Regulations of Shanghai Municipality on the Administration of Migrant Workers

Chapter I General Provisions Article 1 In order to strengthen the management of migrant workers, safeguard their legitimate rights and interests, maintain social order and promote economic and social development, these Regulations are formulated in accordance with the provisions of relevant state laws and regulations and in light of the actual situation of this Municipality. Article 2 The floating population mentioned in these Regulations (hereinafter referred to as floating population) refers to people who have entered this Municipality from other provinces, autonomous regions and municipalities directly under the Central Government and have no fixed residence in this Municipality. Article 3 These Regulations shall apply to the administration of foreign personnel inside and outside the administrative area of this Municipality.

Other relevant provisions of the state and this Municipality shall apply to residents of Taiwan Province Province, Hongkong and Macao entering this Municipality. Article 4 The Municipal People's Government shall lead the management of floating population in this Municipality, strengthen macro-control and promote the orderly flow of floating population.

District, county, township and town people's governments and sub-district offices are responsible for the management of foreign personnel inside and outside the jurisdiction. Fifth people's governments at all levels of public security, labor and other relevant administrative departments are the functional departments of foreign personnel management, and should perform their duties and cooperate with each other to do a good job in the management of foreign personnel. Article 6 People's governments at all levels and sub-district offices shall set up floating population management coordination agencies to coordinate, guide and supervise the floating population management of relevant administrative departments. Article 7 The management of floating population shall follow the principle of combining management with education and management with service. Article 8 The lawful rights and interests of immigrants are protected by law.

Foreigners should consciously fulfill their legal obligations and respect social morality. Chapter II Management of Temporary Residence Article 9 When foreigners enter this city, they shall go through temporary residence registration with the public security organ of the temporary residence in accordance with the relevant provisions of the state. If they stay in hotels, the registration of accommodation shall be regarded as temporary residence registration.

Migrant workers who need to engage in work and business activities in this city shall apply for the Temporary Residence Permit for Migrant Workers in Shanghai (hereinafter referred to as the "Temporary Residence Permit") from the public security organ of the temporary residence, and the public security organ shall timely review it. If the following certification conditions are met, the temporary residence permit shall be issued within 10 days from the date of acceptance:

(1) Holding my identity card;

(2) Having a legal domicile in this Municipality;

(three) there are legitimate reasons for work and business.

It is forbidden to alter, lend, buy or sell or forge temporary residence permits. Tenth temporary registration is valid for three months, and the temporary residence permit is valid for two years.

If it is necessary to stay in this city after the expiration of the temporary residence registration or temporary residence permit, it shall go through the formalities of extension or replacement at the original registration or issuing authority before the expiration of the validity period. Article 11 If the temporary residence permit is lost or the registered items of the temporary residence permit need to be changed, it shall apply to the original issuing authority for completing or changing the formalities, and if it leaves the city at the expiration of the validity period, it shall return the temporary residence permit. Chapter III Management of Rental Houses Article 12 Residential or non-residential houses rented to outsiders shall comply with the administrative regulations of the state and this Municipality on housing, land, planning, public security, sanitation and environmental protection.

Rental housing should have basic living facilities. Thirteenth housing lease, the lessor and the lessee shall sign a written lease contract, and within fifteen days from the date of signing the contract, to the location of the leased housing land management department or the housing management department entrusted by the agency for registration. Fourteenth units and individuals that rent houses to outsiders shall perform the following obligations:

(a) to apply to the local public security organ for the "Housing Lease Security Permit";

(two) when renting a house, the valid identity certificate of the lessee shall be examined, and the registration form or register made by the public security department shall be filled in;

(three) to carry out the necessary safety and health publicity for the lessee, and urge the lessee to apply for temporary residence registration or temporary residence permit in time, go through the verification procedures of family planning, and accept the health inspection of health and epidemic prevention;

(4) Paying taxes according to law;

(five) found that the lessee has illegal behavior, it shall promptly report to the relevant departments;

(six) abide by other relevant provisions of the housing lease.

* Note: The administrative licensing item of "Public Security Permit for House Lease" in this article has been stopped by the Decision of the Standing Committee of Shanghai Municipal People's Congress on Stopping the Implementation of Some Administrative Licensing Items Set by Local Regulations of this Municipality (release date: June 23, 2004, implementation date: July 1 day, 2004). Article 15 The lessee shall abide by the following provisions:

(a) when renting a house, show my valid identity certificate to the lessor;

(two) shall not rent a house without a "house rental security permit";

(three) shall not sublease or lend the leased house to others without authorization;

(four) shall not change the purpose of the house without authorization, and shall not use the rented house for illegal construction.

It is forbidden to use rented houses for illegal and criminal activities. Chapter IV Health and Epidemic Prevention and Family Planning Management Article 16 Migrant workers and businessmen shall, within 15 days from the date of obtaining the temporary residence permit, go to the township health center or street hospital in their temporary residence for health and epidemic prevention inspection; Those who pass the inspection shall be stamped with the health inspection certificate on the temporary residence permit by the township hospitals or street hospitals; If a patient is found to have an infectious disease stipulated in the Law of People's Republic of China (PRC) on the Prevention and Control of Infectious Diseases, the medical unit shall immediately take preventive measures and notify the district and county health and epidemic prevention departments of their temporary residence to handle the epidemic situation well.
