General Provisions

Article 4 The administrative department for urban construction under the State Council is responsible for urban appearance and environmental sanitation work nationwide.

The urban construction administrative departments of the people's governments of provinces and autonomous regions are responsible for the management of urban appearance and environmental sanitation in their respective administrative regions.

The city appearance and environmental sanitation administrative department of the urban people's government is responsible for the management of urban appearance and environmental sanitation in its own administrative region.

Article 14 No unit or individual is allowed to pile materials, build buildings, structures or other facilities on both sides of streets and public areas. Urban Environmental Sanitation Management

Article 23: Environmental sanitation professional units are responsible for the environmental sanitation of the main streets, squares and public waters of cities established in accordance with the national administrative system.

Article 28 The city appearance and environmental sanitation administrative department of the urban people's government shall supervise and manage the collection, transportation and treatment of urban domestic waste.

All units and individuals shall dump garbage and feces in accordance with the time, place and method prescribed by the city appearance and environmental sanitation administrative department of the city people's government.

Garbage and feces should be cleared and transported in a timely manner, and harmless treatment and comprehensive utilization of garbage and feces should be gradually achieved.

Urban domestic waste should be gradually collected, transported and processed according to classification.

Article 29 Environmental sanitation management should gradually implement socialized services. In cities where conditions permit, environmental sanitation service companies can be established.

Anyone who entrusts an environmental sanitation professional unit to clean, collect, transport and process waste must pay a service fee. Specific measures shall be formulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

Article 30 The urban people's government shall develop city gas, natural gas, and liquefied gas in a planned manner and change the fuel structure; encourage and support relevant departments to organize clean vegetables into the city and recycle waste materials to reduce urban garbage.

Article 31 Waste generated by hospitals, sanatoriums, slaughterhouses, and biological products factories must be disposed of in accordance with relevant regulations.

Article 32 Citizens should take good care of the public health environment and refrain from spitting, defecation, and littering with waste such as peels, paper scraps, and cigarette butts.

Penalties

Article 35 Anyone who raises livestock or poultry without approval and affects the city appearance and environmental sanitation shall be ordered by the city appearance and environmental sanitation administrative department of the city people's government or its entrusted unit to order it to be confiscated within a time limit or have it confiscated. Fines may be imposed.

Article 36 Anyone who commits any of the following acts shall be ordered by the city appearance and environmental sanitation administrative department of the city people's government or the unit entrusted by it to cease illegal acts, clean up, dismantle or take other remedial measures within a time limit. (1) Without the consent of the city appearance and environmental sanitation administrative department of the city people's government, setting up large-scale outdoor advertisements without authorization, affecting the city appearance;

Article 39: Anyone who insults or beats city appearance and environmental sanitation staff or obstructs them from performing official duties shall be punished in accordance with the provisions of the "Regulations on Public Security Administration Punishments of the People's Republic of China"; it constitutes a crime , be held criminally responsible in accordance with the law.

Article 40 If the party concerned is dissatisfied with the administrative penalty decision, he may apply for reconsideration to the authority above the authority that made the penalty decision within fifteen days from the date of notification of the penalty; if he is dissatisfied with the reconsideration decision, You can file a lawsuit in the People's Court within 15 days from the date of receipt of the reconsideration decision. The parties concerned may also initiate demolition directly to the People's Court within fifteen days from the date of receiving the penalty notice.
