I don't have time to cancel my tobacco license without opening a shop. I called several times to cancel. Won't it be cancelled automatically?

Will be automatically logged out. There are two situations that can be cancelled.

(a) the "tobacco monopoly retail license" expires, did not apply for renewal, shall be cancelled according to law;

(2) suspend business for one year without authorization, and cancel it according to law three months after the announcement.

According to Article 24 of the Detailed Rules for the Implementation of the Measures for the Administration of Tobacco Monopoly Licenses (Specific Policies), if the holder no longer engages in production and business activities within the validity period of the license, he shall apply for suspension of business in time.

If the holder fails to apply to the issuing authority for "suspension of business" within the validity period, and illegally transfers the tobacco monopoly license by buying, selling, leasing, lending or other means, the Tobacco Monopoly Bureau will cancel the holder's qualification to engage in tobacco monopoly business and make a decision not to issue a tobacco monopoly retail license within three years according to the provisions of Item 2 of Article 44 and Item 3 of Article 25 of the Measures for the Administration of Tobacco Monopoly Licenses (the State Council departmental regulations).

Detailed Rules for the Implementation of the Measures for the Administration of Tobacco Monopoly License (No.205 [2020] of the State Tobacco Law) Article 24 If the holder stops engaging in the production and operation of tobacco monopoly products within the validity period of the tobacco monopoly license, he shall apply for suspension in time.

Measures for the Administration of Tobacco Monopoly License (Decree No.37 of the Ministry of Industry and Information Technology)

Article 41 No enterprise or individual may alter, forge or alter the tobacco monopoly license. You may not buy, sell, lease, lend or illegally transfer tobacco monopoly licenses in other forms.

Article 44 Under any of the following circumstances, the issuing authority may order it to suspend its tobacco monopoly business and make rectification until it is disqualified from engaging in tobacco monopoly business according to law:

(a) the inspection does not meet the requirements of the Tobacco Monopoly Law, the Regulations for the Implementation of the Tobacco Monopoly Law and these Measures;

(2) buying, selling, leasing, lending or illegally transferring tobacco monopoly licenses in other forms;

(3) 1 year was punished by the Tobacco Monopoly Bureau or other law enforcement agencies for illegal production and sale of tobacco monopoly products for more than two times;

(four) the Tobacco Monopoly Bureau or other law enforcement agencies seized more than 50 counterfeit cigarettes and smuggled cigarettes at one time;

(5) Being investigated for criminal responsibility for illegal production and operation of tobacco monopoly products;

(6) Failing to implement the decision of the Tobacco Monopoly Bureau on administrative punishment;

(7) having its business license revoked by the administrative department for industry and commerce;

(8) An enterprise holding the license of tobacco monopoly wholesale enterprise sells tobacco leaves, cigarette paper, filter rods, cigarette tow and special machinery for tobacco to an enterprise without the license of tobacco monopoly production enterprise or tobacco monopoly wholesale enterprise without authorization;

(nine) refused to change the registration because of the change of the registered items;

(ten) other circumstances stipulated by laws, regulations and rules.
