Chapter I General Provisions Article 1 In order to strengthen the protection of ancient and famous trees, make rational use of ancient and famous tree resources and promote the construction of ecological civilization, these Regulations are formulated in accordance with the Forest Law of People's Republic of China (PRC) and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the protection and management of ancient and famous trees within the administrative area of this province.

The term "ancient trees" as mentioned in these Regulations refers to trees that are over 100 years old.

The term "trees" as mentioned in these Regulations refers to trees with historical value or important commemorative significance. Article 3 Ancient and famous trees shall be subject to territorial protection and management. The protection of ancient and famous trees adheres to the principle of giving priority to government protection and combining professional protection with public protection. Article 4 People's governments at all levels shall strengthen publicity and education on the protection of ancient and famous trees, enhance public awareness of protection, encourage and promote scientific research on the protection of ancient and famous trees, popularize scientific research achievements and technologies on the protection of ancient and famous trees, and improve the protection level of ancient and famous trees.

The people's governments at or above the county level shall arrange funds according to the protection level of ancient and famous trees, which shall be earmarked for the investigation, identification, protection and rescue of ancient and famous trees, as well as the publicity and training of ancient and famous trees protection. Article 5 The Greening Committee of the people's governments at or above the county level shall organize and coordinate the protection and management of ancient and famous trees within their respective administrative areas.

The administrative departments of forestry and urban greening of the people's governments at or above the county level shall be responsible for the protection and management of ancient and famous trees in accordance with their respective duties. Article 6 Units and individuals are encouraged to donate ancient and famous trees to the country, and donate money to protect and adopt ancient and famous trees.

People's governments at all levels shall commend and reward units or individuals that have made remarkable achievements in donating and protecting ancient and famous trees. Chapter II Identification Article 7 The Greening Committee of the people's government at or above the county level shall organize the administrative departments of forestry and urban greening to conduct a general survey of ancient and famous trees resources within their respective administrative areas every five years, register, number and take photos of ancient and famous trees, and establish resource files.

Encourage units and individuals to report the discovered ancient and famous tree resources to the administrative departments of forestry and urban greening of the people's governments at or above the county level. The administrative department of forestry and urban greening that has received the report shall promptly investigate and update the archives of ancient and famous trees. Eighth ancient trees are graded according to the following standards:

(1) Ancient trees over 500 years old are Grade I;

(two) old trees with a age of more than 300 years but less than 500 years are classified as Grade II;

(three) the age of 100 years old and less than 300 years old is the third level.

Ancient and famous trees are protected as first-class ancient trees. Ninth ancient and famous trees are identified in accordance with the following provisions:

(a) the first-class ancient and famous trees were identified by the Greening Committee of the provincial people's government, and the competent administrative department of forestry and urban greening set up an expert committee, which was reported to the provincial people's government for identification and publication;

(two) the second-class ancient trees are identified by the Greening Committee of the Municipal People's Government with districts, and the administrative departments of forestry and urban greening set up an expert committee, which was confirmed and announced by the Municipal People's Government;

(3) The Greening Committee of the people's government at the county level shall organize the competent administrative department of forestry and urban greening to set up an expert committee for appraisal, and report it to the people's government at the county level for confirmation and publication.

The relevant units or individuals have objections to the identification of ancient and famous trees, which can be put forward to the Greening Committee of the provincial people's government. The Greening Committee of the Provincial People's Government may reorganize the review according to the specific circumstances. Article 10 The administrative departments of forestry and urban greening of the people's governments at or above the county level may, according to the local resources of ancient and famous trees, determine a batch of trees with the age of nearly 65,438+0,000 years as the reserve resources of ancient trees every five years, and implement protection with reference to the measures for the protection of tertiary ancient trees. Chapter III Conservation Article 11 The administrative departments of forestry and urban greening of the people's governments at or above the county level shall determine the units responsible for the conservation of ancient and famous trees in accordance with the following provisions:

(a) in the organs, military units, enterprises and institutions and other land within the scope of the old and famous trees, by the unit responsible for the maintenance;

(two) the ancient and famous trees within the scope of railways, highways, river dams, reservoirs, lakes and canals, and the management units of railways, highways and water conservancy projects are the responsible units for maintenance;

(three) in the nature reserves, forest parks, scenic spots, geological parks within the scope of land, by the park management agencies for the maintenance of responsible units;

(four) in the cultural relics protection units, temples and other land within the scope of the old and famous trees, by the unit responsible for the maintenance;

(five) in the urban roads, streets, green spaces and other public facilities within the scope of ancient and famous trees, urban landscaping management units for the maintenance of the responsible units;

(six) the old and famous trees within the scope of rural collective land, the villagers' committee or villagers' group is the responsible unit for conservation.

Private ownership of ancient and famous trees, the owner is the person responsible for conservation.

Ancient and famous trees in urban residential areas shall be maintained by the neighborhood offices where the residential areas are located.

If the relevant units or individuals have any objection to the conservation responsibility of ancient and famous trees, they may apply to the administrative department of forestry and urban greening of the people's government at or above the county level for review. Twelfth forestry and urban greening administrative departments of the people's governments at or above the county level shall sign a conservation responsibility letter with the units or individuals responsible for conservation, and clarify the responsibilities and obligations of conservation.

Units or individuals responsible for conservation shall strengthen the daily maintenance of ancient and famous trees, ensure the normal growth of ancient and famous trees, prevent and stop all kinds of behaviors that damage ancient and famous trees, and accept the guidance, supervision and inspection of the administrative departments of forestry and urban greening.

Where ancient and famous trees suffer from harmful biological hazards or man-made and natural damage, and there are obvious signs of weakness and endangerment, the conservation unit or individual shall promptly report to the administrative department of forestry and urban greening of the local people's government at or above the county level. After receiving the report, the administrative department of forestry and urban greening shall promptly organize professional and technical personnel to conduct on-site investigation and take corresponding measures to rescue and rejuvenate ancient and famous trees.
