Yunnan Province Qilu Lake Protection Regulations

Article 1. In order to strengthen the protection and management of Qilu Lake and prevent and control water pollution, in accordance with the "Water Law of the People's Republic of China" and "Law of the People's Republic of China on the Prevention and Control of Water Pollution" and other relevant laws and regulations, combined with the actual situation of Qilu Lake, these regulations are formulated. Article 2 Units and individuals engaging in activities within the protection scope of Qilu Lake shall abide by these regulations. Article 3 The protection of Qilu Lake adheres to the principles of scientific planning, unified management, comprehensive prevention and control, rational utilization and sustainable development. Article 4 The highest water storage level of Qilu Lake is 1797.65 meters (elevation of the Yellow Sea, the same below), and the lowest water storage level is 1794.95 meters.

The water quality of Qilu Lake is protected in accordance with the Class III water standard stipulated in the national "Surface Water Environmental Quality Standard" (GB3838-2002). Article 5 Qilu Lake Nature Reserve is divided into first-level protection areas and second-level protection areas.

The first-level protected area is the area within 100 meters of the Qilu Lake water body and the highest water storage level along the surface. Secondary protection areas are runoff areas other than first-level protection areas.

The boundaries of the first-level protected areas are delineated and marked by the Tonghai County People's Government. Article 6 The Yuxi Municipal People's Government shall provide leadership, supervision and management of the protection work of Qilu Lake. The Tonghai County People's Government is responsible for the protection and management of Qilu Lake.

The relevant departments of the People’s Government of Yuxi City and Tonghai County should, in accordance with their respective responsibilities, do a good job in the protection and pollution prevention of Qilu Lake.

The people's governments of the towns and villages along the lake are responsible for the protection of Qilu Lake within their own administrative regions, and should designate full-time personnel to maintain the rivers entering the lake. Article 7 The people's governments of Yuxi City and Tonghai County shall incorporate the protection of Qilu Lake into the national economic and social development plan, formulate a plan for the protection and utilization of Qilu Lake, establish a protection investment mechanism and an ecological protection compensation mechanism; allocate Qilu Lake protection and management funds included in the fiscal budget. Article 8 The People's Government of Tonghai County and its relevant departments shall strengthen the environmental protection of scenic spots such as the beautiful mountains, sinkholes, flood outlets, Jiulong Pond, Longquan Temple, shell mound ruins, and Erjie Lake Record Stone around Qilu Lake. Work. Article 9: All units and individuals have the obligation to protect Qilu Lake and have the right to stop and report illegal activities that pollute water bodies and damage the ecological environment.

The people's governments of Yuxi City and Tonghai County should regularly announce the status of the water environment; establish an incentive mechanism to encourage social forces to participate in protection work; and give full play to the role of social and news media supervision.

The people's governments of Yuxi City and Tonghai County should commend and reward units and individuals that have made outstanding achievements in the protection of Qilu Lake. Article 10 The Tonghai County People's Government shall establish a Qilu Lake management agency to perform the following duties:

(1) Promote and implement relevant laws and regulations;

(2) Supervise the implementation of Qilu Lake Luhu Lake Protection, Development and Utilization Plan;

(3) Cooperate with relevant departments to implement annual water storage, water supply and flood control plans;

(4) In accordance with Qilu Lake Protection, Development and Utilization Plan , supervise and manage the protection, development and utilization of lake water resources, aquatic resources, waters and beaches;

(5) Apply for Qilu Lake water abstraction license and collect water resources fees;

(6) Determine the closure period for the lake, apply for fishing licenses, and collect fishery resource enhancement protection fees;

(7) Apply for licenses for vessels to enter the lake, and be responsible for water safety management;

< p>(8) Work with the environmental protection department to establish Qilu Lake water quality monitoring, water pollution early warning and emergency response systems;

(9) Coordinate and supervise the relevant departments of towns and counties along the lake to perform their protection duties in accordance with the law;

(10) Centrally exercise part of the administrative penalty power of the relevant functional departments of the Tonghai County People’s Government over lake management in the Qilu Lake Level 1 Protected Area in accordance with the law. The implementation plan will be drawn up by the Tonghai County People’s Government and reported to Yuxi City Approval by the People's Government;

(11) Other matters assigned by the Tonghai County People's Government. Article 11: Establish public security agencies in first-level protected areas to maintain public security. Article 12 The water resources fees and fishery resource enhancement and protection fees collected by the Qilu Lake management agency in accordance with the law shall be turned over to the county-level finance and used exclusively for lake protection.

The people's governments of Yuxi City and Tonghai County should allocate certain funds to support the improvement of production and living conditions in rural areas in protected areas. Specific measures shall be formulated by the Yuxi City People's Government.

Article 13 The following behaviors are prohibited in first-level protected areas:

(1) New construction, reconstruction, and expansion of buildings and structures other than environmental protection and water projects;

(2) Discharge and dump industrial and domestic wastewater that does not meet the discharge standards or exceed the prescribed control volume;

(3) Discharge and dump industrial waste residues, agricultural, medical waste and domestic garbage;

(4) Large-scale breeding and centralized slaughtering of livestock and poultry;

(5) Reclaiming farmland, land, and fishing ponds around lakes;

(6) Cage cages, lake enclosures, Pen breeding;

(7) Occupying and destroying water projects, lake embankments, bank protection and other related facilities, destroying flood control, hydrology, environmental monitoring and other facilities;

(8) Taking water without authorization or Taking water in violation of the provisions of the water abstraction license;

(9) Fishing using motorized boats, electric boats or facilities that pollute water bodies;

(10) Exploding fish, poisoning fish, electric fish, producing, Selling and using fishing gear that hinders the growth and reproduction of fish resources;

(11) Unauthorized boating operations;

(12) Hunting of birds, amphibians and reptiles and other wild animals;

(13) Salvaging aquatic plants without authorization;

(14) Selling and using phosphorus-containing detergents and highly toxic and high-residue pesticides;
