Chapter 1 General Provisions Article 1 is to strengthen measurement supervision and management, ensure the unity of the national measurement unit system and the accuracy and reliability of values, protect the legitimate rights and interests of consumers and operators, maintain social and economic order, and promote For economic and social development, these regulations are formulated in accordance with the "Law of the People's Republic of China and the National Metrology Law" and the "Implementing Rules of the People's Republic of China and the National Metrology Law" and in combination with the actual conditions of this province. Article 2 All units and individuals that establish measuring standard instruments, conduct metrological verification and certification, manufacture, repair, sell, and use measuring instruments, and engage in commercial trade measurement activities within the administrative region of this province shall abide by these regulations. Article 3: The metrological administrative departments at all levels are the competent departments responsible for metrological supervision and management of the people's governments at the same level, and implement the supervision and management of metrological activities within their respective administrative regions.
Relevant administrative departments shall, in accordance with the provisions of laws and regulations, carry out metrological supervision and management work in accordance with their respective responsibilities. Chapter 2 Metrological Supervision Article 4 The main responsibilities of metrological administrative departments at all levels responsible for metrological supervision are:
(1) Implement the laws, regulations and rules on metrological supervision;
(2) Formulate a development plan for the metrology industry, promote national legal measurement units, establish social public measurement standards, and organize the transmission of quantities; (3) Control the manufacture, repair, sale and use of measuring instruments, as well as commercial trade Supervise the implementation of metrological activities;
(4) Conduct metrological certification, mediate metrological disputes, and organize arbitration verification;
(5) Other duties stipulated in laws, regulations and rules. Article 5: Metrological supervision implements a system that combines daily supervision and key supervision.
Measurement administrative departments at all levels should focus on supervising the measurement activities of medical and health care, safety protection, environmental monitoring, and trade settlement of water, electricity, gas, communications and other trade settlements that are closely related to the national economy and people's lives. Article 6 The metrological law enforcement personnel of the metrological administrative department shall conduct the following metrological supervision and inspections in accordance with the law:
(1) Entering the place where measuring instruments and commodities are stored for inspection;
(2) Using recordings Conduct on-site inspections and investigations using , video, photography and other means;
(3) Check and copy relevant account books, vouchers and other materials. Article 7 When conducting metrological supervision and inspection, the metrological law enforcement personnel of the metrological administrative department shall participate in the metrological supervision and inspection with more than two people, present administrative law enforcement certificates and wear law enforcement badges, use unified law enforcement documents, and strictly follow the prescribed procedures for law enforcement.
Measurement law enforcement personnel of the metrology administrative department shall keep the technical secrets and business secrets of the persons under inspection. Article 8: No unit or individual may refuse metrology law enforcement personnel of the metrology administrative department to conduct metrological supervision and inspection, and must not condone or cover up metrological illegal activities; when discovering metrological illegal activities, they have the right to report or complain to the metrological administrative department. The metrological administrative department shall handle reported or complained metrological violations in a timely manner and respond to the reporter or complainant within fifteen days on the handling of the reported or complained cases. Chapter 3 Use of Units of Measurement Article 9 The units of measurement of the International System of Units and other units of measurement selected by the state shall be the national statutory units of measurement. Article 10 National legal units of measurement shall be used when engaging in the following activities:
(1) Preparing and issuing official documents, bulletins, and statistical reports;
(2) Compiling and broadcasting radio and television programs;
(3) Publish reports and academic papers;
(4) Produce and publish advertisements;
(5) Formulate various technical standards and verification procedures;
(6) Publishing and distributing books, newspapers, and periodicals;
(7) Making and issuing bills, certificates, and account books;
(8) Issuing tests and inspections Data;
(9) Manufacturing and selling goods and labeling goods;
(10) Other activities that require the marking of measurement units according to national and provincial regulations. Article 11: Export of goods, publication of ancient books and literary books, and other matters that require the use of non-national statutory units of measurement shall be governed by relevant national regulations. Chapter 4 Metrology Verification and Certification Article 12 Metrology administrative departments at all levels shall supervise and manage the metrology verification work in their respective regions.
Metrology verification work should be carried out locally and nearby in accordance with the principle of economic and rationality. Article 13 The following conditions must be met to carry out metrological verification:
(1) The measuring standard instrument has passed the examination;
(2) Within the limited verification range;
(3) Implement corresponding metrology verification procedures;
(4) Metrology verification personnel pass the assessment. Article 14 Public measuring standard instruments, the highest measuring standard instruments used by enterprises and institutions, and work measuring instruments used for trade settlement, safety protection, medical and health, environmental monitoring, etc. that are subject to compulsory verification by the state shall be subject to compulsory verification. The user unit or individual shall report to the local metrology administrative department at or above the county level, and go to the designated metrology verification institution for periodic verification in accordance with regulations. If it fails to be verified within the time limit or fails to pass the verification, it shall not be used any further.
The mandatory testing period shall be implemented in accordance with national regulations. Article 15 The metrology and verification institution shall complete the verification work within fifteen days from the date of receipt of the measuring instrument under inspection. If an extension is indeed necessary, the metrology and verification institution shall negotiate with the unit that submitted it for inspection.
For measuring instruments that have passed the verification, the metrology and verification institution shall issue a verification certificate, a verification certificate or a verification seal; for the measuring instruments that have failed to pass the verification, the metrology and verification institution shall issue a notification of the verification results. or cancel the original verification seal or certificate.
