Measures of Langfang Municipality on Property Management

Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of all parties involved in property management, create a good living and working environment and promote the construction of a civilized city, these Measures are formulated in accordance with the provisions of the Property Law of People's Republic of China (PRC), the Regulations on Property Management and other relevant laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Measures shall apply to the property management activities within the administrative area of this Municipality.

The term "property management" as mentioned in these Measures refers to the activities of the owners to maintain, conserve and manage the houses, supporting facilities, equipment and related sites by hiring property service enterprises, and to maintain the environmental sanitation and related order in the property management area. Article 3 Property management shall adhere to the principle of combining territorial management, owner autonomy and professional services.

Advocate owners to choose property service enterprises through an open, fair and just market competition mechanism. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen the organization and leadership of property management, incorporate property management services into the development planning of modern service industry, community construction planning and community governance system, establish and improve a socialized, professional and market-oriented property management mechanism, and incorporate property management funds into the fiscal budget. Fifth city property management administrative departments should carry out publicity and training of property management laws, regulations, rules and related policies, establish a credit evaluation system for property service enterprises, and promote the healthy development of the property service industry. Article 6 Owners, owners' congresses and owners' committees, construction units and property service enterprises are encouraged to entrust third-party property service evaluation agencies to evaluate the level and quality of property services.

The assessment report issued by the third-party assessment agency of property services shall be true, objective and comprehensive. Chapter II Supervision and Management Article 7 The municipal administrative department of property management shall be responsible for the supervision and management of property management activities within the administrative area of this Municipality and perform the following duties:

(a) to study and formulate policies on property management within the administrative area of this Municipality;

(two) to guide and supervise the property management work of the county (city, district) property management administrative department;

(three) responsible for the guidance and supervision of residential special maintenance funds;

(four) responsible for the credit management of property service enterprises;

(five) responsible for the supervision of property management bidding activities;

(six) other duties as prescribed by laws, regulations and rules. Eighth county (city, district) property management administrative departments responsible for the supervision and management of property management activities within their respective administrative areas, perform the following duties:

(a) to guide and supervise the property management work of Township People's governments and sub-district offices;

(two) responsible for the collection, use and supervision of residential special maintenance funds;

(three) responsible for the collection, verification and supervision of credit information of property service enterprises;

(four) responsible for the property management bidding for the record and the approval of hiring property service enterprises through agreement;

(five) responsible for property inspection and filing;

(six) responsible for the establishment of property management dispute mediation mechanism, handling property management complaints;

(seven) other duties as prescribed by laws, regulations and rules. Ninth Township People's governments and sub-district offices shall be responsible for the property management within their respective jurisdictions and perform the following duties:

(a) to guide the establishment of the owners' congress and the election of the owners' committee, and to supervise the owners' congress and the owners' committee to perform their duties according to law;

(two) to assist the county (city, district) property management administrative departments to do a good job in property inspection and filing, supervision of residential special maintenance funds, and collection of credit information of property service enterprises;

(three) to convene a joint meeting of property management, mediate property management disputes and assist in handling property management complaints;

(four) to coordinate and guide the management service work of residential quarters without property management;

(five) other duties as prescribed by laws, regulations and rules.

The residents' committee shall assist the township people's governments and sub-district offices to do a good job in property management. Tenth city and county (city, district) people's government of the following relevant departments in accordance with their respective responsibilities to do a good job in property management related work:

(a) the public security organ shall do a good job in the supervision and management of public security and fire safety in the property management area, supervise and inspect the property service enterprises to perform their duties of public security and fire safety, and investigate and deal with illegal acts affecting public security and public order in the property management area according to law;

(two) the administrative department of urban and rural planning shall do a good job in the examination and supervision of the planning of supporting facilities such as property service houses in the property management area;

(three) the price administrative department shall do a good job in the supervision and management of property service charges, standardize the behavior of property service charges, accept price policy consultation and complaints, and investigate and deal with all kinds of price violations according to law;

(four) the construction administrative department shall do a good job in the supervision and management of the quality warranty, water supply, gas supply and heating of housing construction projects within the property management area, and investigate and deal with illegal acts of changing the main body and load-bearing structure of housing construction without authorization according to law;

(five) the competent administrative department of city comprehensive management shall investigate and deal with illegal acts such as changing the use, form, color or material of buildings, structures and other facilities without authorization, illegally erecting buildings and structures, occupying and damaging green spaces. In the property management area according to law;

(six) the safety supervision and management department of special equipment shall do a good job in the safety supervision of elevators, boilers, pressure vessels and other special equipment in the property management area, and investigate and deal with illegal acts in the installation, renovation, maintenance and use of special equipment according to law;

(seven) the civil air defense department shall do a good job in the maintenance, supervision and management of civil air defense projects within the property management area.

Other relevant administrative departments shall, according to their respective responsibilities, do a good job in property management.
