Regulations of Tongchuan Municipality on the Administration of Fireworks and Firecrackers

Article 1 In order to strengthen the management of fireworks and firecrackers, reduce environmental pollution, and ensure the safety of the public, people and property, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Safety Management of Fireworks and Firecrackers and relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the discharge and management of fireworks and firecrackers within the administrative area of this Municipality. Article 3 These Regulations shall be implemented by the municipal and district (county) people's governments.

Township people's governments and sub-district offices shall incorporate the management of fireworks and firecrackers into grassroots social governance, and strengthen organization, coordination, guidance and supervision. Article 4 The public security department is responsible for the safety management of fireworks and firecrackers.

The administrative departments of production safety supervision and management, environmental protection, transportation, market supervision, housing and urban and rural construction, civil affairs, education, urban management, etc. shall, within the scope of their respective functions and duties, do a good job in the management of fireworks and firecrackers according to law. Fifth people's governments at all levels, neighborhood offices, residents' committees and villagers' committees shall take various forms to organize and carry out publicity and education on the lawful and safe discharge of fireworks and firecrackers.

Organs, organizations, enterprises, institutions and other organizations shall do a good job in publicity and education on the legal and safe discharge of fireworks and firecrackers.

Newspapers, radio, television, internet and other media should strengthen public welfare propaganda and public opinion supervision over the lawful and safe discharge of fireworks and firecrackers.

Schools and guardians of minors shall educate minors on the safety of fireworks and firecrackers. Article 6 Fireworks and firecrackers are prohibited in the following areas:

(1) yintai district and Wangyi District: Liuwan Water Plant in the north, Chuankou Water Distribution Plant and intuitive slopes on both sides of Chuandao in the south, and intuitive slopes on both sides of Chuankou-Wang Jiahe community and Chuandao (attachment 1).

(2) Yaozhou District (including New District): north of North Ring Road, south of South Ring Road, east of Yaowang Mountain and west of West Ring Road (Annex 2).

Outside the areas specified in the preceding paragraph, the municipal and district (county) people's governments may, according to the actual situation of urban development, timely determine the areas where fireworks and firecrackers are prohibited and announce them to the public. Seventh places outside the forbidden zone are prohibited from setting off fireworks and firecrackers:

(1) State organs;

(two) the scope of protection of cultural relics protection units and historical buildings;

(3) Units that produce and store inflammable and explosive articles;

(four) forest, crested ibis reserve and other key fire areas;

(5) Medical institutions, kindergartens, schools, sanatoriums and institutions for the aged;

(6) Traffic hubs such as stations and docks and railway line safety protection zones;

(7) Safety protection zones for power transmission and transformation facilities and oil and gas pipelines;

(eight) other places where fireworks and firecrackers are prohibited as prescribed by the municipal or district (county) people's government.

City, district (county) people's government shall set up warning signs for places prohibited from being published in the preceding paragraph. Eighth during the early warning period of heavy pollution weather above yellow, it is forbidden to set off fireworks and firecrackers within the administrative area of this Municipality.

The Municipal People's Government shall timely release the forecast information of heavy pollution weather, and prompt that it is forbidden to set off fireworks and firecrackers during this period. Ninth fireworks shall comply with the provisions of relevant laws, regulations and rules, and shall not be set off in the following ways:

(a) throwing lit fireworks at people, vehicles and buildings;

(two) throwing fireworks in buildings, roofs, balconies or;

(3) obstructing the safe passage of pedestrians and vehicles;

(4) Setting off fireworks and firecrackers in other ways that endanger public safety and personal and property safety. Article 10 To apply for holding large-scale fireworks display activities such as fireworks evening, the organizer shall apply to the public security department in accordance with the regulations on hierarchical management, and after obtaining the fireworks display license according to law, conduct fireworks display operations in accordance with the fireworks display safety regulations and the approved fireworks display operation plan.

If it is really necessary to hold a fireworks show and other large-scale fireworks display activities in the forbidden area stipulated in Article 6 of these regulations due to major activities, the public security department shall report to the Municipal People's Government for approval before making an administrative license. Eleventh prohibit the sale of fireworks in prohibited areas and places. Article 12 Operators and motor vehicle sales enterprises that provide celebrations, weddings, funerals, property services and other services in areas where fireworks and firecrackers are prohibited shall inform clients in advance of the provisions prohibiting fireworks and firecrackers; The illegal discharge of fireworks and firecrackers should be discouraged; If dissuasion is ineffective, report the case to the public security department in time. Thirteenth units and individuals are encouraged to discourage and report violations of these regulations.

Public security, production safety supervision and other administrative departments after receiving the report. It should be checked, handled and feedback in time. If it is verified, the whistleblower will be rewarded. Incentive measures shall be formulated by the Municipal People's government. Fourteenth one of the following acts, by the public security department shall be ordered to stop the discharge, and punished according to the following provisions; If it constitutes a violation of public security administration, it shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law; Those who cause property losses or personal injuries shall bear civil liability for compensation according to law:

(a) in violation of the provisions of Article 6 and Article 7 of these regulations, those who set off fireworks in areas and places where fireworks are prohibited shall be fined between 200 yuan and 500 yuan.

(two) in violation of the provisions of the provisions of article eighth, fireworks during the early warning period of heavy pollution weather above yellow, 500 yuan fine.

(three) in violation of the provisions of article ninth of these regulations, fireworks and firecrackers are set off in a way that endangers public safety and personal and property safety, and a fine of more than 300 yuan and less than 500 yuan is imposed.
