Article 1 In order to protect the safety and health of employees in railway transportation, infrastructure and industrial production, prevent the occurrence of major employee casualties, vigorously reduce the number of employee casualties, and ensure safe and civilized production, These measures are specially formulated to complete or exceed transportation production tasks, improve economic efficiency, use economic methods to manage and promote safe production of employees. Article 2 These Measures apply to all railway bureaus, engineering companies, survey and design companies, subordinate factories, and communication and signal companies.

The above-mentioned units must conscientiously implement the party and the country's work safety guidelines, policies and regulations, so as to ensure sound production safety rules and regulations and complete management; they must adhere to safety first, focus on prevention, and eliminate hidden dangers of accidents. Actively improve working conditions; prevent employee casualties and reduce the number of employee casualties.

Those who have made outstanding achievements in safety production shall be praised and rewarded in accordance with the provisions of these regulations. It will be implemented for units that do not care about the labor safety and health of employees and do not pay attention to safe production; the enterprise management is chaotic and the safety rules and regulations are not perfect; the labor discipline of employees is lax and the hidden dangers of accidents exist; the orders and operations are in violation of regulations, resulting in the occurrence of accidents involving employee casualties. Financial fines. Those responsible for the accident and leaders related to the accident must be given administrative penalties in accordance with regulations. If the circumstances are serious and criminal laws are violated, criminal liability must be pursued in accordance with the law.

To implement the reward and punishment system for employee safety production, we must implement and strengthen the legal system to ensure strict rewards and punishments. Focus on spiritual encouragement, supplemented by material rewards, and combine ideological and political work, economic rewards and punishments with administrative penalties. Article 3 All railway bureaus, engineering companies, surveying and design companies, subordinate factories, and communication and signal companies that have achieved remarkable results in production safety and have met the following conditions shall be reported to the Ministry in writing by each unit, and the Ministry shall make an assessment. Give recognition and rewards. The principle of bonus distribution for each award-winning unit should be to reward units and individual employees who have made contributions to safety production, and should not be distributed equally.

1. Railway bureaus with less than 100,000 people (excluding 100,000 people) have eliminated employee fatalities for four consecutive months; railway bureaus with more than 100,000 people have eliminated employee fatalities for three consecutive months. Fatal accidents; if a railway bureau with more than 200,000 people eliminates fatal accidents among its employees for two consecutive months, the Ministry of Railways will give individual commendations and a bonus of one yuan per person based on the total number of employees.

2. If the engineering company eliminates employee fatal accidents for six consecutive months, the Ministry of Railways will give a commendation and a bonus of one yuan per person based on the total number of employees in the company.

3. Affiliated factories, communication and signal companies, and survey and design companies, if there are no employee deaths or serious injuries throughout the year; and the injury rate per 1,000 people in minor injury accidents, the subordinate factories and communication and signal companies will be 10% or 1,000 respectively. If the number of surveying and design companies is less than one thousandth, the Ministry of Railways will give a notification and commendation, and issue an average bonus of one yuan per person based on the total number of employees in each unit. Article 4: When any accident involving employee casualties occurs in any railway bureau, engineering company, surveying and design company, subordinate factory or communication and signal company, a financial fine shall be imposed on the unit responsible for the accident in accordance with the following provisions.

1. Financial fines for accident units

1. Units that have an accident in which more than five people are injured will be fined 5,000 yuan to 10,000 yuan.

2. Units that have an accident in which more than three people are seriously injured or an accident in which one or two people are killed will be fined between RMB 10,000 and RMB 30,000.

3. Units that have a major casualty accident involving three or more people will be fined an economic fine of RMB 50,000 to RMB 100,000.

Article 5 The payment of incentive fees and the collection of fines for employee casualties shall be handled separately in accordance with the orders of the Ministry of Railways and the notice of fines for employee casualties issued by the Ministry of Labor and Personnel Bureau on behalf of the Ministry.

The Ministry of Finance Bureau is responsible for allocating and collecting incentives on time for railway bureaus, communication and signal companies, and Zhengzhou Loading and Unloading Machinery Factory, as well as economic fines for the above-mentioned accident units. Accident fines can be settled and collected every six months (affiliated factories and communication and signal companies are settled annually).

2. The Ministry of Finance, the General Administration of Infrastructure, and the Engineering Command are responsible for disbursing and collecting the incentive fees for engineering companies and survey and design companies and the accident economic fines for the above-mentioned companies respectively.

3． The incentive fees for the factories affiliated to the Ministry and the economic fines for the above-mentioned accident units shall be allocated and collected on time by the Ministry of Industry, the General Administration of Infrastructure, the Works Bureau, the Materials Management Bureau and other units according to their affiliations. Article 6 Employees' safety production reward fees shall be paid under the employee reward fund. Fine expenses related to employee casualties shall be paid from the enterprise's own funds (such as enterprise funds, profit retention, profit and loss share, employee reward fund, etc.) Expenditures shall be incorporated into relevant accounts by the collecting units to be used for safety rewards, labor protection education and improvement of working conditions. Article 7 Units that are fined due to employee casualties must promptly turn over the fines within the specified time and may not refuse to pay or allocate production costs.
