestions on behalf of the industry. Article 5 State organs, enterprises, institutions and social organizations within the administrative area of this Municipality shall strengthen publicity and education on the laws and regulations on road traffic safety of non-motor vehicles and the common sense of traffic safety of their own personnel.

Television stations, radio stations, Internet information service providers and other media should strengthen the publicity of non-motor vehicle road traffic safety laws and regulations and traffic safety common sense. Chapter II Production and Sales Article 6 Non-motor vehicles produced and sold in this Municipality shall meet the national standards. Article 7 This Municipality implements the catalogue system of electric bicycle products that meet the national standards. The product catalogue shall specify the production enterprise, brand, model, technical parameters and other items, and be updated and announced to the public in a timely manner.

The municipal administrative department for industry and commerce shall, jointly with the municipal quality supervision and management, traffic management of the municipal public security organs, environmental protection and other departments, compile the product catalogue according to the national standards, or entrust the non-motor vehicle industry association to organize the compilation. The municipal administrative department for industry and commerce shall timely incorporate electric bicycles that meet the national standards into the product catalogue. Electric bicycles not listed in the product catalogue shall not be sold and registered in this city. Article 8 A seller of electric bicycles shall publicize the product catalogue and register the laws and regulations in a prominent position in the sales place. The electric bicycles sold shall be consistent with the product catalogue; If it does not meet the requirements, the consumer may, in accordance with the provisions of the state and the agreement of the parties, require the seller to return or replace it. Article 9 An e-commerce platform operator shall verify and register the identity of the sales operator who applies to enter the platform to sell non-motor vehicles in accordance with the provisions of laws and regulations such as consumer rights protection and e-commerce, and clarify the rights and obligations of the seller in terms of platform access and exit, quality and safety guarantee of goods and services, and protection of consumer rights and interests.

If the operators of e-commerce platforms find that the non-motor vehicles sold in the platforms violate relevant laws and regulations, they shall take necessary measures according to law and report to the relevant competent authorities.

If the administrative department for industry and commerce finds that the platform violates relevant laws and regulations, it shall require the platform operator to take immediate measures to stop it, and the platform operator shall cooperate. Chapter III Registration Article 10 Electric bicycles can only run on the roads in this city after they have obtained the driving license and number plate of this city. Article 11 Anyone who applies for registration of an electric bicycle shall apply to the traffic administrative department of the public security organ for registration within 15 days from the date of purchase, submit the vehicle for inspection and submit the following materials:

(1) An application form for registration;

(2) the identity certificate of the owner;

(3) proof of car purchase;

(four) vehicle factory certificate. Twelfth applications for registration of electric bicycles, the traffic administrative department of the public security organ shall inspect the vehicle. In the product catalogue and the application materials are complete and effective, the traffic administrative department of the public security organ shall register on the spot and issue the driving license and license plate of electric bicycle free of charge; Do not meet the requirements, shall not be registered, and inform the applicant in writing.

The driving license and number plate of electric bicycle shall be uniformly supervised by the traffic administrative department of the public security organ.

If the driving license and number plate of the electric bicycle are damaged or lost, the parties concerned shall apply to the traffic administrative department of the public security organ for replacement or replacement.

The traffic administrative department of the municipal public security organ shall provide convenience for citizens to register electric bicycles by adding registration points, simplifying procedures and gradually implementing licensed sales.

The traffic administrative department of the municipal public security organ shall formulate specific measures for the registration of electric bicycles and announce them to the public.
