Sanming City Landscaping Management Regulations

Chapter I General Provisions Article 1 In order to strengthen the management of urban landscaping, protect and improve the urban ecological environment, promote the construction of ecological civilization, and meet the people's growing needs for a beautiful living environment, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Regulations on the Administration of Urban Landscaping in Fujian Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, protection and management of landscaping in the urban planning area of this Municipality and the counties (cities) under its jurisdiction.

The term "landscaping" as mentioned in these Regulations includes garden green space, trees, flowers and landscaping facilities.

Where there are other provisions in laws and regulations on the landscaping of nature reserves, scenic spots, drinking water source protection areas, woodlands, wetlands, highways and other areas and the protection and management of ancient and famous trees in cities, those provisions shall prevail. Article 3 Urban landscaping shall adhere to the principles of government-led, public participation, local conditions, ecological priority, scientific planning, construction and management.

Urban landscaping should be combined with the implementation of ecological restoration and urban restoration, optimize the allocation of plants and landscaping facilities, highlight the characteristics of landscape gardens and cities, and embody regional cultural elements such as red culture, Hakka culture and Fujian culture in this city. Article 4 The people's governments of cities and counties (cities, districts) shall incorporate the construction of urban landscaping into the national economic and social development plan, include the funds for the construction and maintenance of urban landscaping in the fiscal budget at the corresponding level, strengthen the popularization of science and technology in urban landscaping, and organize voluntary tree planting and other greening activities for the whole people.

The township (town) people's governments and sub-district offices within the urban planning area shall, in accordance with their duties, do a good job in the relevant work of urban landscaping within their respective jurisdictions. Fifth city landscaping department is responsible for the management, guidance and supervision of the city's urban landscaping. County (city, district) urban landscaping department is responsible for the management of urban landscaping within its jurisdiction. The professional management unit of urban landscaping is subordinate to the competent department of urban landscaping, and is specifically responsible for the related work of urban landscaping.

Development and reform, public security, finance, natural resources, ecological environment, housing and urban and rural construction, transportation, water conservancy, culture and tourism, forestry and other departments shall, according to their respective responsibilities, do a good job in urban landscaping.

Power generation and power supply, communication, radio and television network, water supply and drainage, gas, municipal and other relevant units should cooperate with the relevant work of urban landscaping. Article 6 Units and citizens who have the ability to work shall, in accordance with the relevant provisions of the state, perform the obligation of planting trees or other greening.

Encourage units and individuals to participate in the construction and maintenance of urban landscaping by means of donation, construction, adoption and tree planting. Advocate civilized units at all levels to adopt public gardens and green spaces.

Encourage the development of garden-style units, garden-style residential quarters and other urban landscaping demonstration activities. Chapter II Planning and Construction Article 7 The people's governments of cities and counties (cities) shall organize the natural resources departments and the competent departments of urban landscaping to prepare the urban green space system planning, incorporate it into the overall urban planning, and make it public.

The planning of urban green space system should proceed from the local reality, and reasonably arrange the planning indicators such as urban landscaping land area, urban built-up area green coverage rate, per capita park green space, etc., which should meet the national or provincial garden city (county) standards.

Urban green space system planning should include surface cities and heavy mountains as the basis for reasonable construction, transformation and upgrading. Article 8 The preparation and revision of urban green space system planning shall, in accordance with the relevant provisions of the state, delimit the control lines of various urban green spaces (hereinafter referred to as green lines), and the specific measures for the management of green lines shall be formulated by the Municipal People's Government. Article 9 The proportion index of the landscaping land area of a construction project to the total land area of a construction project (hereinafter referred to as the green rate) shall meet the following requirements:

(a) residential land and general units in new urban areas shall not be less than 30%, and schools, hospitals, sanatoriums, government organizations, public cultural facilities and other units shall not be less than 35%;

(two) residential land and general units in the old city transformation area shall not be less than 25%, and schools, hospitals, nursing homes, government organizations, public cultural facilities and other units shall not be less than 30%;

(three) the green rate of industrial, commercial, urban roads and other construction projects shall be implemented in accordance with the urban green space system planning.

Units and residential land existing green rate is lower than the provisions of the preceding paragraph, there are still open spaces that can be green, it should be green within a time limit, and shall not be idle or used for other purposes. Tenth natural resources departments in the issuance of construction project planning permits, should be in accordance with the provisions of article ninth to verify the landscaping area; Do not meet the requirements, shall not be issued.
