Shanghai Measures for Regulating the Business Behavior of the Catering Industry in October 2008

In order to regulate the business behavior of catering enterprises, protect the legitimate rights and interests of consumers, and promote the healthy development of the catering industry, combined with Relevant laws and regulations are specially formulated in these measures.

Article 1 Scope of application

These measures are applicable to hotels, restaurants, restaurants (chain restaurants), bars and other enterprises engaged in the catering industry in this city.

Article 2: Integrity Management

Catering enterprises shall abide by relevant national laws and regulations, strengthen cost accounting, establish and improve clearly marked pricing and other systems, abide by professional ethics, operate with integrity, and consciously maintain Corporate image and reputation.

Article 3 Staffing

Catering enterprises should be equipped with full-time (part-time) price clerks to be responsible for the price management of the enterprise.

Article 4: Clearly marked prices

1. According to the State Planning Commission's "Regulations on Clearly Marked Prices for Goods and Services", each catering enterprise must have eye-catching price tags or well-made price tags. Price Book.

2. The title page of the catering price list must be marked with: the address and telephone number of the superior management department; the telephone number and address of the price supervision and complaint department in the district (county) where it is located.

3. The price tag of dishes should include product name, specification (large, medium, small, regular basin), pricing unit, sales price and other items. For the "current price" of fresh and seafood dishes, the actual market price must be indicated on the physical object or in the price list.

4. The price of snacks and snacks should include: product name, specifications, pricing unit, sales price, and the unit quantity must also be indicated in the specification column.

5. In addition to the product name, specifications, unit of measurement, and sales price, zero-cup wine and homemade drinks must also indicate the capacity of each cup.

Article 5 Service Charges

All service items and charging standards of catering enterprises should be clearly stated to consumers, and services should be provided that are consistent with the charging standards.

1. Catering companies can charge a certain service fee based on market positioning and state it on the title page of the price list.

2. Catering companies can negotiate with consumers to charge relevant fees for videography, electricity bills, projector rental or playback, etc.

3. Catering enterprises should obtain the consent of consumers when providing tea, and can determine the charging price according to the variety and quality of tea.

4. Enterprises that reserve banquets can charge a deposit of no more than 20% of the total amount. Reservations and changes should be agreed in writing and a voucher should be issued.

Article 6 Providing a List

1. When providing catering services, various catering companies with dine-in facilities should proactively provide consumers with a consumption service settlement list. Only after confirming that the settlement list is correct can you collect payment and issue a tax invoice.

2. The consumption settlement list should truthfully state the product name, unit, quantity, discount and total amount of dishes, snacks, soups, wine, beverages, tea, fruits, towels and other items. Items without clearly marked prices shall not be included in the consumption settlement list. The settlement list must indicate the name of the company, the date and time of consumption, and the telephone number for complaints.

3. Catering enterprises that set minimum consumption standards should mark the content and standards of the minimum consumption in a conspicuous position, and inform consumers before providing consumer services.

Article 7 Liability for Compensation

If a catering company has a dish quality problem and is complained by consumers, and if the investigation proves it true, it should take the initiative to apologize and replace it with the same quality standard. Dishes can also be refunded at the original price. If a consumer's health is harmed due to dining, and it is verified to be true by the relevant authoritative department, the catering enterprise shall provide corresponding compensation.

Article 8 Industry Agreement

1. Catering enterprises should refuse consumers to bring outside food and drinks (including wine and beverages) into restaurants, bars and other business premises, and display them in conspicuous locations Set up notices.

2. If a catering enterprise agrees to allow consumers to take out food or drinks, the service fee charged should be clearly stated on the title page of the price list and the consumer should be informed before providing services. Food hygiene liability caused by food and alcohol.

3. Waiters in catering companies have the obligation to promptly dissuade consumers from excessive drinking to prevent drunkenness.

If a drunk consumer causes an accident and causes losses, the catering company can claim compensation from the consumer.

4. Dishes, snacks, mooncakes, cakes, etc. ordered by consumers and not collected after the shelf life will be deemed as abandoned, and the catering company will no longer refund the deposit.

5. Catering companies are not responsible for the safekeeping of consumers’ valuables, but waiters should remind consumers to keep their belongings properly. Qualified catering companies should be equipped with clothing covers to provide convenience for consumers.

Article 9 Supervision and Inspection

The Shanghai Catering Industry Association is responsible for inspecting and supervising the implementation of these Measures by catering enterprises.

Article 10 If a dispute arises between a consumer and an operator and requires compensation, the consumer may resolve the dispute directly with the operator or through negotiation with the operator through the Catering Industry Association, or may complain to the Consumer Rights Protection Committee or the administrative department. To appeal, you can apply for arbitration to the Shanghai Arbitration Commission in accordance with the arbitration agreement agreed upon by both parties, or you can file a lawsuit directly with the People's Court.

Article 11 If these Measures are inconsistent with relevant national laws and regulations, they shall be implemented in accordance with relevant national laws and regulations.

Article 12 The Shanghai Catering Industry Association is responsible for the interpretation of these Measures. Effective from October 1, 2008.
