Introduction to labor ability level appraisal

Working ability appraisal is to determine the degree of loss of labor ability through the appraisal of a person’s ability to engage in physical work. Loss of working ability can be divided into:

(1) Partial loss of working ability. Although such people are physically weak, have organ dysfunction, or have limbs disabled due to injury or illness, they can still perform some light or within their capabilities work.

(2) Complete loss of working ability. Such people are no longer able to engage in any intensive work due to injury or illness, and even require care from others in their daily lives. The identification of labor ability is a complex and difficult task, which involves medical, ethical and other relevant knowledge and is in accordance with relevant national policy regulations.

It is made based on clear identification standards and a comprehensive analysis of the condition of the person being identified. 3-6 The courts, labor arbitration, petitions and other departments entrust the appraisal and processing according to the work-related injury appraisal standards.

Article 38 of the "Social Insurance Law of the People's Republic of China" due to work-related injuries The following expenses shall be paid from the work-related injury insurance fund in accordance with national regulations:

(1) Medical expenses and rehabilitation expenses for the treatment of work-related injuries.

(2) Hospitalization food subsidy.

(3) Transportation, food and accommodation expenses for medical treatment outside the coordinated area.

(4) Costs required for installing and configuring assistive devices for the disabled.

(5) Living care expenses confirmed by the Labor Capacity Appraisal Committee for those who cannot take care of themselves.

(6) One-time disability subsidy and monthly disability subsidy received by employees with level 1 to level 4 disabilities.

(7) One-time medical subsidy that should be enjoyed when the labor contract is terminated or terminated.
