Procuratorial organs and their staff shall keep confidential what they know in the process of supervision and investigation.

Supervisory organs and their staff members shall keep confidential the state secrets, business secrets and personal privacy they know in the course of supervision and investigation. "State secrets" refer to matters related to national security and interests, which are determined according to legal procedures and only known to a certain range of people in a certain period of time; "Business secret" refers to technical information and business information that is not known to the public, can bring economic benefits to the obligee, is practical and kept confidential by the obligee; "Personal privacy" refers to secrets in personal life that are unwilling to be made public or known to others.

I. Nature of the People's Procuratorate:

1. The people's procuratorate is the legal supervision organ of the state. The people's procuratorates independently exercise procuratorial power according to law, and are not subject to interference by administrative organs, social organizations or individuals.

2. China has established special people's procuratorates such as the Supreme People's Procuratorate, local people's procuratorates at various levels and military procuratorates. Local people's procuratorates at all levels are divided into: people's procuratorates of provinces, autonomous regions and municipalities directly under the Central Government; Branches of people's procuratorates of provinces, autonomous regions and municipalities directly under the Central Government, and people's procuratorates of autonomous prefectures and municipalities directly under the Central Government; People's procuratorates of counties, cities, autonomous counties and municipal districts.

3. the Supreme People's Procuratorate is the highest procuratorial organ. The Supreme People's Procuratorate leads the work of local people's procuratorates at all levels and special people's procuratorates, and the people's procuratorates at higher levels lead the work of people's procuratorates at lower levels.

The Supreme People's Procuratorate is responsible to the National People's Congress and the NPC Standing Committee. Local people's procuratorates at all levels are responsible to the organs of state power that produced them and the people's procuratorates at higher levels.

Two, the people's Procuratorate shall exercise the following functions and powers:

1. exercise procuratorial power over serious criminal cases of treason, secession and serious violation of the unified implementation of state policies, laws and decrees.

2, for the direct acceptance of the national staff to use their powers to commit crimes, should be investigated and dealt with according to law.

3. Review cases investigated by public security organs, state security organs and other investigation organs, and decide whether to arrest, prosecute or not to prosecute. And supervise the legality of the investigation activities of the investigation organs.

4. Prosecute criminal cases and support public prosecution; Supervise whether the criminal judgments and rulings of the people's courts are correct and whether the judicial activities are legal.

5. Whether the criminal activities carried out by execution organs such as prisons and detention centers are implemented according to law.

6. To exercise legal supervision over the civil trial activities of the people's courts, and lodge a protest if it is found that the effective judgments and rulings of the people's courts violate the law.

7. To exercise legal supervision over administrative litigation. If it is found that the effective judgment or ruling of the people's court violates laws and regulations, it shall lodge a protest according to law.

Legal basis: Provisions on the Confidentiality of Handling Cases by People's Procuratorates

Article 4 These Provisions shall apply to the case-handling personnel of procuratorial organs and those who need to contact with cases because of their work.

Article 5 When handling cases, people's procuratorates at all levels shall correctly handle the relationship between the openness of procuratorial affairs and state secrets and work secrets, safeguard the litigation rights of the parties according to law, strictly abide by the legal provisions and work discipline, and earnestly keep state secrets.

Article 6 The People's Procuratorate implements the responsibility system of confidentiality in handling cases, with the procurator-general as the first responsible person, the deputy procurator-general in charge as the main responsible person and the department head as the specific responsible person.
