Does SMS notification have legal effect?

Legal analysis: if the parties conclude a contract by means of data message, they may require to sign a confirmation letter before the contract is established. In view of the fact that electronic delivery uses the Internet, radio waves and other media to realize data exchange and transmission in different time and space between points, which is quite different from the traditional correspondence, the agreement on the electronic delivery method between the two parties is conducive to clarifying the terminal equipment used by the recipient to receive the notice, the commitment of risk responsibility and the effectiveness of delivery, and avoiding disputes in the future.

Legal basis: Article 87 of the Civil Procedure Law of People's Republic of China (PRC), with the consent of the addressee, the people's court may serve litigation documents by fax, e-mail and other means that can confirm receipt, except for judgments, rulings and conciliation statements. If it is delivered by the way mentioned in the preceding paragraph, the date when it reaches the addressee's specific system by fax or e-mail shall be the date of delivery.
