Measures of China Municipality on Filing Major Cases of "Combating Pornography and Illegal Publications"

Article 2 Cases of "eliminating pornography and illegal publications" as mentioned in these Measures refer to cases related to illegal publishing activities or illegal publications that should be given administrative punishment or investigated for criminal responsibility according to law within the scope of duties of the leading groups of "eliminating pornography and illegal publications" in all provinces, autonomous regions and municipalities directly under the Central Government.

Article 3 Whoever meets one of the following conditions is a major case of "eliminating pornography and illegal publications":

(a) cases in which the license should be revoked according to law;

(two) cases that should be ordered to suspend business for rectification according to law;

(3) Cases in which the illegal business amount is more than 1 10,000 yuan;

(4) cases in which the manufacture and sale of publications containing the contents stipulated in the second paragraph of Article 103 and the second paragraph of Article 105 of the Criminal Law of People's Republic of China (PRC) and the prohibited contents stipulated in Articles 26 and 27 of the Regulations on the Administration of Publication may seriously endanger national security and social stability;

(five) cases of manufacturing and selling obscene pornographic and vulgar publications, which may have a bad influence on society;

(six) cases of manufacturing and selling infringing and pirated publications, which may attract international attention and harm the interests of the state;

(seven) cases that hinder administrative law enforcement or violent resistance to the law;

(eight) cases that should be transferred to public security organs for investigation according to law;

(nine) cases investigated by the central leadership or the leaders of the national "anti-pornography and illegal publications" working group;

(10) Cases assigned by the Office of the National Working Group for Combating Pornography and Illegal Publications;

(eleven) major cases identified by the office of the leading group for the work of eliminating pornography and illegal publications in provinces, autonomous regions and municipalities directly under the central government;

(twelve) other cases that seriously disrupt the order of the publication market.

Fourth major cases of "anti-pornography and illegal publications" shall be reported to the office of the National Working Group for the record. The case for filing shall adopt a standardized name and number, and be reported in accordance with the provisions. Specific requirements:

(1) The name of the case consists of three parts: the place where the case occurred, the time when the case occurred and the nature of the case. For example, the "1. 1" illegal book case in Shenzhen, Guangdong.

(2) The case number consists of three parts: the administrative abbreviation, year and serial number of each province, autonomous region and municipality directly under the Central Government. (three) the contents of the case include the basic case, the stage of handling the case and the result of handling the case. The basic case includes the source of the clue, the time and place of the crime, the names of the people involved, the number of people involved, the amount involved and the investigation department. The case-handling stage refers to the stages of administrative investigation, criminal investigation, procuratorial examination and prosecution, and court trial. The result of handling a case refers to the result of administrative punishment and the result of the court's first or final judgment.

Article 5 When submitting the case filing materials, it shall fill in the Record Form for Major Cases of Combating Pornography and Illegal Publications, which is uniformly formulated by the Office of the National Working Group for Combating Pornography and Illegal Publications. One case is a form, and one case is a backup, with detailed case details, investigation process and handling results and other related materials attached.

Sixth major cases of "eliminating pornography and illegal publications" in various places shall be reported by the leading group offices of provinces, autonomous regions and municipalities directly under the central government for the record.

Article 7 Cases under the jurisdiction of the member units of the national working group on "eliminating pornography and illegal publications" that meet the provisions of Article 2 of these Measures shall be filed with the office of the national working group on "eliminating pornography and illegal publications" by each member unit; Cases within the jurisdiction of the member units of the leading groups of provinces, autonomous regions and municipalities directly under the Central Government that meet the provisions of Article 2 of these Measures shall be filed by the offices of provinces, autonomous regions and municipalities directly under the Central Government with the national office of "eliminating pornography and illegal publications".

Eighth major cases that may endanger social stability or may have adverse effects must be reported for the record within 24 hours after filing.

Article 9 The progress of filing cases shall be reported to the Office of the National Working Group for Combating Pornography and Illegal Publications in a timely manner. The filing form of major cases of "eliminating pornography and illegal publications" in the country can be left blank, but the name and number of the case should be indicated.

Article 10 The case supervision department of the Office of the National Working Group for Combating Pornography and Illegal Publications shall designate a special person to handle the filing of major cases.

Article 11 The member units of the national anti-pornography and illegal publications working group and the offices of the leading groups of all provinces, autonomous regions and municipalities directly under the Central Government shall designate special persons as case liaison officers to be responsible for daily case liaison with the offices of the national anti-pornography and illegal publications working group. The case liaison officer shall timely and comprehensively grasp the basic facts and progress of major cases in this department and local area.

Article 12 The leading group offices of provinces, autonomous regions and municipalities directly under the Central Government shall establish a case coordination and information communication mechanism with administrative law enforcement departments and judicial organs to track, coordinate and supervise the investigation and handling of cases in a timely manner.

Article 13 The Office of the National Working Group for Combating Pornography and Illegal Publications shall, depending on the situation, select some cases on file for key supervision, and issue a written Case Supervision Sheet to the relevant departments and the offices of the leading groups for combating pornography and illegal publications in provinces, autonomous regions and municipalities directly under the Central Government. Relevant regions and departments should take necessary measures to strengthen the investigation and handling of key cases supervised by the office of the national working group on "eliminating pornography and illegal publications"

Article 14 The list of national collective and individual candidates who have rendered meritorious service in handling cases of "cracking down on pornography and illegal publications" shall, in principle, be generated from major cases reported for the record in various places this year, and no other candidates may be recommended without special circumstances.
