Provisions on the Use of Reconnaissance Certificates and Special Traffic Signs by State Security Organs in Hebei Province

Article 1 In order to standardize the use of reconnaissance certificates and special traffic signs of state security organs and ensure that state security organs and their staff perform national security tasks according to law, these Provisions are formulated in accordance with the provisions of the National Security Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of this province. Article 2 The reconnaissance certificate of the state security organ and the special traffic sign for vehicles mentioned in these Provisions refer to the reconnaissance certificate of the Ministry of National Security of People's Republic of China (PRC) (hereinafter referred to as the reconnaissance certificate) and the special traffic sign for vehicles uniformly issued by the Ministry of National Security. Article 3 When performing national security tasks within the administrative area of this province, state security organs and their staff shall use reconnaissance certificates and special traffic signs for vehicles in accordance with these provisions. Article 4 Reconnaissance certificates are limited to the use of staff of state security organs when performing state security tasks.

The configuration and use of special traffic signs for vehicles are limited to command vehicles of state security organs, vehicles carrying out reconnaissance and security tasks and other vehicles with special tasks. Article 5 State security organs shall strengthen the management of reconnaissance certificates and special traffic signs of vehicles to ensure the unified custody of personnel. When the staff of state security organs need to use reconnaissance certificates and special traffic signs for vehicles when performing their tasks, they shall go through the examination and approval procedures in accordance with the regulations and shall not intentionally damage or lose them. Article 6 When performing national security tasks, staff members of state security organs may produce reconnaissance certificates and perform the following duties according to law:

(1) Examining the identity certificates of citizens and overseas personnel;

(two) to check the belongings of unidentified persons and suspects who endanger national security;

(three) to investigate and inquire about the situation related to national security work to the relevant organizations and personnel;

(4) Summoning suspects who are suspected of committing crimes on the spot or who are accused and found to have committed acts endangering national security to a designated place for interrogation;

(five) to inspect and read the archives, materials and articles related to national security work, and to inspect the information data, electronic communication tools, equipment and other equipment and facilities of organizations and individuals.

Involving military units and active servicemen, it shall be handled in accordance with relevant regulations. Article 7 When performing an urgent task of national security, the functionaries of state security organs shall enjoy the following rights according to law after presenting their reconnaissance certificates:

(a) give priority to the purchase of air tickets, train tickets and boat tickets, give priority to the choice of cars (classes) and seats, or take public transport first and then make up the tickets;

(two) according to the relevant provisions of the state to the customs, frontier defense, inspection and quarantine, airports, stations, docks and other inspection agencies to apply for exemption from inspection information and equipment;

(three) when necessary, give priority to the use or use of organs, groups, enterprises, institutions and individuals of transportation, communication tools, venues or buildings. After completing the task, it should be returned in time and pay the appropriate fee. If losses are caused, compensation shall be made. Article 8 When performing the tasks of national security, the staff of state security organs can enter the areas and places related to the task free of charge with reconnaissance certificates or special vehicles with special traffic signs. Article 9 When a state security organ performs an emergency task of state security, special vehicles with special traffic signs are not restricted by the driving route, direction, speed and traffic signals on the premise of ensuring road traffic safety. When the traffic is blocked, give priority to the traffic. After the traffic accident is investigated by the traffic management department of the public security organ, it can be released first, and it is exempt from inspection at the checkpoint, and it is exempt from paying tolls for toll roads, bridges and tunnels and parking fees for operating parking lots. Article 10 When the functionaries of state security organs use reconnaissance certificates and special traffic signs of vehicles to perform tasks of state security, the relevant units and personnel shall cooperate with them, provide necessary conditions, submit relevant information and materials concerning state security work in time, and shall not refuse or hinder them for any reason, and keep the secrets of state security work they know. Article 11 The functionaries of state security organs shall use reconnaissance certificates and special traffic signs for vehicles in accordance with these Provisions. It is strictly forbidden to use reconnaissance certificates and special traffic signs for illegal activities or personal gain, and it is strictly forbidden to lend reconnaissance certificates and special traffic signs to others for use.

In addition to the implementation of national security emergency tasks, traffic signs dedicated to vehicles shall not be used. Twelfth no unit or individual may detain the vehicle reconnaissance certificate and special traffic signs.

It is strictly prohibited to forge, alter, trade or illegally use reconnaissance certificates and special traffic signs for vehicles. Article 13 Citizens, legal persons and other organizations have the right to report and accuse the state security organs and their staff of using reconnaissance certificates and special traffic signs in violation of these provisions to the state security organs or relevant departments, and the state security organs or relevant departments shall promptly investigate and deal with them according to law. Fourteenth staff of state security organs in violation of these provisions, one of the following circumstances, shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) the use of reconnaissance certificates and special traffic signs for vehicles without performing the examination and approval procedures as required;

(2) Intentionally damaging or losing reconnaissance certificates and special traffic signs for vehicles;

(3) engaging in illegal activities or seeking personal gain by using reconnaissance certificates and special traffic signs for vehicles;

(4) Lending vehicle reconnaissance certificates and special traffic signs to others for use;

(five) did not perform the national security emergency task, using special traffic signs;

(six) other dereliction of duty, abuse of power, corruption.
